H 547 (2025-2026) CHILDREN'S SERVICES PROTECTION ACT. Filed Mar 26 2025, AN ACT TO LIMIT LIABILITY FOR NONGOVERNMENTAL CONTRACTORS WORKING WITH AND FOR CERTAIN PUBLIC AGENCIES.

House amendment to the 2nd edition makes the following changes to new GS 143B-3001.B (limited liability for licensed nongovernmental contractors with agencies). Instructs that the statutory damage caps that apply to public service agencies do not apply to claims against a nongovernmental caretaker contracting with a public agency for the provision of services to minors who takes any action that would qualify as abuse under GS 7B-101(1) (definitions pertaining to abuse and neglect of a juvenile). Makes conforming changes.

H 569 (2025-2026) PFAS POLLUTION AND POLLUTER LIABILITY. Filed Mar 27 2025, AN ACT TO PROTECT THE CITIZENS OF NORTH CAROLINA FROM DRINKING WATER CONTAMINATED BY GENX AND OTHER PFAS COMPOUNDS.

House amendment to the 3rd edition makes the following changes.

Amends the definition of responsible party in new GS 130A-19.1 (abatement of PFAS exceedances), so that it means a per- and polyfluoroalkyl substances (PFAS) manufacturer: (1) whose direct discharge of PFAS into surface waters of the State has caused or contributed to the presence of PFAS in a public water system; and (2) who has entered a consent order that establishes required compliance measures to address discharges of PFAS to surface water (was, A PFAS manufacturer whose discharge or release of PFAS into the environment has caused or contributed to the presence of PFAS in a public water system). Requires a public water system to have incurred costs in excess of $50 million to remove, correct, or abate adverse effects upon the water supply resulting from contamination by the responsible party in order for the Secretary to order that responsible party to pay the public water system the actual and necessary costs of repair, as described. Specifies now that a public water system must now reimburse ratepayers of the system through refunds or credits to customers, or a reduction in future rates charged, in a manner that will not impair any existing financial obligations that may be associated with the public water system if the described conditions are met (was, reimbursement through a reduction in future rates charged). Makes technical and clarifying changes.

H 616 (2025-2026) MEGASITES/SELECTSITES PROGRAM REVISIONS (NEW). Filed Mar 31 2025, AN ACT TO MODIFY THE MEGASITES AND SELECTSITES READINESS PROGRAMS.

House amendment to the 2nd edition limits the Economic Development Partnership of North Carolina (EDPNC)'s allocations of money in the NC Selectsite Fund (Fund) pursuant to Section 11.12 of SL 2023-134 so that no more than $150,000 of the money available in the Fund can be used biennially for engaging a national selection site firm through the described competitive bidding process. Requires geographic diversity to be a priority consideration in identifying new sites, beginning with the report due in 2026.

House amendment to the 2nd edition makes the following changes. 

Part VI.

Modifies the definition of defensive device to refer to "less than lethal" devices instead of "non-lethal" devices. 

Part VII.

Removes the changes to GS 143-143.4, which broadens the door lock exemptions under the NC State Building Code so that it included any business entity licensed to sell automatic weapons as a federal firearms dealer that is in the business of selling firearms or ammunition.

H 681 (2025-2026) UPDATE OPIOID ABATEMENT TREATMENT PROG. RULES. Filed Apr 1 2025, AN ACT DIRECTING THE COMMISSION FOR MENTAL HEALTH, DEVELOPMENTAL DISABILITIES, AND SUBSTANCE USE SERVICES TO AMEND THE RULES REGARDING OUTPATIENT OPIOID TREATMENT PROGRAMS FOR GREATER CONSISTENCY WITH FEDERAL REGULATIONS.

House amendment to the 2nd edition makes the following changes. 

Eliminates the directive in Section 1.(a) for the Commission for Mental Health, Developmental Disabilities, and Substance Use Services (Commission) to explicitly prohibit administrative discharge from treatment due to continued substance use, missed doses, and nonparticipation in ancillary services such as counseling as part of its amendments to the rules applicable to outpatient treatment programs. Instead, requires the Commission to amend those rules to require the State Opioid Treatment Authority (SOTA) to review patient discharge policies related to continued substance use, missed doses, and nonparticipation in ancillary services such as counseling.

H 886 (2025-2026) AEDS AND CPR IN PUBLIC SCHOOLS. Filed Apr 9 2025, AN ACT TO REQUIRE THE PLACEMENT OF AUTOMATIC EXTERNAL DEFIBRILLATORS (AEDS) IN ALL SCHOOLS IN PUBLIC SCHOOL UNITS AND TO PROVIDE TRAINING FOR SCHOOL PERSONNEL ON THE USE OF AEDS AND CPR.

House amendments make the following changes to the 1st edition.

Amendment #1

Removes provisions appropriating $4.1 million from the General Fund to the Department of Public Instruction for 2025-26 to be allocated by the Superintendent of Public Instruction on a first-come, first-served basis to governing bodies of public school units in an amount sufficient to purchase and install one automatic external defibrillators (AED) per school and train personnel on the proper use of the AED as required by this act. Authorizes the State Board of Education (Board) to adopt emergency rules to implement the act for the 2025-26 school year. Changes the effective date to when the act becomes law (was, July 1, 2025). 

Amendment #2

Inserts whereas clauses that describe how Representative Becky Carney's life was saved by the presence of an AED when she went into cardiac arrest in the building of the General Assembly on April 2, 2009. Titles the act, "The Rep. Becky Carney Cardiac Arrest Act."  Makes organizational changes.

House amendment to the 1st edition clarifies that the act's exemption requirements from the State Building Code's door lock requirements of the means of egress for the described federally licensed firearms dealers does not apply to those dealers that are primarily engaged in the business of selling firearms or ammunition and have received prior authorization from the local fire code official to use an alternative means or method of achieving compliance with the Building Code's  door lock requirements. H 936 (2025-2026) ROBOCALL SOLICITATION MODIFICATIONS. Filed Apr 10 2025, AN ACT TO MODIFY THE LAWS GOVERNING TELEPHONE SOLICITATIONS TO ADDRESS ROBOCALLS.

House amendment to the 2nd edition modifies the definition of prior express written consent in GS 75-101 so that it is a written agreement that: (1) bears the signature (defined) of the person called that clearly authorizes the seller to deliver or cause to be delivered to the person called telephone solicitations; (2) includes the telephone number to which solicitations are authorized to be delivered; and (3) contains a clear and conspicuous disclosure informing the signatory that the person, in signing the agreement, authorizes the seller to deliver, or cause to be delivered, to the signatory telephone solicitations and that the person is not required to sign the agreement or enter into the agreement as a condition of purchasing any property, goods, or services. (Previously, term meant a written agreement bearing the signature of the telephone subscriber that clearly authorizes the telephone solicitor to deliver or cause to be delivered to the telephone subscriber telephone solicitations, and the telephone number to which the signatory authorizes such telephone solicitations to be delivered. Prior express written consent for a call or text (i) shall be to a single person; (ii) may be obtained only after clear and conspicuous disclosure that the telephone subscriber will receive future calls on behalf of a specific seller; (iii) is effective if the form of signature is recognized as a valid signature under applicable federal or State law; and (iv) is nontransferable.)

S 266 (2025-2026) HISTORIC FLOOD EVENT BLDG. CODE EXEMPTION. Filed Mar 11 2025, AN ACT TO ESTABLISH EXEMPTIONS FROM CERTAIN FLOODPLAIN REQUIREMENTS FOR THE REPLACEMENT OR RECONSTRUCTION OF STRUCTURES DAMAGED BY HISTORIC FLOOD EVENTS; AND EXEMPTIONS FROM SOLID WASTE COMPOSTING RULES, STATE-ONLY STORMWATER AND SEDIMENTATION CONTROL REQUIREMENTS, STATE-ONLY AIR QUALITY PERMITS, SOIL AMENDMENT OR COMPOST PRODUCT REGISTRATION, AND FIRE CODE LIMITATIONS ON MULCH PILE STORAGE, FOR THE PROCESSING OF TREE STUMPS AND OTHER VEGETATIVE DEBRIS INTO MULCH OR SOIL AMENDMENTS IN THE COUNTIES AFFECTED BY HELENE FOR A PERIOD OF TWENTY-FOUR MONTHS.

Senate amendments make the following changes to the 2nd edition.

Amendment #1

Section 2.

Modifies the five listed requirements that the Department of Environmental Quality (DEQ), Department of Agriculture and Consumer Services (DACS), and a unit of local government (as applicable), are required to waive so long as it does not conflict with the described obligations under federal law as follows.  Requires that the persons or entities undertaking an activity that would normally require the specified solid waste composing permit provide the described notice to DEQ by at least ten days prior to beginning operations. Removes the waiver for stormwater and sedimentation and erosion control requirements. Instead, waives approval of erosion and sediment control plans under the described regulation where the activities do not involve removal of trees or other existing ground cover. Makes technical, clarifying, and conforming changes.

Requires persons or entities undertaking activities that would otherwise be subject to the five listed requirements that are waived by the act to provide the described notice to DEQ and DACS, except for those undertaking an activity that would normally require the specified solid waste composing permit (who are already subject to separate notice requirements under the act, described above). Limits individual sites to a maximum allowance of 25,000 cubic yards, as described. Clarifies that a waiver under the act does not exempt the activities from complying with other applicable regulations. Provides for limits on depth for mulch used for temporary erosion control. Provides for determination of normally accepted agronomic rates for materials to be used as a soil amendment, as specified. Effective when the section becomes law and expires July 1, 2027. Requires that any material managed under these provisions must be removed from the site for its intended purpose by no later than July 1, 2027.

Amendment #2

Section 2.1.

Requires all units of local government in counties designated before, on, or after the act’s effective date under a major disaster declaration by the President as a result of Hurricane Helene managing vegetative debris removal within their jurisdictions to transport the material to a composting site for reuse as mulch or soil amendment when the transportation and disposal costs for processing tree stumps and other vegetative debris at the composting site are equal to or less than the costs associated with the transportation and disposal at a landfill. Directs DEQ and DACS to comply with the requirements above to the extent they assist local governments with such debris. Effective when the section becomes law and expires on July 1, 2027.

S 336 (2025-2026) INTERSTATE MED.L LIC. COMP./INTERN'L PHYS. Filed Mar 19 2025, AN ACT TO ESTABLISH AN INTERSTATE COMPACT FOR THE LICENSURE OF THE PRACTICE OF MEDICINE AND TO CREATE A PROCESS FOR INTERNATIONAL PHYSICIAN EMPLOYEE LICENSE.

Senate committee substitute to the 2nd edition makes the following changes.

Section 3.

Adds submission of the application fee as one of the requirements an applicant must meet for the NC Medical Board (Board) to issue an internationally-trained physician license (License) under GS 90-12.03. Removes provisions automatically converting a License in good standing into a full license to practice medicine in the State after four years of practice in the State. Instead, authorizes a physician with a License in good standing meeting the four-year practice to apply for a full medical license. Directs the Board to grant the application if the applicant has no disciplinary actions by any state, federal or foreign regulatory agency, no pending investigations by any state, federal or foreign regulatory agency, no misdemeanor convictions in the two years preceding their application for a full license, no felony convictions, no pending misdemeanor or felony charges, and no adverse actions affecting their privileges or ability to practice. Clarifies that “misdemeanor” does not include traffic violations. Removes directive that the Board collect the number and types of inquiries from potential applicants as part of its evaluation of the implementation and potential success of a License under GS 90-12.03. Makes organizational changes.

Changes the act’s effective date from October 1, 2025, to January 1, 2026.

Changes the act's effective date to December 1, 2025, (was, October 1, 2025) and specifies that it applies to offenses committed on or after that date.

S 442 (2025-2026) PARENTS PROTECTION ACT. Filed Mar 24 2025, AN ACT TO MAKE VARIOUS CHANGES TO LAWS AFFECTING THE CARE OF JUVENILES AND THE ADOPTION OF CHILDREN.

Senate amendments to the 1st edition make the following changes. 

Amendment #1

Section 1.

Deletes proposed provisions of GS 131D-10.1, the Foster Care Children’s Bill of Rights, that would have (1) specified in (1) that raising a child in a manner consistent with the child's biological sex, including any related mental health or medical decisions, is not a violation under this subdivision of violence, abuse, neglect, or danger, as those terms are being used and (2) prohibited in (a1) delaying or denying the opportunity to become a foster parent or the placement of a child in foster care because of the adoptive parents’ refusal, unwillingness, or lack of support to enable the child to engage in a gender transition.

Amendment #3

Section 1.

Changes Section 1's effective date from December 1, 2025, to when the act becomes law.

Section 2. 

Changes the effective date of the act's amendments to GS 14-318.2 (misdemeanor child abuse) and GS 14-318.4 (felony child abuse) from December 1, 2025, to July 1, 2025. 

Section 3.

Removes December 1, 2025, general effective date of the act and instead specifies that the act is effective when it becomes law, except as otherwise provided. 

Amendment #5 

Increase the age of the child under GS 14-318.2(c1) (misdemeanor child abuse) and GS 14-318.4(d) (felony child abuse) from a child under 16 to a child under 18.

S 479 (2025-2026) SCRIPT ACT. Filed Mar 25 2025, AN ACT SUPPORTING COMMUNITY RETAIL PHARMACIES AND IMPROVING TRANSPARENCY.

Senate amendment to the 4th edition makes the following changes.

Part III.

Enacts GS 58-56A-23, requiring the Department of Insurance (DOI) to identify any pharmacy deserts and then publish a list of those pharmacy deserts on its website and report its findings to the specified NCGA committee. Requires the initial publication and report to be made by January 1, 2026, with updates every four years and by no later than 12 months after the release of decennial federal census data.  Makes conforming changes.

Removes defined term retail community pharmacy from GS 56-56A-1 (Pharmacy Benefits Management). Removes reference to “retail community pharmacy” in GS 58-56A-4 (preventing a pharmacy benefit manager contract from requiring the described pharmacies in a pharmacy desert from accepting reimbursements for less than the acquisition cost of the covered described benefit) and replaces it with “any pharmacy.”

Requires DOI to adopt rules to implement the provisions of Part III of the act by October 1, 2025, including rules establishing the pharmacy desert designation.

Part V.

Incorporates pharmacy desert (as defined in GS 58-51-37) into GS 90-85.3 (definitions pertaining to the NC Pharmacy Practice Act). Expands the scope of new GS 90-85.21E (pertaining to allowed denials of prescription fills or refills by independent pharmacies) to extend to the statute's provisions pharmacists in a pharmacy desert. Removes provisions allowing an independent pharmacy to decline to fill or refill a prescription if the pharmacist will be paid less or is paid less than the acquisition cost of the drug, device, or service covered (but retains provision allowing an independent pharmacy to decline to fill or refill the prescription if the independent pharmacy will be paid or is paid less). Makes conforming changes, including to the statute's title.

Part VIII.

Extends the Part’s effective date from October 1, 2025, to January 1, 2027.

S 513 (2025-2026) MODIFY RQMTS. FOR WIND ENERGY FACILITIES. Filed Mar 25 2025, AN ACT TO ESTABLISH ENHANCED PUBLIC NOTICE REQUIREMENTS FOR PROPOSED WIND ENERGY FACILITIES AND TO REQUIRE WIND ENERGY FACILITIES TO INSTALL LIGHT-MITIGATING TECHNOLOGY SYSTEMS.

Senate committee substitute to the 1st edition makes the following changes.

Modifies the notice requirement under GS 143-215.119 so that an applicant for a proposed wind energy facility/wind energy facility expansion now has to notify all described property owners within one mile of any property boundary of the facility (was, 20 miles). Requires the applicant to provide notice, as described, to each county board of commissioners and the governing body of each municipality within 20 miles of the proposed facility. Changes the Department of Environmental Quality’s (DEQ) requirement to publish notice of hearing on the facility for counties outside the proposed facility to require publication in a newspaper of general circulation in any counties within 20 miles of any property boundary of the facility (was, counties bordering the county where the facility will be located). Requires DEQ to also provide written notice of the hearing, as specified, to the governing bodies of each municipality located within 20 miles of the proposed facility. Instructs, in GS 143-215.121.1, that the addition of a light-mitigating technology system to an existing wind energy permit does not require any amendments, revisions, or modifications of any existing wind energy facility permit or any additional permit from DEQ. Requires the permit holder to notify DEQ and to pay a registration fee of $25.

Senate amendment to the 2nd edition makes the following changes.

Adds to the proposed changes to Section 15, SL 2020-18, as amended, to allow the Environmental Management Commission (Commission) to use the Department of Environmental Quality's (Department) watershed modeling for the Neuse River Basin to adopt new transport zones and delivery factors by rule once the Department has completed the watershed modeling. Eliminates the requirement for the Department to provide the Commission a list of qualified professionals from which the Commission can select at least two to validate the completed watershed modeling before the Department can use the modeling to adopt the new transport zones and delivery factors.

Section 21.1

Effective January 1, 2026, and applying to referenda conducted on or after that date, increases the maximum amount that may be assessed on propane sold in the State under GS 119-63.4 from $.002 to $.003. Further increases the number of votes needed for the referendum to become effective to 75% of dealers and distributors voting in favor of the increase (was, 50%). 

Broadens the permitted uses of the assessments by the North Carolina Propane Education & Research Foundation to include workforce development.

Removes all peninsulas extending into the waters of Lake Norman from the definition of shoreline area in GS 77-89.1 (definitions pertaining to the Lake Norman Marine Commission [Commission]).  Now prevents more than 35% of the commissioners from (1) having an ownership interest in any property adjoining the shoreline area of Lake Norman; (2) having an ownership interest in or be employed by any business that generates income from Lake Norman or that has an ownership interest in property that adjoins the lake’s shoreline area under GS 77-89.3. Requires each commissioner to complete a written disclosure statement identifying any of the described conflicts of interest by January 31 each year. Provides for publication of those statements on the Commission’s public website by January 31 annually. Makes organizational changes. Amends GS 77-89.5(b) (organization and meetings) by making all Commission records public, no longer limiting it to those relating to the development, collection, and use of fees. Specifies that the Commission’s regulations under GS 77-89.8 cannot conflict with the exercise of any authority granted under any permit or license issued by any State or federal agency, in addition to State or federal law. Designates authority under GS 77-89.10 (enforcement) to assist a magistrate with primary responsibility for enforcement of the Commission’s regulations as described to each chief district magistrate of a district court district that includes one or more of the four counties (was, the four counties were authorized to assign the described magistrate). Makes a clarifying change to GS 77-89.9 (fees). Specifies that if there is a surplus of fee collections or funding for a given calendar, it should be applied to program-specific expenses for the next calendar year.

Also amends the definition of renewable energy facility so that it means a facility that meets the specified requirements, no longer excluding a hydroelectric power facility with a generation capacity of more than 10 megawatts.
