H 2 (2011-2012) PROTECT HEALTH CARE FREEDOM Filed Jan 26 2011, TO PROTECT THE FREEDOM TO CHOOSE HEALTH CARE AND HEALTH INSURANCE.

Senate committee substitute makes the following changes to 3rd edtion. Amends proposed GS 58-49A-1(b)(8) to add that the following items will not be expanded, limited, or modified by the statute: the physical and mental examination of a party ordered by a judge in a civil action under Rule 45 of the Rules of Civil Procedure, blood or genetic testing to establish paternity pursuant to GS 8-50.1 and GS 110-132.2, and the taking of DNA or any other biological evidence in accordance with GS Chapter 15A.
Amends proposed GS 58-49A-1(c) to require the Department of Justice (DOJ) to provide the Attorney General with any funds necessary to fulfill responsibilities under the subsection from funds appropriated to DOJ and from other available grants or funding.

H 89 (2011-2012) GIS/NC ONEMAP SYSTEM FUNDS. Filed Feb 14 2011, APPROPRIATING FUNDS TO REVITALIZE THE NC ONEMAP PROJECT AS RECOMMENDED BY THE JOINT LEGISLATIVE OVERSIGHT COMMITTEE ON INFORMATION TECHNOLOGY.

Appropriates $96,500 for 2011-12 and $862,500 for 2012-13 from the General Fund to the Information Technology Fund to be used as the title indicates. Effective July 1, 2011.

H 90 (2011-2012) CONFECTIONERS MAY USE UP TO 5% ALCOHOL BY VOL. Filed Feb 14 2011, TO ALLOW CONFECTIONERS TO PRODUCE CONFECTIONERIES WHICH CONTAIN NO MORE THAN FIVE PERCENT ALCOHOL BY VOLUME.

Amends GS 106-129(3)(b.) to provide that a confectionery is deemed adulterated under the North Carolina Food, Drug, and Cosmetic Act if it bears or contains more than five percent alcohol by volume (currently, contains any alcohol other than alcohol not exceeding 0.5% derived from flavoring extracts) including alcohol not in excess of 0.5% by volume derived solely from flavoring extracts (or if the confectionery falls under another statutory category).

H 91 (2011-2012) REPEAL E-NC SUNSET. Filed Feb 14 2011, TO REPEAL THE SUNSET PROVISION PERTAINING TO THE E-NC AUTHORITY, AS RECOMMENDED BY THE HOUSE SELECT COMMITTEE ON HIGH SPEED INTERNET ACCESS IN RURAL AND URBAN AREAS.

Amends Section 4 of SL 2003-425, as amended, as title indicates. Repeals current sunset date of December 31, 2011.

S 66 (2011-2012) RETRIEVAL OF DEER. Filed Feb 14 2011, TO AUTHORIZE THE RETRIEVAL OF KILLED OR WOUNDED DEER USING A SINGLE DOG ON A LEASH.

Identical to H 29, filed 2/2/11.

Adds new subsection (k) to GS 113-291.1 as the title indicates. Additionally provides that if a hunter kills or wounds a deer during authorized hunting hours then the hunter may use only a .22-caliber rimfire pistol or weapon that is otherwise legal for that hunting season to engage in the quick and humane killing of a wounded deer. Makes an exception to allow pursuit and retrieval of the deer after the hunting hours authorized under subsection (a) of GS 113-291.1, if necessary, but prohibits using a motor vehicle to accomplish the pursuit and retrieval. Effective October 1, 2011.
