Senate amendments to the 4th edition make the following changes.
Part II Current Operations and Expansion/General Fund
Section 2.2(j) General Fund Availability.
Amendment #6 makes the following changes. Specifies that if any of the $4 million per year of the 2023-25 fiscal biennium transferred by the State Controller to the Department of Commerce from the World University Games Reserve has not been expended or encumbered by June 30, 2029, those funds will revert back to the General Fund.
Amendment #11 makes the following changes. Requires the Department of Commerce to submit annual reports by October 1 following the conclusion of each fiscal year in which funds appropriated from the World University Games Reserve are expended or encumbered on activities supported by the funds.
Part IX-B Central Management and Support
Section 9B.4(d) Expansion of the NC Loan Repayment Program/Incentives for Health Providers in Rural and Underserved Areas
Amendment #1 makes the following changes. Amends the Office of Rural Health’s (ORH) required 2025 and 2026 report to the specified NCGA committee and the Fiscal Research Division by requiring that the ORH also report the total number of additional licensed providers enrolled in the NC Loan Repayment Program that received incentives to support the recruitment and retention of additional licensed providers pursuant to the act. Makes conforming changes.
Part IX-F Health Service Regulation
Section 9F.8 Certificate of Need Reforms for Ambulatory Surgical Facilities
Amendment #27 makes the following changes. Amends GS 131E-176 by amending the definition of qualified ambulatory surgical facility to require that it be located in a county with a population greater than 125,000, or a population of 125,000 or less (was, less than 125,000) and does not have a hospital operating in the county. Amends the definition of qualified ambulatory surgical facility under GS 131E-146 to require that it be located in a county with a population greater than 125,000, or a population of 125,000 or less and does not have a hospital operating in the county (was, population less than 125,000 and does not have a hospital operating in the county).
Part XI Commerce
Section 11.9 NCInnovation
Amendment #18 makes the following change. Amends new GS Article 76B NCInnovation (GS 143-728) so that no more than 1% can be used annually for overhead and administrative costs (was, just 1% with no mention of annual use).
Amendment #24 further amends GS 143-728 to require that NCInnovaton require recipients of State funds to be organized under the laws of the State (was, incorporated in this State).
Part XIII Labor
Section 13.1 Pro Be Proud Reporting,
Amendment #4 makes the following change. Changes the due date of the North Carolina Home Builders Educational and Charitable Foundation’s annual report to the specified NCGA committee and the Fiscal Research Division from April 1 of each year to February 1 of each year.
Part XVI Administrative Office of the Courts
Section 16.21 Appeals of Right to the NC Supreme Court.
Amendment #15 makes technical changes to NC Rule of Civil Procedure 42 by changing reference to "three judge panel" to "three-judge panel."
Section 16.26 Numerically Realign Superior, District Court, and Public Defender Districts with Prosecutorial Districts.
Amendment #9 makes the following changes. Amends GS 7A-133 (number of judges by district) to have it conform to existing law (changes the number of judges elected in District 15 from six to seven.) Amends GS 7A-133(b8) by changing the number of District 19D to 29.
Part XXIX-A Office of State Human Resources
OSHR/Human Capital Resource Management
Amendment #30 amends the date by which OSHR must start making quarterly reports on its progress in implementing the system to replace the currently used human capital resources management components, from October 1, 2023, to January 1, 2024.
Part XLI Transportation
Section 41.14A Study of DMV Mail Flow and Routing.
Amendment #13 makes the following change. Changes the due date by which the Division of Motor Vehicles’ study on the flow and routing of mail related to the Division of Motor Vehicle's provision of services and other business must be submitted to the specified NCGA committee from November 1, 2023, to October 1, 2023.

House amendment to the 3rd edition makes the following changes. Now appropriates $250,000 from the General Fund to the Opportunity Scholarship Grant Fund in nonrecurring funds for the 2023-24 fiscal year to be used by the State Educational Assistance Authority for the purposes of verification of domicile set forth in the act.
