S 574 (2013-2014) GROUNDWATER CONTAMINATION/MODIFY RESPONSE (NEW). Filed Apr 1 2013, AN ACT CLARIFYING THAT CERTAIN CIVIL ACTIONS RELATING TO GROUNDWATER CONTAMINATION ARE NOT SUBJECT TO THE TEN-YEAR STATUTE OF REPOSE SET FORTH IN G.S. 1-52.

House amendments make the following changes to the 3rd edition.

Amendment #1

Changes the long title.

Amends proposed GS 130A-26.3, Limitations period for certain groundwater contamination actions, deleting language that required the claimant's last exposure to contaminated groundwater to have occurred before June 19, 2013, in order for the 10-year period to not serve as a bar to its claim of action.

Makes a clarifying change to the effective date clause, providing that once enacted the law also applies to actions filed on or after that date.

Deletes expiration clause, which previously provided that the act expired on June 19, 2023.

Amendment #2

Amends the enactment clause of the act to provide that the act applies to actions arising or pending on or after the date the act becomes law. Also provides that an action is to be considered pending if there has been no final disposition with prejudice and mandate issued against that plaintiff by the highest court of competent jurisdiction where the claim was timely filed or appealed. Adds back in the expiration date, providing that the act expires on June 19, 2023, but is not effective for claims for relief brought on or after that date and does not affect actions pending on that date.

S 744 (2013-2014) APPROPRIATIONS ACT OF 2014. Filed May 14 2014, A BILL TO BE ENTITLED AN ACT TO MAKE BASE BUDGET APPROPRIATIONS FOR CURRENT OPERATIONS OF STATE DEPARTMENTS, INSTITUTIONS, AND AGENCIES, AND FOR OTHER PURPOSES.

House amendments make the following changes to the 5th edition.

Part XI. Universities

Amendment #38 adds a new Section 11.24, ECSU Study, to this Part. Acknowledges the origins of Elizabeth City State University (ECSU) and states that the General Assembly finds that ECSU is a key educational and economic resource for northeastern North Carolina.

Directs the Joint Legislative Education Oversight Committee (ED Oversight) to evaluate and study strategies to address any financial or enrollment concerns for ECSU. Requires ED Oversight to examine, at minimum, any plans of the University of North Carolina Board of Governors or of ECSU to restore ECSU to more financially sustainable conditions. Directs ED Oversight to examine the strategies in ECSU's March 2014 publication,"Rightsizing ECSU: The Need for Financial Stability." Urges ED Oversight's work in conducting this study to include consulting with the Board of Trustees of Elizabeth City State University and any other appropriate parties.

Directs ED Oversight to report the results of its evaluation and study to the General Assembly before the convening of the 2015 General Assembly. Requires that the report include any recommendations for actions by the General Assembly to address financial and enrollment concerns.
