Changes the long title.
Amends GS 58-2-164(c2), adding to the methods that may be used to prove North Carolina residency or eligible risk status under the rate evasion fraud statute pertaining to nonfleet private passenger motor vehicle insurance. Adds to the methods listed, of which two must be used to substantiate proof of residency or eligible risk status: (1) the declaration page of the applicant's North Carolina commercial automobile policy dated no later than one year prior thereto and (2) the driver's license of a corporate officer or member of the LLC of the applicant.
Makes conforming organizational changes.

Senate committee substitute makes the following changes to the 1st edition.
Deletes the proposed changes to GS 58-36-30(b1). Amends GS 58-36-30 by adding new (b2) requiring the Commissioner of Insurance to annually collect from insurers and publish on the Department of Insurance's website, by July 1, the following data: (1) the percentage of policies for which a consent to rate has been obtained and (2) the average difference between the approved premium and the consented premium. Makes any non-aggregated data obtained by the Commissioner proprietary and confidential and not a public record. Applies only to insurance against loss to residential real property with no more than four housing units. Requires that the Department publish the required information by October 1, 2017.
Enacts new GS 58-33-107 providing that with respect to new business as as part of the rating and underwriting of nonfleet private passenger motor vehicle insurance coverage, no insurer, agent, broker, or limited representative can charge, demand, or receive a premium for a policy covering nonfleet private passenger motor vehicle insurance without first investigating and considering the potential policyholder's accident and driving records.
Makes conforming changes to the act's titles.

Amends GS 58-36-30(b1), as enacted by Section 1.3(a) of SL 2016-78, concerning consent to insurance rates in excess of that allowed by the Rate Bureau for residential real property with not more than four housing units, adding language that provides that any data obtained by the Commissioner of Insurance (Commissioner) pursuant to this subsection that identifies individual insurers or insureds is considered proprietary and confidential and not a public record (previously, subsection stated that any data obtained by the Commissioner pursuant to this subsection was proprietary and confidential and not public record). Adds new provisions requiring the Commissioner to annually collect and publish on the Department of Insurance website, no later than July 1, the following aggregated data for each geographical ratemaking territory: (1) the percentage of policies for which a consent to rate has been obtained and (2) the average difference between the manual premium and the consented premium.
