H 11 (2021-2022) REGULATE ALCOHOL CONSUMABLES. Filed Jan 27 2021, A BILL TO BE ENTITLED AN ACT TO REGULATE ALCOHOL IN MANUFACTURED FOOD PRODUCTS SUCH AS ICE CREAM, ICE POPS, GUM, AND GELATIN.

House committee substitute amends the 1st edition as follows. 

Amends the proposed definition for the term alcohol consumables to include any manufactured and packaged gum-based product containing at least 0.5% alcohol by volume. Makes conforming changes to the act's long title.

House committee substitute amends the 1st edition as follows.

Amends proposed GS 14-34.1A, which makes it a Class H felony to discharge or attempt to discharge any firearm or barreled weapon capable of discharging shot, bullets, pellets, or other missiles at a muzzle velocity of at least 600 feet per second at or into any unoccupied emergency vehicle. Adds a vehicle owned or operated by the Section of Community Corrections of the Division of Adult Corrections and Juvenile Justice of the Department of Public Safety to the definition of emergency vehicle.

Modifies the proposed exemption for medical services personnel under GS 14-269 from the prohibition against carrying concealed weapons. Now more specifically exempts emergency medical services personnel while on duty who are deployed as part of their official duties providing tactical medical assistance to a law enforcement SWAT team in an emergency situation (previously exempt when providing tactical medical assistance to law enforcement in an emergency situation, including a SWAT operation).

House committee substitute amends the 1st edition as follows. 

Part II

Adds a new section amending GS 116-281 regarding eligibility for need-based scholarships for students attending private institutions of higher education. Regarding eligibility based on the student being a dependent relative of an active duty member of the US Armed Forces who is abiding in the State incident to active military duty while sharing an abode with the active duty member, adds the following new provisions. Requires for the dependent relative to remain eligible under this criteria notwithstanding reassignment of the active duty member outside of the State if, at the time the dependent relative applies for admission to an eligible private postsecondary institution, the dependent relative is enrolled in a high school in NC and enrolls and remains continuously enrolled at the institution upon admission no later than the fall semester immediately following establishment of eligibility. Applies beginning with the award of scholarships for the 2021-22 academic year.

Amends proposed GS 90-12.8, which establishes new requirements for practitioners prescribing Schedule II controlled substances identified in GS 90-90(1), including opium, opiates, and opioids. Excludes from the statute's requirements veterinarians, animal hospitals, and veterinary practices.

H 132 (2021-2022) JUVENILE CODE REV'S/CIP RECOMMENDATIONS.-AB Filed Feb 23 2021, AN ACT TO MAKE REVISIONS TO THE JUVENILE CODE PURSUANT TO RECOMMENDATIONS BY THE COURT IMPROVEMENT PROGRAM.

House committee substitute makes the following changes to the 1st edition.

Section 7

Makes a technical change in proposed GS 7B-904(c1) to clarify SAMHSA means Substance Abuse and Mental Health Services Administration.

Section 14

Makes a clarifying change to the changes proposed in GS 7B-912 to specify that the information court's are required to inquire about at permanency planning hearings beginning after the juvenile's 17th birthday includes information about the juvenile's opportunity to participate in the foster care 18-21 program authorized by GS 108A-48 (previously did not specify authorizing statute). 

Section 15

Modifies the required reporting of departments of social services to the court at every hearing after the juvenile's 17 birthday, set forth in new GS 7B-912(b1). Requires the department to report on the contact information of the person responsible for overseeing voluntary foster care placements with young adults in the county department of social services with custody or placement responsibility of the juvenile and in the county department of social services where the juvenile plans to reside at 18 (previously required that of a LINKS Coordinator or equivalent in the department with custody or placement responsibility of the juvenile and in the county in which the juvenile plans to reside when he or she attains the age of 18 years).

H 134 (2021-2022) 2ND AMENDMENT PROTECTION ACT. Filed Feb 23 2021, AN ACT TO PROVIDE THAT A PERSON WHO HAS A CONCEALED CARRY HANDGUN PERMIT MAY CARRY A HANDGUN ON EDUCATIONAL PROPERTY THAT IS THE LOCATION OF BOTH A SCHOOL AND A PLACE OF RELIGIOUS WORSHIP AND TO ENACT THE 2ND AMENDMENT PROTECTION ACT OF 2021.

House committee substitute makes the following changes to the 1st edition.

Part I

Modifies new subsection (k1) in GS 14-269.2, which creates a new exception for concealed carry permit holders and others exempt from obtaining a permit from the prohibition against carrying weapons on campus and other education property. Changes the conditions for the exception to include that the person possesses and carries a handgun on educational property other than an institution of higher learning or a nonpublic, postsecondary education institution, rather than restricting the exception to carrying on education property of a nonpublic school. Adds a new provision to specify that property owned by a local board of education or county commission is not a building that is a place of worship, as the term is used to condition the exception to carrying on education property that is the location of both a school and a building that is a place of worship. Eliminates the specifications for a nonpublic school's operating hours, previously included in the conditions of the new exception which require carrying outside of operating hours. Instead, enacts a new subsection (1c) to define school operating hours to by ant time when (1) the premises are being used for curricular or extracurricular activities; (2) the premises are being used for educational, instructional, or school-sponsored activities; or (3) the premises is being used for programs for minors by entities not affiliated with the religious institution. Makes technical changes.

Makes conforming changes to GS 14-415.11(c) to provide for the exception to GS 14-269.2(k1). Adds to GS 14-415.11(c) to prohibit conceal carry permit holders from carrying in areas prohibited by GS 14-269.3 (Carrying weapons into assemblies and establishments where alcoholic beverages are sold and consumed) and GS 14-277.2 (Weapons at parades, etc., prohibited).

Part IV

Modifies the proposed exemption for medical services personnel under GS 14-269 from the prohibition against carrying concealed weapons. Now more generally exempts emergency medical services personnel while on duty who are deployed as part of their official duties providing tactical medical assistance to law enforcement in a SWAT operation (previously specified in an emergency situation).

Makes organizational changes to clarify that the proposed changes to GS 114-12.1, regarding minority sensitivity training of law enforcement personnel, are effective October 1, 2021.

H 256 (2021-2022) SMART SCH. BUS SAFETY PILOT/CERTAIN COUNTIES. Filed Mar 10 2021, AN ACT TO ESTABLISH THE SMART SCHOOL BUS SAFETY PILOT PROGRAM IN CERTAIN COUNTIES.

Directs the Department of Public Instruction (DPI) to establish the Smart School Bus Safety Pilot Program (program) with up to 17 authorized local school administrative units, beginning with the 2021-22 school year and ending on or before January 1, 2025. Requires participating units to contract with qualifying vendors to provide technology and services for student transportation. Allows DPI to authorize a replacement unit with similar student population to participate in the program in the event an authorized unit elects not to participate. Provides ten minimum requirements for the technology and services provided, including improving overall communications and reporting on school buses, and enabling GPS tracking of school buses. Details requirements and contingencies of participation, including requiring the outfitting of school buses designed to transport children with disabilities as appropriate, providing that hardware becomes the property of the unit at the program's conclusion, and requiring that the technology be used through at least the conclusion of the 2023-24 school year. 

Requires DPI to annually report, beginning July 1, 2022, to the specified NCGA committees and division. Details report requirements. 

Appropriates $11,039,330 from the General Fund to DPI for 2021-22 to establish the program. Allocates the funds in specified amounts to each unit authorized to participate in the program. 

Effective July 1, 2021. 

H 257 (2021-2022) JOINT MUNICIPAL POWER AGENCIES/INVESTMENTS. Filed Mar 10 2021, AN ACT TO AUTHORIZE MONEYS DEPOSITED IN CERTAIN DECOMMISSIONING FUNDS ESTABLISHED BY NORTH CAROLINA MUNICIPAL POWER AGENCY NUMBER 1 TO BE INVESTED THROUGH THE STATE TREASURER'S ANCILLARY GOVERNMENTAL PARTICIPANT INVESTMENT PROGRAM.

Amends GS 147-69.2 to authorize the State Treasurer to make investments to the credit of the Catawba Unit No. 1 Decommissioning Trust Fund and the Catawba Unit No. 2 Decommissioning Trust Fund, as identified (Trust Funds). Authorizes the State Treasurer to invest the funds deposited in the Trust Funds as general obligations, obligations of other states, obligations of cities, obligations of domestic and foreign companies meeting specified rating requirements, and asset-backed securities meeting specified rating requirements, as described in subdivisions (b)(1) through (6) of the statute.

Additionally authorizes the State Treasurer to invest funds deposited in the Trust Funds pursuant to subdivision (b)(6c), which allows domestic and foreign investment in obligations, debt securities, and asset-backed securities that do not meet the requirements of subdivisions (b)(1) through (6); excludes these investments from the 7.5% cap placed on the market value of all invested assets of Retirement Systems under the subdivision. Additionally authorizes the State Treasurer to invest funds deposited in the Trust Funds pursuant to subdivision (b)(8), in a strategy composed primarily of equity securities traded on a public securities exchange or market organized and regulated pursuant to the laws of the jurisdiction of the exchange or market and issued by any company incorporated or otherwise created or located within or outside the United States as long as the investments meet the two specified conditions of the subdivision; however, excludes these investments from the 65% cap placed on the market value of all invested assets of Retirement Systems under the subdivision. Authorizes the State Treasurer to require a minimum deposit of up to $100,000 and assess reasonable fees of up to 15 basis points per annum to defray administration costs as a condition of making an investment pursuant to subdivisions (b)(6c) and (b)(8). 

Amends GS 159B-18 to authorize the investment of funds deposited in the Trust Funds as provided in GS 147-69.2(b6), as enacted. Further describes the Trust Funds.

H 258 (2021-2022) OCEAN ISLE MUSEUM FOUNDATION FUNDS. Filed Mar 10 2021, AN ACT APPROPRIATING FUNDS TO THE OCEAN ISLE MUSEUM FOUNDATION FOR CAPITAL IMPROVEMENTS, STORM WATER DAMAGE REPAIRS, AND LOST REVENUE DUE TO COVID-19-RELATED SHUTDOWNS.

Includes whereas clauses. Appropriates $392,000 from the General Fund to the Ocean Isle Museum Foundation, Inc. for 2020-21 for repairs, renovations and operating losses sustained due to repeated weather events and COVID-19 related lockdowns. Effective July 1, 2021.

H 259 (2021-2022) ELECTION INTEGRITY ACT. Filed Mar 10 2021, AN ACT TO REQUIRE THAT ALL VOTING SYSTEMS USED FOR ELECTIONS IN THIS STATE BE MANUFACTURED IN THE UNITED STATES OF AMERICA, TO CODIFY THE COMMON LAW REQUIREMENT OF UNITED STATES CITIZENSHIP TO QUALIFY AS A JUROR, TO ALLOW A CLERK OF COURT TO HEAR JURY EXCUSES IF SO DESIGNATED BY THE CHIEF DISTRICT COURT JUDGE, TO REQUIRE THAT THE NAMES AND ADDRESSES OF PERSONS REQUESTING TO BE EXCUSED FROM JURY DUTY BASED ON DISQUALIFICATION BE SHARED WITH THE STATE BOARD OF ELECTIONS IF THE DISQUALIFICATION IS DUE TO UNITED STATES CITIZENSHIP, AND TO PROVIDE REPORTING REQUIREMENTS FOR THE STATE BOARD OF ELECTIONS FOLLOWING A POST-ELECTION AUDIT FOR A GENERAL ELECTION.

Enacts GS 163-165.7(k) to require the State Board of Elections to mandate that all voting systems, including software, used for elections be manufactured in the US by US-owned companies. Applies to voting systems acquired on or after the date the act becomes law.

H 260 (2021-2022) FEES FOR ADVANCED PLACEMENT COURSES/UNC. (NEW) Filed Mar 10 2021, AN ACT TO ESTABLISH A PROGRAM TO EXEMPT STUDENTS ENROLLED IN SECONDARY SCHOOLS OPERATED BY THE UNIVERSITY OF NORTH CAROLINA FROM PAYING FEES RELATED TO ADVANCED PLACEMENT COURSES.

Enacts GS 116-43.30 to exempt students enrolled in the NC School of Science and Math and the UNC School of the Arts from paying exam or course registration fees for advanced courses, regardless of the score the student achieves on the exam, to the extent funds are made available. States legislative intent, and defines advanced course to mean an Advanced Placement course, an International Baccalaureate Diploma Programme course, or a Cambridge Advanced International Certificate of Education course. Directs the UNC System Office to annually report to the specified NCGA committee, as specified, beginning December 15, 2022.

Appropriates $90,000 in recurring funds from the General Fund to the UNC Board of Governors for 2021-22 to pay the exam and course registration fees for advanced courses for eligible students. 

Effective July 1, 2021.

H 261 (2021-2022) RAISE MIN. AGE/JUVENILE JURISDICTION. Filed Mar 10 2021, AN ACT TO MODIFY THE DEFINITIONS OF DELINQUENT JUVENILE AND UNDISCIPLINED JUVENILE TO INCLUDE ONLY JUVENILES AT LEAST TEN YEARS OF AGE AND TO MODIFY THE MINIMUM AGE OF JUVENILE JURISDICTION.

Amends GS 7B-1501 to limit the scope of the defined terms delinquent juvenile and undisciplined juvenile, as used in Subchapter II, to juveniles at least 10 years old (was, at least 6 years old). 

Similarly, amends GS 143B-805 to limit the scope of the defined terms delinquent juvenile and undisciplined juvenile, as used in Part 3 of Article 13 governing the Juvenile Justice Section of the Department of Public Safety, to juveniles at least 10 years old (was, at least 6 years old). 

Applies to delinquent and undisciplined acts committed on or after the date the act becomes law.

Effective four years from the date the act becomes law, repeals GS 7B-1903(f), which prohibits using physical restraints on a juvenile less than 10 years old during transport when the court determines the juvenile needs an evaluation for medical or psychiatric treatment and there is no pending delinquency charge, unless determined to be reasonably necessary for safety.

Makes conforming changes to GS 7B-2102 to remove the age restrictions for fingerprinting and photographing juveniles (currently, requires juveniles be 10 years or older at the time of the offense).

Makes conforming changes to GS 7B-2513 to remove the age restrictions for commitment of a delinquent juvenile to the Division of Adult Correction and Juvenile Justice for placement in a youth development center (currently, requires juveniles to be at least 10 years old).

H 262 (2021-2022) SMART START FUNDS. Filed Mar 10 2021, AN ACT TO PROMOTE YOUNG CHILDREN'S HEALTHY DEVELOPMENT THROUGH CONTINUED INVESTMENT IN THE NORTH CAROLINA PARTNERSHIP FOR CHILDREN, INC., (SMART START) PROGRAM.

Includes whereas clauses. Appropriates $30 million in recurring funds for each year of the 2021-23 fiscal biennium from the General Fund to the Department of Health and Human Services, Division of Child Development and Early Education, to be allocated to the North Carolina Partnership for Children, Inc., (Smart Start) for distribution to Smart Start local partnerships. Requires that the funds be used to provide additional funding for the following Smart Start activities or initiatives: (1) $15 million for child care–related activities; (2) $7.5 million for family support activities; (3) $3.75 million for health-related activities; and (4) $3.75 million for child care subsidy. Effective July 1, 2021.

H 264 (2021-2022) EMERGENCY POWERS ACCOUNTABILITY ACT. Filed Mar 10 2021, AN ACT TO CLARIFY THE EXPIRATION OF A STATEWIDE STATE OF EMERGENCY AND THE EXERCISE OF CERTAIN POWERS UNDER A STATEWIDE STATE OF EMERGENCY, TO CLARIFY THE ABATEMENT OF STATEWIDE IMMINENT HAZARDS, AND TO CLARIFY STATEWIDE QUARANTINES.

Amends GS 166A-19.20 to provide for the expiration of a gubernatorially or legislatively declared state of emergency applicable to a statewide emergency area seven days after issuance without concurrence of the Council of State. Allows for a 30-day extension with concurrence of the Council of State. Prohibits the Governor from issuing or extending a declaration applicable to a statewide emergency area the same or substantially similar to that which failed concurrence of the Council of State based on the same emergency.

Amends GS 166A-19.3 to define concurrence of the Council of State to mean the consensus, within 48 hours of contact, of a majority of the Council of State prior to the Governor exercising a power of authority requiring a concurrence of the Council of State. Requires the Governor to document and release each contact and response, and deems the documentation a public record. Deems failure to respond a concurrence. Also defines statewide emergency area to mean any emergency area applicable to two-thirds or more of the counties in the state. Defines Council of State.

Amends GS 166A-19.30, which states additional powers of the Governor in the event of insufficient local control of a gubernatorially or legislatively declared state of emergency to assure adequate protection for lives and property. Adds the following requirements and limitations with respect to the exercise of those additional powers, including (1) immediate notification of the affected local authorities, (2) concurrence of the Council of State, and (3) expiration of the exercise in the same manner as statewide declarations of emergency under GS 166A-19.20, as amended.

Amends GS 130A-20, which provides authority for the Secretary of Health and Human Services (Secretary), Secretary of Environmental Quality, and local health directors to order abatement of an imminent hazard; enter upon property and take abatement action upon noncompliance after notice; and take a lien on the property for cost of abatement. Separates the authority of the Secretaries from the local health directors. Clarifies that the authority of local health directors applies to specific properties.

Adds new subsection (c) to grant the Secretary the authority to determine that a class or category of property uses presents a statewide imminent hazard and to order persons in control of that type of class or category of property uses to abate the statewide imminent hazard upon notification to the Governor and the Governor's concurrence of the Council of State. Explicitly prohibits any action to close a category or class of properties without a concurrence of the Council of State. Allows the Secretary to enter the property and take necessary abatement actions for noncompliance with the order after notice or a reasonable attempt to notify the persons in control of a specific property. Deems the Secretary of Environmental Quality to share the rights set out in new subsection (c) to enforce the waste management and drinking water regulations of Articles 9 and 10. Aligns the defined terms concurrence of Council of State, and statewide, with the new terms set out in GS 166A-19.3, as amended. 

Deems any power exercised under a state of emergency or declaration of emergency existing on the date the act becomes law that would require a concurrence of the Council of State pursuant to the act to expire two days after the act becomes law, unless a concurrence of the Council of State is sought and received in accordance with the act.

H 266 (2021-2022) URGING CONGRESS/NATIONAL INFRASTRUCTURE BANK. Filed Mar 10 2021, A HOUSE RESOLUTION URGING CONGRESS TO CREATE A NATIONAL INFRASTRUCTURE BANK.

Includes whereas clauses. Provides that the House of Representatives calls upon the US Congress to introduce and pass legislation similar to HR 6422 to create National Infrastructure Bank to finance urgently needed infrastructure projects throughout the US. Requires the Principal Clerk to transmit copies of this resolution to each member of North Carolina's Congressional delegation, Governor Cooper, and President Biden.

H 267 (2021-2022) CONCEALED HANDGUN PERMIT/PHOTO. Filed Mar 10 2021, AN ACT TO REQUIRE A CURRENT AND VALID PICTURE OF A PERMITTEE ON A CONCEALED HANDGUN PERMIT.

Amend GS 14-415.13(a) to require applicants for a concealed handgun permit to provide the sheriff with a copy of a current and valid photo identification (was, photographs). Amends GS 14-415.10 by defining photo identification as a North Carolina drivers license or special identification card. Amends GS 14-415.16 to require submission of a copy of a current and valid photo identification when applying to renew the concealed handgun permit. Amend GS 14-415.17 to require the inclusion of the photo from the photo identification on the permit.

Requires the State Bureau of Investigation (SBI) to adopt rules establishing the size of the photo required and placement on the permit. Allows the SBI to adopt temporary rules to implement this act. 

Applies to permits issued or renewed on or after October 1, 2021.

Filed Mar 10 2021, AN ACT PROVIDING A COST-OF-LIVING ADJUSTMENT FOR RETIREES OF THE TEACHERS' AND STATE EMPLOYEES' RETIREMENT SYSTEM, THE CONSOLIDATED JUDICIAL RETIREMENT SYSTEM, AND THE LEGISLATIVE RETIREMENT SYSTEM; AND APPROPRIATING FUNDS FOR THAT PURPOSE.

Amends GS 135-5 (concerning the Teachers' and State Employees' Retirement System), GS 135-65 (concerning the Consolidated Judicial Retirement System), and GS 120-4.22A (concerning the Legislative Retirement System), to provide, from and after July 1, 2021, a 2% increase in the retirement allowance to or on account of beneficiaries whose retirement commenced on or before July 1, 2020, or a prorated amount for those whose retirement commenced after July 1, 2020, but before June 30, 2021, as determined by the respective Board of Trustees.

Appropriates $96 million from the General Fund to the Reserve for Retiree Cost-of-Living Adjustments for each of the 2021-22 and 2022-23 fiscal years to implement the act.

H 271 (2021-2022) EMINENT DOMAIN. Filed Mar 10 2021, AN ACT TO AMEND THE NORTH CAROLINA CONSTITUTION TO PROHIBIT CONDEMNATION OF PRIVATE PROPERTY EXCEPT FOR A PUBLIC USE, TO PROVIDE FOR THE PAYMENT OF JUST COMPENSATION WITH RIGHT OF TRIAL BY JURY IN ALL CONDEMNATION CASES, AND TO MAKE SIMILAR STATUTORY CHANGES.

Subject to approval by the voters at the 2022 general election, amends Article I of the North Carolina Constitution by adding a new Sec. 39 to prohibit the taking by eminent domain of private property except for a public use only. Directs that just compensation be paid to the private property owner and provides that either party may request that the amount of just compensation be determined by a jury. Provides for method of voting pursuant to GS Chapter 163. Provides that if the majority of votes are in favor of the amendment, the State Board of Elections is to certify the amendment to the Secretary of State and the amendment will become effective upon certification and apply to takings of private property by eminent domain after the certification date.

Amends GS 40A-3(a), (b), and (b1) to restrict private condemnors and local public condemnors to exercising the power of eminent domain for a public use only (was, for a public use or benefit). Amends the list of private condemnors permitted to exercise the power of eminent domain to also include corporations, bodies politic, or persons exercising eminent domain for communication facilities (previously, specified telegraphs and telephones), facilities related to the distribution of natural gas, and pipelines or mains for the transportation of natural gas (was, gas). Makes additional clarifying changes.

Also amends subsection (c) to limit takings by political entities (other public condemnors) to the exercise of eminent domain for public use only (was, public use or benefit).

Enacts a new subsection (d) to GS 40A-3 to provide that private condemnors, local public condemnors, and other public condemnors in subsections (a), (b), (b1), and (c) of this statute, for the public use, have the power of eminent domain and may acquire any property for the connection of any customer(s) via purchase, gift, or condemnation.

Changes to GS 40A-3 are effective when the act becomes law, applying to takings occurring on or after that date.

S 220 (2021-2022) THE REOPEN OUR SCHOOLS ACT OF 2021. (NEW) Filed Mar 9 2021, AN ACT TO PROVIDE ACCESS TO IN-PERSON LEARNING FOR STUDENTS IN GRADES KINDERGARTEN THROUGH TWELVE.

Senate committee substitute deletes the content of the 1st edition and instead provides the following. 

Mandates that all local school administrative units provide in-person instruction to K-12 students of their unit for the remainder of the scheduled 2020-21 school year beginning no later than the first instructional day scheduled in the adopted school calendar that occurs 21 days following the date the act becomes law. Defines in-person instruction to require meal service and transportation services.

Details criteria for the provision of in-person instruction, including compliance with the Strong Schools NC Public Health Toolkit, as it existed on March 4, 2021, for implementation of Plan A (Minimal Social Distancing) and Plan B (Moderate Social Distancing) as appropriate for reopening. Requires instruction under Plan A to all students enrolled in grades K-5. Requires instruction under Plan A or Plan B to all students enrolled in grades 6-12, at the discretion of the local board, except that local boards are required to offer instruction under Plan A to students with individualized education program (IEPs) or a section 504 plan at the discretion of the student's parent or guardian. Requires prior notification of the Department of Health and Human Services and a description of a plan to move to Plan A by local boards to offer Plan A to students enrolled in grades 6-12. Requires partnering with the ABC Science Collaborative of the School of Medicine at Duke (ABC Collaborative) to collect and analyze data from units for students in Plan A in grades 6-12, with contact tracing and reporting as specified. Mandates that local boards continue to provide remote instruction options for all students to elect to participate in at the parent or guardian's discretion. Authorizes local boards to revise the 2020-21 school calendar to reschedule teacher workdays to be used to prepare for a return to Plan A instruction prior to the date in-person instruction is required by the act. Grants local boards flexibility in day-to-day shifts from in-person instruction to remote instruction due to COVID-19 exposures resulting in insufficient school personnel or required student quarantines. Requires a local board to report any shift by a school or classroom to remote instruction to the Department of Public Instruction (DPI) within 72 hours of the shift.

Requires DPI to contract with the ABC Collaborative within federal funds available to provide data collection, analysis and interpretation of COVID-19 related metrics of student, teacher, and staff safety for local units providing in-person instruction under Plan A for middle and high school students. Requires the contract to allocate $500,000 to Duke University for these services. Details actions the ABC Collaborative must take under the contract. Requires the ABC Collaborative to report to the specified NCGA committees, DPI, the State Board of Education, DHHS, and the Governor, with an interim report due by the last calendar day of March, April, and May of 2021, and the final report due by June 30, 2021. Specifies content requirements. 

Directs DPI to execute the contract by the fifteenth day after the act becomes law, and disburse the funds allocated to Duke by the contract within five days of execution. Requires the contract to terminate by September 15, 2021. Exempts the contract from initial purchase and contract requirements.

Subject to HB 196 of the 2021 Regular Session (2021 COVID-19 Response and Relief) becoming law, amends Section 5A of SL 2020-1 (2020 COVID Relief Bill Modifications), as amended by that act, to account for the allocation of funds in the contract with Duke within federal funds required to be reserved by DPI after DPI allocated federal funds to public school units made available from the Elementary and Secondary School Emergency Relief II (ESSER II) Fund. Requires $500,000 of the reserved ESSER II Fund funds to be used to contract with Duke for the ABC Collaborative.

Authorizes the Governor to order, during the remainder of the 2020-21 school year, individual local school administrative units to close full-time in-person instruction and provide hybrid or remote learning options or to close, restrict, or reduce operations within schools of that unit by executive order stating the reasoning for requiring closure, restriction, or reduction in operation. Prohibits the Governor from issuing a statewide executive order for school closure, restriction, or reduction in operation, and prohibits the Governor from using any other authority to do so.

Makes conforming changes to the act's titles.

S 226 (2021-2022) AMEND HIE MANDATORY PARTICIP. &AMP ENFORCEMENT. Filed Mar 10 2021, AN ACT EXTENDING THE DEADLINES FOR MANDATORY PARTICIPATION IN THE STATEWIDE HEALTH INFORMATION EXCHANGE NETWORK KNOWN AS NC HEALTHCONNEX FOR CERTAIN PROVIDERS AND ENTITIES; AND ESTABLISHING A CIVIL PENALTY AS AN ENFORCEMENT MECHANISM FOR MANDATORY PARTICIPATION.

Amends GS 90-414.4(a1), making the following one-year extensions for mandatory connection to the Health Information Exchange (HIE) Network. Requires participation by providers of Medicaid and State-funded health care services not otherwise provided for by October 1, 2022. Requires participations by ambulatory surgical centers, licensed dentists, licensed physicians with a primary practice in psychiatry, and the State Lab of Public Health by June 1, 2022. Requires participation by registered pharmacies, and state health care facilities under the Secretary of the Department of Health and Human Services' jurisdiction by June 1, 2022. 

Enacts GS 90-414.4(b1) requiring the HIE Network Authority to assess a civil penalty not exceeding $10 per claim to any provider or entity that fails to connect to the HIE Network and submit required data through the HIE Network as mandated in existing subsection (b) of the statute. Requires remittance to the Civil Penalty and Forfeiture Fund. Requires the provider or entity to take one of four actions within 30 days of the assessment, including payment of the penalty in full, executing a participation agreement, requesting an exemption or hardship extension, or filing a contested case petition, as specified. Enacts subsection (b2), subjecting assessment proceedings to the Administrative Procedure Act, GS Chapter 150B. Authorizes the HIE Authority to bring an action to recover the penalty if no action is taken by the provider or entity within 30 days' notice of the penalty or 30 days following affirmation of the penalty. Specifies that such an action does not relieve a party from other penalties prescribed by law.

Amends GS 90-414.7, adding the authority to assess civil penalties as provided in GS 90-414.4(b1), as enacted, to the powers of the HIE Authority. 

Effective October 1, 2021, and applies to violations of GS 90-414.4(b) occurring on or after that date.

S 227 (2021-2022) CITIES/FLOOD REDUCTION TECHNIQUES. Filed Mar 10 2021, AN ACT GRANTING CITIES THE SAME AUTHORITY AS COUNTIES TO UNDERTAKE ACTIVITIES WITHIN THEIR STORM MANAGEMENT PROGRAMS TO IMPLEMENT FLOOD REDUCTION TECHNIQUES THAT RESULT IN IMPROVEMENTS TO PRIVATE PROPERTY.

Enacts GS 160A-311.1, authorizing cities to take the following actions within its stormwater management program: (1) purchase property for the purpose of demolishing flood-prone buildings; and (2) implement flood damage reduction techniques that result in improvements to private property, including elevating structures or their associated components and demolishing or retrofitting flood-prone structures. States legislative findings regarding stormwater management programs, and limits the scope of the statute to cities with a population of 200,000 or more.

Requires a city council to approve a policy document governing implementation of the authorized flood damage reduction techniques which improve private property. Details five requirements of a city's policy document, including requiring prior consent of the property owner, requiring a determination that improving the stormwater system is not practically feasible or cost-effective, stating the minimum financial contribution a private property owner must make, and requiring reimbursement by the property owner of city funds if the property is sold within five years of project completion. Requires an existing stormwater advisory committee to review and approve such projects, and submit an annual report to the city council for its review.

S 228 (2021-2022) ALLOW EMPLOYERS TO OFFER EPO BENEFIT PLANS. Filed Mar 10 2021, AN ACT TO LOWER HEALTH CARE COSTS AND EXPAND ACCESS BY ALLOWING SMALL BUSINESSES TO OFFER EXCLUSIVE PROVIDER BENEFIT PLANS.

Enacts GS 58-50-56.1 as follows. Regarding continuity of care following a termination of a contract between an insurer and a health care provider offering an exclusive provider benefit plan due to a change in the terms of provider participation in the benefit plan when an insured is undergoing treatment from the provider for an ongoing special condition on the date of termination, requires the insurer to timely notify the insurer of the right to elect continuation of coverage of treatment by the provider during a transitional period, subject to the insured having a claim for services provided by the terminated provider or the insured otherwise being known as a patient of the terminated provider by the insurer. Defines ongoing special condition to include specified acute illnesses, chronic illnesses, and terminal illnesses, and pregnancy from the start of the second trimester. Defines exclusive provider benefit plan (benefit plan), insurer, and terminated or termination.

Requires each benefit plan offered by an insurer to provide transition coverage to individuals who are newly covered by a benefit plan because the individual's employer has changed benefit plans and are undergoing treatment from a provider for an ongoing special condition. Requires an insurer to notify the newly covered insured on the date of enrollment of the right to elect continuation of coverage of treatment by a provider that is not contracted with the benefit plan and permit the newly covered insured to elect to continue to be covered with respect to the treatment by the provider of an ongoing special condition during a transitional period.

Allows the treating hospital care provider to determine the length of the transitional period, not exceeding 90 days after the date of the notice to the individual regarding termination of the provider or the date of enrollment in a new benefit plan, as described.

Provides for specified extensions of the general transitional period for  individuals who had scheduled or were on a waiting list to schedule surgery, organ transplantation, or inpatient care; individuals entering the second trimester of pregnancy; and individuals who were terminally ill.

Identifies six terms and conditions upon which an insurer can condition coverage of a continued treatment by a provider, including that the provider agrees to adhere to the insurer's established policies and procedures for participating providers. 

Provides parameters for the statute's construction, including that the statute does not require an insurer to offer a transitional period when the insurer terminates a provider's contract for reasons relating to quality of care or fraud. 

Requires insurers to include a clear description of an insured's rights under the statute in its evidence of coverage and summary plan description.

Authorizes the Department of Insurance to adopt temporary implementing rules.

Makes conforming changes to GS 58-50-56(i).

Applies to insurance contracts issued, renewed, or amended on or after October 1, 2021.

Appropriates $821,089 in recurring funds for each year of the 2021-23 biennium and $660,000 for 2021-22 from the General Fund to the State Highway Patrol to fund 12 full-time State Trooper positions. Specifies that the positions funded in this act are to result in an increase of at least 12 State Troopers assigned to State Highway Patrol District H5 of Troop H. Effective July 1, 2021.

S 231 (2021-2022) MILITARY FAMILY SPORTS ACT. Filed Mar 10 2021, AN ACT TO REORGANIZE RULES REGARDING THE REGULATION OF INTERSCHOLASTIC ATHLETICS IN PUBLIC SCHOOLS AND TO REQUIRE THE STATE BOARD OF EDUCATION TO ADOPT A RULE TO EXPAND ELIGIBILITY FOR CHILDREN OF MILITARY FAMILIES TO PARTICIPATE IN INTERSCHOLASTIC ATHLETICS.

Enacts Article 29E, Interscholastic Athletic Competition, in GS Chapter 115C. Charges the State Board of Education (State Board) with adopting rules governing interscholastic athletic activities conducted by local boards of education, including eligibility for student participation. Allows for the State Board to authorize a designated organization to apply and enforce the Board's rules at the high school level. Requires the State Board to adopt rules to require annual distribution to specified middle and high school employees, first responders, volunteers, and parents and students participating in interscholastic athletic activities of a concussion and head injury information sheet. Requires school employees, first responders, and volunteers to sign the sheet, and students and parents must sign the sheet and return it to the coach before participating. Requires the signed sheets to be maintained by each middle and high school. Requires removal from the activity of any participating student who exhibits signs or symptoms consistent with a concussion for the day. Requires prior evaluation by and written clearance for participation on a subsequent day by a licensed physician, a licensed neuropsychologist working in consultation with a licensed physician, a licensed athletic trainer, a physician assistant, or a nurse practitioner, as described.

Also requires the State Board to adopt a rule that requires all middle schools and high schools to develop a venue specific emergency action plan to deal with serious injuries and acute medical conditions, as specified. Details minimum plan requirements the rule must include, such as requiring the plan to be in writing, approved by the principal, and reviewed and rehearsed annually.

Directs the State Board to adopt a rule providing that any child of a military family who transfers into a middle school or high school due to the military service of his or her parent or legal guardian is eligible to participate in interscholastic athletic activities occurring during that semester, even if the student does not meet the minimum course enrollment requirements or has not met the deadline to apply to participate. 

Makes conforming changes to GS 115C-12(23) regarding the State Board power to adopt rules governing interscholastic athletic activities conducted by local boards, with specified requirements for middle schools and high schools. 

Applies beginning with the 2021-22 school year.

Allows establishing a specified full-time equivalent position to represent the State's interests and be responsible for State-owned assets as the new State's veterans home becomes operational.

Reduces from five to four the members who must be appointed by the Commissioner who are fire and casualty insurance agents licensed and actively engaged in writing motor vehicle insurance in the State. Enacts GS 153A-212.3 and GS 160A-289.3 to prohibit governmental entities from intentionally prohibiting, preventing, or delaying law enforcement or fire and rescue services from accessing a specifically bounded area within the governmental entity's jurisdiction during a public demonstration unless the services are replaces by like services provided by another governmental entity. Defines governmental entity to include mayor, chief executive officer, governing body, board, commission, committee, or department of a municipality, county, or other political subdivision of the State. Makes governmental entities liable for damages, injury, or death proximately caused by the governmental entity in violation of the statute. Excludes tactical decisions made by law enforcement or fire and rescue services personnel based on the risks to or safety of personnel or the public. Applies to demonstrations occurring on or after the date the act becomes law.

H 265 (2021-2022) REINSTATE MTN ISLAND LAKE MARINE COMMISSION. Filed Mar 10 2021, AN ACT TO AUTHORIZE THE REINSTATEMENT OF THE MOUNTAIN ISLAND LAKE MARINE COMMISSION.

Amends GS 77-70, the definitions for the Mountain Island Lake Marine Commission (Commission), making clarifying changes and adding and defining participating counties.

Amends GS 77-71, to make organizational changes, now providing that the provisions of any joint resolution can be modified, amended, or rescinded by a subsequent joint resolution made with the unanimous consent of the participating counties (previously did not require unanimous consent). Provides that after a unilateral withdrawal from participation by a participating county the Commission will continue with the remaining participating counties, with any property of the withdrawing county being distributed as determined by all participating counties. Provides that all property of the Commission will be distributed as specified if all participating counties withdraw.

Amends GS 77-72, deleting various provisions that provided for the membership of the governing board. Now provides that the Commission will have a governing board of seven members, subject to the provisions of this section. Makes organizational changes. 

Amends GS 77-73, 77-74, 77-75, 77-76(a), and 77-78(a), making technical and conforming changes. 

Provides that this act only applies to Gaston, Lincoln, and Mecklenburg counties.

Deems property in the described territories as of January 1, 2021, no longer subject to municipal taxes imposed for taxable years beginning July 1, 2021.

Makes conforming changes to the act's titles.

Applicable to Durham County only, amends GS 166A-19.24, which authorizes remote meetings of a public body during a declaration of emergency by the Governor or the NCGA. Adds a new subsection to require a quasi-judicial proceeding by the county Board of Adjustment, authorized to be held remotely pursuant to the statute subject to due process and notice requirements, to be continued if one or more persons who have standing to participate in the hearing do not consent to the remote hearing. Requires that the hearing be continued until the sooner of 30 days or when the Board of Adjustment is able to meet in person. Applies to proceedings initiated on or after the date the act becomes law.

S 232 (2021-2022) STUDENTS, PARENTS, COMMUNITY RIGHTS ACT. Filed Mar 10 2021, AN ACT TO PERMIT INCREASED ACCESS TO OUTDOOR SPORTING FACILITIES IN PUBLIC AND NONPUBLIC HIGH SCHOOLS IN CERTAIN COUNTIES.

Includes whereas clauses. Limits the scope of the act to Alleghany, Ashe, Avery, Burke, Caldwell, Madison, McDowell, Mitchell, Polk, Rutherford, Watauga, Wilkes, and Yancey counties.  Authorizes all public and nonpublic high schools to limit the number of spectators at outdoor sporting events for the remainder of the scheduled 2020-21 school year, as follows. Defines spectator to exclude athletes, school employees, entertainers, and event support staff. Caps spectators at 50% capacity of an outdoor facility's approved occupancy capacity under the building code, or no more than seven persons for every 1,000 feet for those without an approved occupancy capacity. Specifies that for outdoor facilities allowing spectators to bring their own seats, individuals sitting in their own seats do not count toward the limit if the individuals maintain at least 6 feet of distance between themselves and anyone outside of their family unit. Requires high schools to comply with the requirements of the StrongSchoolsNC Public Health Toolkit as it existed on February 2, 2021, and the Interim Guidance for Administrators and Participants of Youth and Amateur Sports Programs as it existed on January 28, 2021, in allowing access to outdoor sporting facilities so long as the requirements are consistent with the act's provisions. Does not prohibit a school's implementation of stricter access to outdoor sporting events at that school. 

S 233 (2021-2022) MODIFY FOX/COYOTE TAKING FOR CERTAIN COUNTIES. (NEW) Filed Mar 10 2021, AN ACT TO MODIFY THE LIST OF COUNTIES THAT HAVE AN OPEN SEASON FOR TAKING FOXES AND COYOTES DURING CERTAIN ANNUAL TRAPPING SEASONS.

Amends Section 1 of SL 2018-10, which establishes an open season for taking foxes with weapons and for foxes and coyotes by trapping during the trapping seasons annually set by the Wildlife Resources Commission, with no tagging requirements and no bag limit, applicable to specified counties only. Adds the counties of Guildford, Harnett, and Randolph to the scope of Section 1, and removes Cumberland County. Applies to offenses committed on or after October 1, 2021.

S 234 (2021-2022) LINCOLN CO. BD. OF ED./PARTISAN ELECTION. Filed Mar 10 2021, AN ACT TO CHANGE THE ELECTION METHOD FOR THE LINCOLN COUNTY BOARD OF EDUCATION FROM NONPARTISAN TO PARTISAN.

Identical to H 244, filed 3/9/21.

Amends Section 5 of SL 1973-876, as amended, to replace the elections provisions for the election of the Lincoln County Board of Education (Board) as follows. Provides for partisan election (currently nonpartisan) beginning at the general election in 2022, with election in each even-numbered year thereafter as terms expire in the same manner as other county officers. Provides for staggered terms, with the election of three members to serve four-year terms in 2022 and quadrennially thereafter, and the election of four members to serve four-year terms in 2024, and quadrennially thereafter. Requires members to serve until a successor has been elected and qualified. Provides for appointment by the Board to fill vacancies determined by the basis of election, with members elected on a partisan basis to be filled by appointment of the remaining members in accordance with GS 115C-37.1. No longer includes residency criteria for members based on township. 

Provides a savings clause for members elected in 2018 or 2020, and requires those members and anyone appointed to fill an unexpired term of those members, to serve until a successor has been elected and qualified. 

Amends GS 115C-37.1(d), effective on the first Monday of December of 2022, to include Lincoln County in the scope of the statute which governs vacancies in offices of county boards elected on a partisan basis.

S 236 (2021-2022) REQ. CONSENT/EARLY VOTING/CHAR-MECK. SCHOOLS. Filed Mar 10 2021, AN ACT TO REQUIRE CONSENT FROM THE CHARLOTTE-MECKLENBURG SCHOOLS' SUPERINTENDENT BEFORE USING CERTAIN SCHOOLS AS EARLY ONE-STOP VOTING SITES.

Prohibits Charlotte-Mecklenburg County Schools (CMS) from being used for early one-stop voting locations without the prior consent of the CMS Superintendent, who must have up to five school operating days to grant or deny consent. Requires the CMS Superintendent to grant consent if the school building is or can be configured to provide a separate entrance and exit for voters and barriers to keep voters from accessing areas of the school where students have access during operating hours. Requires payment or reimbursement for costs to prepare and maintain the school building for safety to be paid or reimbursed by the Mecklenburg County Board of Elections. Applies to elections held on or after the date the act becomes law.
