H 116 (2011-2012) COASTAL WETLAND RIPARIAN BUFFER GRANDFATHER (NEW). Filed Feb 16 2011, REGARDING THE DELINEATION OF PROTECTIVE RIPARIAN BUFFERS FOR COASTAL WETLANDS IN THE NEUSE RIVER AND TAR PAMLICO RIVER BASINS.

House committee substitute makes the following changes to 1st edition. Deletes provisions of the 1st edition and replaces it with AN ACT TO LIMIT THE IMPACT OF COASTAL WETLAND RIPARIAN BUFFER REQUIREMENTS ON THE CONSTRUCTION OF SINGLE-FAMILY RESIDENCES ON CERTAIN LOTS PLATTED AND RECORDED PRIOR TO AUGUST 1, 2000. Until the effective date of the revised permanent rules that the Environmental Management Commission (EMC) must adopt under this act, requires the EMC and the Department of Environment and Natural Resources (DENR) to implement the Neuse River Basin Riparian Buffer Rule and the Tar-Pamlico River Basin Riparian Buffer Rule as follows. The rules apply to development of an existing lot that is adjacent to surface waters in the coastal area, as provided. Allows a single family residence to encroach on the buffer where applying the buffer requirements would preclude construction of the residence and necessary infrastructure, if the following conditions are met: (1) residence is set back the maximum feasible distance from the normal high-water or water level on the existing lot and designed to minimize buffer encroachment; (2) the residence is set back at least 30 feet landward of the normal high-water or normal water level; (3) stormwater generated by new impervious surfaces within the buffer is treated and diffuse flow of stormwater is maintained throughout the buffer; and (4) no part of the septic tank or drainfield encroaches into the buffer. Requires the EMC to adopt a rule to replace the Neuse River Basin Riparian Buffer Rule and the Tar-Pamlico River Basin Riparian Buffer Rule that is substantively similar to the provisions above.

Amends GS 93A-2(c)(3), clarifying that the provisions of the real estate license law do not apply to legal acts or services performed by an attorney who is a member of the NC State Bar (deletes conditional language). Makes a technical change. Makes the amendment to GS 93A-54(a)(9) effective January 1, 2012 (rather than when the act becomes law). Directs the Real Estate Commission to adopt specified rules as necessary, effective when the act becomes law (rather than on January 1, 2012).

Deletes amendments to GS 48-2-607(c), which required that an action brought to set aside certain adoptions be brought within one year. Makes an organizational change to GS 48-3-608(b), which concerns revocation of consent in direct placement circumstances. Repeals GS 48-2-302(a) (previous edition amended the statute), which specifies the filing deadline for certain adoption petitions. Amends GS 48-2-401(a), clarifying that the petitioner must initiate service of notice (rather than serve notice) of a filed petition for adoption on specified persons no later than 30 days after the petition is filed (previous edition deleted the 30 day time period).

H 645 (2011-2012) MOTOR FUEL EXCISE TAX ADJUSTMENT & STUDIES (NEW). Filed Apr 5 2011, PROVIDING THAT THE 2011 GENERAL ASSEMBLY SHALL MEET FOR A DAY AT THE STATE CAPITOL.

House committee substitute deletes all provisions of 1st edition and replaces with AN ACT TO AUTHORIZE ADULT DAY CARE/OVERNIGHT RESPITE PROGRAMS IN CLEVELAND COUNTY.
Amends GS 131D-6(b) to provide that “adult day/overnight respite program” means a program inspected and certified by the Department of Health and Human Services as eligible to provide 24-hour group care and supervision to physically or mentally disabled adults. Specifies required criteria for the 24-hour care, and clarifies that the state is not obligated to pay for any services not already authorized. Makes conforming changes. Applies to Cleveland County only. Effective January 1, 2012.
Directs the Social Services Commission to adopt rules to establish adult day care/overnight respite programs.

Filed Apr 6 2011, TO REORGANIZE THE GENERAL STATUTES RELATING TO SCHOOL DISCIPLINE; PREVENT LITIGATION BY ADDING DEFINITIONS TO AND CLARIFYING AMBIGUITIES IN THE CURRENT LAW; CODIFY EXISTING CASE LAW; AND INCREASE LOCAL CONTROL AND FLEXIBILITY REGARDING DISCIPLINE.

House committee substitute makes the following changes to 1st edition. Provides that alternative education services include programs established by the local board of education (Board) in conformity with its policies (was, regulations). Provides that if the offense triggering the long-term suspension takes place before the final quarter of the school year, the suspension shall be (was, may be) no longer than the remainder of the school year in which the offense was committed. Replaces the term powerful explosive with destructive device. Defines destructive device as meaning an explosive, incendiary, or poison gas bomb, grenade, rocket having a propellant charge of more than four ounces, missile with an explosive or incendiary charge of more than one-quarter ounce, mine, or a device similar to any of the listed devices (was, defined powerful explosive as any bomb, grenade, mine, dynamite cartridge, or other similar device with significant explosive or incendiary capacity). Clarifies that Board policies shall not (was, may not) impose mandatory long-term suspensions or expulsions for specific violations unless otherwise provided in state or federal law. Deletes provision requiring that notice be provided to a parent and an opportunity to participate in the informal hearing regarding a short-term suspension if the student is unable to understand the hearing. Provides that a student is not entitled to appeal the principal’s decision to impose a short-term suspension to the superintendent or Board and the principal’s decision is not subject to judicial review. Amends GS 115C-12(27) to revert to March 15 as the annual reporting date for the State Board of Education to submit specified data to the Joint Legislative Education Oversight Committee (the first edition dropped the specific date and only required that the State Board report annually). Deletes requirement that the State Board also submit its report to the Commission on Improving the Academic Achievement or Minority and At-Risk Students. Makes additional technical corrections, and organizational changes.

House committee substitute makes the following changes to the 1st edition.
Deletes proposed new Article 9C (high school to work partnerships) of GS Chapter 115C and instead adds new subdivision (34a) to 115C-47 (powers and duties generally of local boards of education) to direct local boards of education (Boards) to encourage high school to work partnerships between high schools and local businesses. Retains the provisions regarding the high school to work partnership from proposed Article 9C, except makes the following changes: (1) deletes language requiring Boards to adopt and implement a policy to encourage the partnerships; (2) provides that waiver forms may be developed in collaboration with participating businesses for the protection of students and the businesses; (3) directs Boards to encourage high schools to designate the Career Development Coordinator or other designee of the local Career and Technical Education administrator to be the point person for local businesses to contact (was, high schools to designate a staff member to be the point person); (4) prohibits counting students as absent when they are participating in work-based learning opportunities or in Career and Technical Education student organization activities; and (5) authorizes Boards to determine the maximum number of days that may be used for job-shadowing activities.

H 779 (2011-2012) ELECTRONIC RECORDING/CUSTODIAL INTERROGATIONS. Filed Apr 6 2011, TO AMEND THE LAW REGARDING ELECTRONIC RECORDING OF CUSTODIAL INTERROGATIONS.

House committee substitute makes the following changes to the 1st edition. Amends the definition for electronic recording to clarify that the term refers to an audio recording or a visual recording that is an authentic, accurate, unaltered record. Reinserts language to clarify that the requirement to place the camera recording in a custodial interrogation so that the camera films both the interrogator and the suspect on the record only applies if the record is a visual recording. Provides that the provisions regarding the admissibility of electronic recordings apply during the prosecution of any offense to which Article 8, Electronic Recording of Interrogations, applies (was, any homicide).

Prohibits the Coastal Resources Commission (was, Department of Environment and Natural Resources) from denying, on the basis of the setback requirements in 15A NCAC 07H .0306(a)(2), a development permit for the repair or replacement (was, reconstruction) of a single-family or duplex residential dwelling (was, any residential structures) on its original footprint provided that the residential structure (1) was constructed prior to August 11, 2009, (2) has a total floor area greater than 5,000 square feet, and (3) meets the minimum setback required under 15A NCAC 07H .0306(a)(2)(A), (was, constructed before August 11, 2009 and with a total floor area greater than 5,000 square feet). Changes the title to AN ACT TO AMEND LAWS RELATING TO OCEAN SETBACKS TO PROVIDE THAT SINGLE-FAMILY AND DUPLEX RESIDENTIAL DWELLINGS GREATER THAN FIVE THOUSAND SQUARE FEET CONSTRUCTED PRIOR TO AUGUST 11, 2009, SHALL HAVE A MINIMUM SETBACK OF SIXTY FEET OR THIRTY TIMES THE SHORELINE EROSION RATE, WHICHEVER IS GREATER, FOR DEVELOPMENT PERMITS ISSUED TO REPAIR OR RECONSTRUCT SUCH PROPERTIES, IN ORDER TO PROTECT THE PROPERTY RIGHTS OF HOMEOWNERS.

S 307 (2011-2012) SMART CARD BIOMETRICS AGAINST MEDICAID FRAUD. Filed Mar 9 2011, TO ESTABLISH THE NORTH CAROLINA SMART CARD PILOT PROGRAM TO UTILIZE BIOMETRICS TO COMBAT FRAUD.

Senate committee substitute makes the following changes to 2nd edition.
Provides that the Smart Card Pilot Program is to be administered by the Provider and Recipient Services Unit of the Division of Medical Assistance (was, administered by the Program Integrity Unit of the Division of Medical Assistance). Directs that the pilot program be initiated for a six-to-12 month period (was, a 12-month period). Provides that the pilot program is to involve enrollment, distribution, and use of smart cards by designated recipients (was, all recipients) as replacements for currently used Medicaid assistance cards. Clarifies that an information system that is included in the pilot program must be a secure Web-based information system. Provides that in implementing the pilot program, the Department of Health and Human Services (Department) may incorporate additional or alternative methods (was, alternative methods) of authentication of residents.
Directs that the pilot program is to be considered a success if it meets minimum criteria defined in this act and reduces the average monthly costs of recipients within the pilot area to recover the cost of the smart card program, (was, reduce the average monthly cost of the pilot program recipients by a minimum of 3%). Prohibits expansion of the pilot program unless the Department’s data indicates that the program can be expanded through program savings (was, prohibited expansion of the program unless the General Assembly provided for its continuation or expansion).
Provides that all federal and state laws regulating the privacy of personal health information including HIPAA and HITECH apply to prosecutions involving both criminal and civil penalties allowable under law, up to a felony criminal conviction. Provides that the provisions regarding compliance and prosecution apply to all contracts made by the Department in regards to this pilot program. Requires that all compliance and prosecution provisions in the proposed act be incorporated into all contractual documents between the Department and a third-party vendor. Provides that any violation of federal or state laws regarding the privacy of personal health information makes the contracting parties subject to prosecution; however, provides that if the Department is acting in good faith, it is not held responsible for the actions of a contractor or subcontractor that violates any federal or state law concerning the protection of personal health information.
Deletes provision specifying that funds appropriated to the General Assembly for 2010-11 fiscal year for fraud prevention be carried forward to the 2011-12 fiscal year to carry out the purposes of this act.
