H 199 (2025-2026) AUTHORIZE MUNICIPAL DEANNEXATION. (NEW) Filed Feb 25 2025, AN ACT PROVIDING A PROCESS FOR MUNICIPALITIES AND PROPERTY OWNERS TO INITIATE DEANNEXATION OF PROPERTY FROM THE CORPORATE LIMITS OF A MUNICIPALITY.

House committee substitute to the 2nd edition replaces the prior edition with the following. Makes conforming changes to act’s long and short titles.

Enacts Article 4B, “Deannexation of Corporate Limits,” to GS Chapter 160A, to provide a uniform procedure for the contraction of municipal boundaries in a transparent, fiscally responsible, locally accountable, and fair manner. Specifies that the deannexation process is a legislative function of the municipality.  Requires, in new GS 160A-58.101, that the municipality prepare a legible map of the area to be deannexed, a statement showing how the proposed deannexation will affect the municipality's finances and services, and a plan for the services to the area proposed for deannexation prior to holding any hearing on the matter. Establishes the following procedure for deannexation initiated by a municipality in GS 160A-58.102: (1) the adoption of a resolution containing the property description as specified; (2) at least 30 days prior to the public hearing, approval of the report discussed above along with public posting of a summary of the report as described; (4) a public hearing on the resolution, held only after separate notice of that hearing has been provided; (5) adoption of an ordinance with the five described components authorizing the deannexation, held at any regular or special meeting held after the hearing.  Provides for delivery of the adopted ordinance together with the list of the real property owners of parcels and registered voters within the area described in the deannexation ordinance within five business days to the tax assessor and the county board or boards of elections of the county in which the deannexed area lie. Provides for simulataneous proceedings if the municipality is considering deannexing multiple areas.

Specifies that from and after the effective date of the deannexation ordinance, the deannexed area and its citizens and property are not subject to any debts, laws, ordinances, and regulations in force in the municipality except to the extent that such debts, laws, ordinances, and regulations, may apply to other similarly situated citizens and property outside the corporate limits of the municipality.

Provides for challenge to the deannexation ordinance by referendum in GS 160A-58.103. Requires a petition signed by 25% of the registered voters residing in the area described in the deannexation ordinance. Requires city clerk to validate the signatories as described before the question of deannexation is placed on the ballot. Directs the municipal governing board to notify the appropriate county board or boards of elections of the adoption of the deannexation ordinance and provide a legible map and clear written description of the proposed deannexation area. Requires a municipal resolution setting the date for the referendum, notice of the referendum to be run by county boards of election containing a statement on the referendum, and a deannexation ballot. Limits voting to voters in the deannexed areas. Specifies that if less than a majority of the votes cast on the referendum are for deannexation, the deannexation ordinance is void and the municipal governing board may not proceed with a separate deannexation process with respect to that proposed deannexation area for at least 24 months from the date of the referendum. If a majority of the votes cast on the referendum are for deannexation, the deannexation is deemed valid.

Authorizes deannexation to be initiated by citizen petition in GS 160A-58.104 signed by the owners of all the real property located within the area proposed for deannexation. Provides for form for petition, signature verification by the city clerk, and a public hearing on the deannexation petition upon at least 10 days’ public notice. Authorizes the municipality to adopt a deannexation ordinance after the public hearing. If it chooses not to do so, then prevents the municipality from proceeding with a separate deannexation process with respect to that proposed deannexation area for at least 24 months from the date of the municipal governing board's findings. Specifies that, except as required by a contractual relationship between the property owner or tenant of real property in the deannexed area, the municipality could, but is not required to, continue to provide services to all or part of the dennexed area and would not be liable for ceasing services to the deannexed area.

Provides, in GS 160A-58.105, that if deannexation of an area from the corporate limits of a municipality would transfer service obligations to any (1) other unit of local government, (2) nonprofit volunteer fire department or rural fire protection district, or (3) any district, commission, or authority created under GS Chapter 153A, then the municipality or property owner initiating deannexation must obtain the consent of the governing board for the entity to which a service obligation would be transferred. Directs the party responsible for obtaining the consent to deliver evidence of the consent to the city clerk.

Specifies, in GS 160A-58.106 that deannexation of property under the Article becomes effective on the first June 30 at least 90 days following the adoption of the deannexation ordinance. Directs, in GS 160A-58.107, that real and personal property in a newly deannexed area as of January 1 of the year in which the deannexation becomes effective is not subject to municipal taxes for the taxes levied for the fiscal year beginning July 1 of that year. Specifies that any liens of the municipality for ad valorem taxes or special assessments outstanding before the deannexation's effective date may continue to be collected or foreclosed upon after the deannexation's effective date.

Authorizes a municipality to continue, transfer, or discontinue municipal services to a deannexed area in GS 160A-58.108, as specified. Authorizes the municipality to revise its service rates by provided by a public enterprise (defined). If the municipality has accepted ownership of or maintenance responsibility for roads that serve or connect to an area to be deannexed, exclusive of those with debt financing, then the municipality may determine to discontinue those services, as specified. If the municipality owns or is responsible for facilities that are subject to the  requirements of a Municipal Separate Storm Sewer System (MS4) permit, the city may recover the undepreciated costs for publicly-owned facilities located on or providing service to the area to be deannexed in the same manner provided in Article 10 of GS Chapter 160A, as described. Instructs that if the municipality decides to discontinue providing police, fire protection, emergency management, or other public safety services to an area to be deannexed, then a municipality is not liable for any act or omission related to a delay in responding to a call for public safety services, in referring the call to another local government or public safety agency or in refusing to respond to a call for public safety services.

Tasks the mayor of the municipality to cause an accurate map of the deannexed area, together with a copy of the deannexation ordinance duly certified, to be recorded with the five departments listed, including the Secretary of State, in GS 160A-58.109.  Provides for judicial review in GS 160A-58.110 for any holder of interest in real property located within the corporate limits of the municipality including the area to be deannexed who believes they will suffer material injury because (1) the municipality failed to comply with the procedures set forth in the Article, (2) the governing body acted arbitrarily, capriciously, or without statutory authority, or (3) the governing body violated the State or federal constitution may file a petition seeking review of the governing board's action.

Effective January 1, 2027.

H 920 (2025-2026) VIRTUAL CURRENCY KIOSK CONSUMER PROT. ACT. (NEW) Filed Apr 10 2025, AN ACT TO ENACT THE VIRTUAL CURRENCY KIOSK CONSUMER PROTECTION ACT.

Senate committee substitute to the 3rd edition makes the following changes.

Reduces the limit on aggregate fees and charges directly or indirectly charged to a customer for a single transaction or series of transactions under GS 53-457 (virtual currency customer fees) from 14% to 12% of the dollar equivalent of the virtual currency involved in the transaction or transactions.

Extends the date by which the Commissioner has to develop a process for determining when a virtual currency transaction is fraudulent, along with other rules necessary to implement the act, from December 1, 2026, to January 1, 2027. Extends the effective date of the act from December 1, 2026, to January 1, 2027.

H 925 (2025-2026) CONSUMERS IN CRISIS PROTECTION ACT. Filed Apr 10 2025, AN ACT TO ENACT THE CONSUMERS IN CRISIS PROTECTION ACT.

House amendment to the 4th edition makes the following changes. 

Removes provisions of new GS 66-536, requiring disclosure of consumer legal funding contracts in the specified circumstances. Replaces those provisions with directives that those contracts are presumed to be not discoverable in a civil action as well as inadmissible as evidence.

H 925 (2025-2026) CONSUMERS IN CRISIS PROTECTION ACT. Filed Apr 10 2025, AN ACT TO ENACT THE CONSUMERS IN CRISIS PROTECTION ACT.

House committee substitute to the 3rd edition makes the following changes. Makes conforming organizational changes to account for new Section 4.

Section 1.

Clarifies that the registration provisions of GS 66-529 apply to consumer legal funding companies. Clarifies in GS 66-528 that actions by attorneys or accountants prohibited in GS 66-534 are not exempt from the Consumers in Crisis Protection Act.

Section 4 (new).

Effective July 1, 2026, appropriates $10,000 in recurring funds from the General Fund to the Office of Secretary of State for 2026-27 to be used by the Office of Secretary of State to pay for the cost of registering consumer legal funding companies.

H 958 (2025-2026) ELECTION LAW CHANGES. Filed Apr 10 2025, AN ACT TO MAKE VARIOUS CHANGES REGARDING ELECTION LAWS.

House amendments to the 5th edition make the following changes. 

Amendment #1 removes Section 3.1 of the act, which amended GS 163-19 and GS 163-30 to prohibit members of the State Board of Elections and local boards of elections from making certain written or oral statements. 

Amendment #2 further amends GS 14-132 by adding that evidence of making or causing noise outside of a public building or facility used as a temporary voting place with the intent of disrupting or disturbing voting or election-related activities, excluding noise made for emergency purposes or in normal operations of the building or facility, can be used to prove a violation of the statute.

H 1083 (2025-2026) VOLUNTARY PORTABLE BENEFITS PLAN ACT. Filed Apr 28 2026, AN ACT TO ENACT THE VOLUNTARY PORTABLE BENEFITS PLAN ACT AND TO APPROPRIATE FUNDS FOR THAT PURPOSE.

House committee substitute to the 2nd edition makes the following changes.

Renumbers the new Article as Article 53 to GS Chapter 66 and makes conforming changes. Clarifies the definitions of bank, portable benefit account (PBA), portable benefit account provider, and portable benefit plan. No longer specifies types of insurance and benefits included as portable benefit plans. Defines six additional terms including portable benefit plan provider

Expands upon who may contribute to a portable benefit account. Clarifies required conditions of agreement between an independent contractor and a hiring party making voluntary PBA contributions. Prohibits a hiring party from making PBA contributions contingent on use of a certain portable benefit account provider and specifies that hiring party shall treat PBA contributions as compensation. 

Specifies that a PBA is the sole property of the independent contractor who owns it and its contents do not revert to a hiring party. Permits PBA owner to cease contributions, change purchased plans, or transfer account balance at any time without penalty. Sets out 13 permissible uses of PBA funds. Specifies that a hiring party’s PBA contributions are not evidence of an employer-employee relationship and do not affect entitlement to unemployment insurance benefits. 

Provides that an independent contractor who opts in to voluntary contributions from a hiring party shall select a portable benefit account provider to administer the funds. Prohibits a hiring party from serving as an account provider except as a pass-through contributor. Prohibits conditioning fund distribution on continued work for hiring party. Specifies requirements for segregation of funds, fee disclosure, financial responsibility, recordkeeping, standard of care, and approval from the Commissioner of the North Carolina Department of Labor. 

Makes clarifying changes to provision allowing deduction of PBA contributions from adjusted gross income calculation and exclusion from withholding requirement. Adds new subsection GS 105-251.2(c1) to require portable benefit account providers to give information to the Secretary of Revenue upon request subject to specified parameters.

Removes appropriation. Changes the act’s effective date to January 1, 2027.

H 1104 (2025-2026) IMPROVE IVC PROCESS AND ENHANCE PUBLIC SAFETY. (NEW) Filed Apr 29 2026, AN ACT TO IMPROVE THE INVOLUNTARY COMMITMENT PROCESS AND INCREASE PUBLIC SAFETY AND TO IMPLEMENT AN INPATIENT CAPACITY RESTORATION PROGRAM.

Senate amendment to the 4th edition makes the following changes.

Section 2, Section 6.5, and Section 9.

Makes technical changes to the name of the NC Sheriffs’ Association, Inc.

Section 11.

Clarifies that the initial treatment plan required by GS 122C-265 should be incorporated into any order for outpatient commitment issued under GS 122C-267.

Directs the Administrative Office of the Courts (AOC) to set parameters for information sharing with the Director in GS 122C-54(d).

Section 13.

Updates statutory cross references to GS 15A-1003(b) (was, subsection (a)) in GS 15A-1003, GS 15A-1004, and GS 15A-1007. Updates statutory cross references to GS 15A-1003(e)(1), (2), (3), and (5) (was, GS 15A-1003(d)(1), (2), (3), and (5)) in GS 15A-1008.

House committee substitute to the 1st edition deletes the content of the previous edition and replaces it with the following. Amends GS 105-275(45) (special classes of property excluded from tax) to make the exclusion apply to solar energy electric systems placed in service (fully installed and producing usable energy) before July 1, 2027 (previously no date was specified). Effective for taxes imposed for taxable years beginning on or after July 1, 2027. Makes conforming changes to the act's titles.

H 1242 (2025-2026) MODERNIZE LAW OF THE LAND CLAUSE. Filed Jun 30 2026, AN ACT TO AMEND ARTICLE I, SECTION 19, OF THE NORTH CAROLINA CONSTITUTION TO MODERNIZE THE LANGUAGE OF THE LAW OF THE LAND CLAUSE.

Subject to approval by voters at the general election in November 2026, amends Section 19 of Article I of the NC Constitution to remove use of the word “his.” If approved, effective upon certification by the State Board of Elections.

S 808 (2025-2026) BOARD OF COSMETIC ART EXAMINERS AMENDMENTS. Filed Apr 21 2026, AN ACT TO MODIFY THE REQUIREMENTS FOR NATURAL HAIR CARE SPECIALIST LICENSURE AND CREATE A CERTIFICATION FOR HAIR BRAIDERS; TO LICENSE HAIR DESIGNERS; TO ALLOW MOBILE COSMETIC ART SHOPS; AND TO MAKE OTHER CHANGES TO THE COSMETIC ART STATUTES.

House committee substitute to the 5th edition makes the following changes. Makes conforming changes to the act’s long title. Makes technical changes throughout the act.

Section 1.

Amends GS 88B-2 as follows. Reinstates the definition of apprentice. Modifies the definition of hair braiding by removing reference to the natural hair not being permanently altered. Modifies natural hair care so that it includes minor trimming of hair or hair extensions incidental to the braiding of hair. Removes changes to required education hours required for a cosmetology license (GS 88B-7). Reinstates the existing qualifications for licensing apprentices (GS 88B-8). Increases the number of educational hours required for: (1) a hair design license (GS 88B-8.1) from 900 to 1,000; (2) a licensed esthetician (GS 88B-9) from 300 to 475;(3) a licensed manicurist from (GS 88B-10) from 100 to 200; (4) a licensed natural hair care specialist (GS 88B-10.1) from 100 to 150 of the described natural hair care hours; and (5) a certified hair braider (GS 88B-10.1) from 76 to 126 hours of the described natural hair care courses. Amends GS 88B-12 by reinstating the requirement to issue a temporary employment permit to an applicant for licensure as an apprentice if they meet the specified criteria. Removes provisions authorizing natural hair care specialists to provide natural hair care at the described community festivals in GS 88B-15, only allowing hair braiding. Increases the hair braider application fee in GS 88B-20 from $5 to $10 and makes conforming changes by reinstating the relevant fees for apprentices. Makes conforming changes to GS 88B-21, GS 88B-22, and GS 88B-23, by reinstating provisions applicable to apprentices. Amends GS 88B-25 by exempting from GS Chapter 88B a person licensed as a massage and body work therapist while engaging in shampooing, conditioning, or washing of hair. 

Section 3.

Removes provisions providing for the automatic conversion of apprentice licenses to cosmetology licenses, as described. Also removes the provision requiring the North Carolina Board of Cosmetic Art Examiners to adopt rules to implement the act and to post on its website information about the elimination of the apprentice license and transition to cosmetologist licensure.

S 1001 (2025-2026) COASTAL REGULATORY REFORM. Filed Apr 30 2026, AN ACT TO MODIFY THE COASTAL AREA MANAGEMENT ACT APPLICATION PROCESSING RULE TO CLARIFY ADJACENT LANDOWNER NOTICE REQUIREMENTS, TO INCREASE THE MAXIMUM CAMA APPLICATION PROCESSING FEE, TO AMEND UPLAND BASIN DISSOLVED OXYGEN AND FINANCIAL ASSURANCE REQUIREMENTS, TO MAKE OTHER TECHNICAL CORRECTIONS TO THE UPLAND BASIN PERMITTING STATUTE, AND TO CLARIFY AGENCY AUTHORITY OVER THE COASTAL RESERVE.

Senate amendment to the 3rd edition makes conforming change to act's long title to reference CAMA application processing fees and remove references to the Coastal Storm Damage Mitigation Fund.

S 1041 (2025-2026) PUBLIC WORKFORCE MODERNIZATION ACT. Filed Apr 30 2026, AN ACT TO MODERNIZE AND SIMPLIFY THE STATE HUMAN RESOURCES SYSTEM.

House amendment to the 4th edition makes the following changes.

Section 1.

Updates statutory cross references from (i) GS 126A-84(b)(1) and (2) to GS 126A-84(c)(1) and (2); (ii) GS 126A-50(4) to GS 126A-50(a)(4); (iii) GS 126A-95 to GS 126A-94 in GS 126A-15.2 (exemptions from GS Chapter 126A).

Section 4.24.

Makes a technical change by removing the depiction of the administrative duties of the Superintendent of Public Instruction in GS 115C-21(a)(1).

Section 5.6A (new).

Amends GS 153A-103 (number of employees in the offices of sheriff and register of deeds) to direct the board of commissioners to not designate employees of the sheriff’s office as subject to the State Human Resources Act under GS Chapter 126A. Makes a technical change.

Section 5.8 (new).

Specifies that if House Bill 171, 2025 Regular Session (Equality in State Agencies/Prohibition on DEI) becomes law, then: (1) GS 126-14.7, as enacted by the act, is recodified as GS 126A-104.5 and (2) adds the following employees to GS 126A-15.2 as exempt from GS 126A-104.5, UNC Employees and Community College System Office employees.  

Specifies that if Senate Bill 257, 2025 Regular Session (2025 Appropriations Act) becomes law, then directs the Revisor of Statutes to replace: (1) “Chapter 126” with “Chapter 126A” and “Articles 6 and 7” with “Articles 15 and 16” in GS 115C-229.45(7) as enacted by that bill; (2) “Part 10 of Article 16” with “Article 15A” in GS 126A-15, as enacted by the act; (3) “GS 126-5(c1)(43)” with “GS 126A-15(8)gg” in GS 62-14, as amended by that bill.

Specifies that if Senate Bill 257, 2025 Regular Session (2025 Appropriations Act) becomes law, then employees of the Utilities Commission under the direction of the Commission as specified, are added to the list of statutorily exempt employees under GS 126A-15.

Effective January 1, 2027, if Senate Bill 257, 2025 Regular Session (2025 Appropriations Act) becomes law, then employees of the Building Codes and Interpretations Bureau as specified, are added to the list of statutorily exempt employees under GS 126A-15.

Specifies that if Senate Bill 257, 2025 Regular Session (2025 Appropriations Act) becomes law, then expands the circumstances when Cabinet agencies may employ temporary employees outside of the JoinNC Program under GS 126A-111 to include when the Department of Natural and Cultural Resources is employing temporary employees in any of the nine listed administrative divisions.

Specifies that if Senate Bill 257, 2025 Regular Session (2025 Appropriations Act) becomes law, then amends the GS 126A-41(b) as enacted the act so that each agency with an exempt policymaking or managerial position to set the salary for that position within the salary range established by the Commission plus 30% (was, 10%).

H 332 (2025-2026) NASH/ROCKY MOUNT OCCUPANCY TAX CHANGES. (NEW) Filed Mar 6 2025, AN ACT TO MODIFY NASH COUNTY'S OCCUPANCY TAX, TO CREATE ROCKY MOUNT DISTRICT R, AND TO AUTHORIZE THE DISTRICT TO LEVY AN OCCUPANCY TAX OF UP TO TWO PERCENT (2%).

Senate amendment to the 3rd edition removes the following provisions from the act:

  • The increases to Haywood County's occupancy tax.
  • The creation of the Beaufort County District B taxing district.
  • Changes to the Cherokee County's Tourism Development Authority.

H 1222 (2025-2026) RECORD DEVELOPMENT APPROVAL VOTES/BRUNSWICK. Filed May 5 2026, AN ACT TO REQUIRE CERTAIN DEVELOPMENT APPROVALS TO BE MADE BY THE BRUNSWICK COUNTY BOARD OF COMMISSIONERS.

Senate amendment to the 1st edition makes the following changes. Makes conforming changes to the act’s long title.

Section 2.

Removes definition of development approval. Tasks the Brunswick County Board of Commissioners (Board) with making the final decision on all preliminary subdivision plats that would result in the division of the original lot into twenty-five or more lots.

Section 3.

Tasks the Board with making the final decision on all special use permits.

Section 4.

Directs Brunswick County to require a traffic impact analysis, to be submitted in conjunction with an application for the four types of listed projects, including a special use permit, and a preliminary subdivision plat that would result in the division of the original lot into twenty-five or more lots. Provides for presentation of the traffic impact analysis to the Board in open session before voting on the project.

Section 5.

Requires the Board to make final decisions on the listed zoning matters, including zoning ordinance and map amendments, preliminary subdivision plats, variances, and special use permits, by a recorded vote taken in open session. Specifies that the official record of the meeting must reflect how each member voted on each matter before the Board.

Section 6.

Applies only to the use and development of land and structures located in Brunswick County outside of the land use and zoning jurisdiction of municipalities located in Brunswick County.

Section 7.

Clarifies that the act applies to applications on or after the act becomes law.

LOCAL/SENATE BILLS
S 876 (2025-2026) VARIOUS LOCAL PROVISIONS X. (NEW) Filed Apr 28 2026, AN ACT TO MAKE VARIOUS CHANGES TO LOCAL LAWS IN NORTH CAROLINA.

Conference Report to the 5th edition makes the following changes.

New Part III provides that the City of Kannapolis shall hold municipal elections in even-numbered years with the mayor and city council elected on a partisan basis. Requires candidates seeking nomination by petition to comply with the requirements of Article 11 of GS Chapter 163, except that the date and time of filing must be in accordance with GS 163-122(a)(3). Provides that no municipal elections will be conducted in Kannapolis in 2027. Extends the terms of three council members whose terms expire in 2027 by one year, and extends the terms of the mayor and three council members whose terms expire in 2029 by one year. Resumes regular elections in 2028 with the same staggering of terms as when elections were held in odd-numbered years.

New Part VIII allows Moore County to expend general funds up to $500,000 (other than ad valorem property tax revenues) to comply with minimum construction standards in areas damaged by Tropical Storm Chantal that are critical to the county’s public safety and emergency services. Effective upon becoming law and expires June 30, 2028.

New Part XII requires Clayton, upon adoption of an ordinance or entering into an annexation agreement, to make major municipal services available to the annexed area on substantially the same basis and manner as these services are provided to the rest of the Town. 

New Part XIII abolishes the Southport Historic Preservation Commission. Prohibits the City of Southport from designating a new historic preservation commission. Prohibits the City from creating or expanding historic districts. Provides that any historic district in Southpoint in effect on this section’s effective date shall remain in effect but cannot be expanded.

New Part XIV allows the Town of Leland to voluntarily annex territory up to three miles from town limits if: (1) the property is owned by the Town or (2) the Town has received a petition for annexation by July 1, 2026, and the territory does not extend beyond specified boundaries.

New Part XV extends the corporate limits of the town of Franklinton to include the specified tract. Effective July 1, 2027.

Makes conforming changes to other section numbering.
