H 113 (2015-2016) PROTECT OUR STUDENTS ACT. Filed Feb 24 2015, AN ACT TO PROTECT NORTH CAROLINA'S STUDENTS BY INCREASING THE CRIMINAL PENALTY FOR THE COMMISSION OF CERTAIN SEX OFFENSES COMMITTED AGAINST A STUDENT BY A PERSON WHO IS SCHOOL PERSONNEL AND TO ESTABLISH A PROCEDURE FOR INSTITUTIONS OF HIGHER EDUCATION TO OBTAIN A LIST OF STUDENTS AND EMPLOYEES AT THE INSTITUTION WHO ARE REGISTERED AS SEX OFFENDERS.

Senate amendment makes the following changes to the 2nd edition.

Amends GS 14-202.4, concerning sexual offenses involving defendants who are school personnel other than teachers, school administrators, student teachers, school safety officers, or coaches, making clarifying changes that the term school personnel includes any person as defined in GS 115C-332(a)(2), including those employed by nonpublic, charter, or regional schools.

H 294 (2015-2016) PROHIBIT CELL PHONE/DELINQUENT JUVENILE.-AB Filed Mar 18 2015, AN ACT TO MAKE IT A CRIMINAL OFFENSE TO PROVIDE A CELL PHONE TO A DELINQUENT JUVENILE IN CUSTODY OF THE DEPARTMENT OF PUBLIC SAFETY.

Senate amendment makes the following changes to the 2nd edition.

Amends GS 14-258.1(d) concerning the furnishing of mobile phones to delinquent juveniles, clarifying, for the purposes of this subsection, that a delinquent juvenile in the custody of the Division of Juvenile Justice means a juvenile confined in a youth development center or a detention facility, as well as the transportation of a juvenile to or from confinement.

Senate committee substitute makes the following changes to the 3rd edition.

Amends GS 113A-9(7a) to define the term significant expenditures of public moneysto mean the expenditure of public funds in an amount greater than $20 million (was, $10 million) for a single project or action or related group of projects or actions.

Amends GS 113A-9(11) to change the definition for the term use of public landto mean land-disturbing activity of greater than 20 acres resulting in substantial, permanent changes in the natural cover or topography of those lands (was, term means activity affecting more than 5 acres of upland property and resulting in changes to the natural cover or topography of those lands or is inconsistent with the approved management plan for a state park).

Amends GS 143-215.22L(d) to provide that regardless of the provisions of GS 113A-4(2), the study to be conducted by the Department of Environment and Natural Resources must include secondary and cumulative impacts of any proposed transfer of water for which this section requires a certificate.

S 486 (2015-2016) NC TRAIL EXPANSION/ECONOMIC CORRIDORS. Filed Mar 25 2015, AN ACT TO ENHANCE ECONOMIC DEVELOPMENT THROUGH THE EXPANSION OF THE STATE TRAILS NETWORK.

Senate committee substitute makes the following changes to the 1st edition.

Amends GS 143B-434.2A, as enacted in this act, to direct the North Carolina Trails Committee, in consultation with the Travel and Tourism Board, to review all applications for funds from the North Carolina Trails Management Trust Fund and approve or reject (was, approve) projects for funding.

Amends GS 143B-434.1 to direct the CEO of the Economic Development Partnership of North Carolina (was, the Director of the Division of Tourism, Film, and Sports Development) and the Secretary of Commerce to work with the North Carolina Travel and Tourism Board (Board) to fulfill the duties and requirements as provided in this section and to promote the sound development of the travel and tourism industry in North Carolina.

Amends GS 143B-434.1(b) to include among the functions and duties of the Board advising the Secretary of Commerce (1) in developing a budget for Visit North Carolina, a unit of the Economic Development Partnership of North Carolina (EDP); (2) as to the effectiveness of agencies with which the EDP has contracted for advertising and regarding the selection of an advertising agency to assist Visit North Carolina in promoting the state as a travel and tourism destination; and (3) as to the effectiveness of the overall operations of Visit North Carolina (was, Division of Tourism, Film, and Sports Development). Also makes it a duty of the Board to advise the Secretary of Commerce on any matter that the Secretary, Governor, or Vice-President of Tourism for the EDP (was, Director of the Division of Tourism, Film, and Sports Development) may refer to it. Deletes the requirements of naming a subcommittee.

Amends GS 143B-434.1(c) to require the Board to have 15 members (was, 13). Amends criteria for membership and designates member positions to be eliminated in order to achieve the reduction in membership. Amends subsection (d) to designate terms to be served by the members of the Board. Requires that one of the two appointments to the Board by the Speaker of the House of Representatives be associated with the tourism industry (was, tourism attractions). Requires that one of the two appointments to the Board by the President Pro Tempore of the Senate be associated with the tourism industry (was, the tourism-related transportation industry). Adds as members: (1) the Secretary of Commerce as a non-voting member; (2) the CEO of the EDP, or the CEO's designee, as a non-voting member; (3) one member of the Destination Marketing Association of North Carolina; (4) a member designated by the Board of Directors of the NC Travel Industry Association; and (5) one member-at-large appointed by the Board of Economic Development Partnership of North Carolina.

Makes additional conforming changes to delete all references to the Division of Tourism, Film, and Sports Development.

Adds authorization for the Department of Agriculture and Consumer Services (DACS) to establish admission fees and related activity fees authorized by GS 106-877 for state forests using a dynamic pricing strategy as defined in Section 3(e) of this act. Includes DACS as one of the entities required to assist in submitting a report on implementing the new pricing strategy to the Environmental Review Commission.

Amends new GS 111-47.3 to provide that in addition to the Division of Parks and Recreation of the Department of Environment and Natural Resources (DENR), any other department given responsibilities for state parks may operate or contract for the operation of food or vending services at state parks.

Amends Part V of this act to include any other department given responsibilities for the State Parks System in the General Assembly's authorization to add the Fonta Loop Trail to the State Parks System as provided in GS 113-44.14(b). Expands this Part on property management to direct DENR, or any other department given responsibilities for the North Carolina Aquariums, to study economic development opportunities for the Oregon Inlet Lifesaving Station related to tourism-related economic development. Requires DENR or the responsible agency to report its findings, including any legislative proposals, to the Environmental Review Commission no later than March 1, 2016.

Directs the Wildlife Resources Commission to update the Mattamuskeet Lodge Business Management and Tourism Study prepared for the NC Wildlife Resources Commission and issued in September 2008 (was, directed the Wildlife Resources Commission to study the feasibility of leasing Mattamuskeet Lodge and adjacent properties to a private developer for opportunities related to hunting, fishing, and tourism).

Amends additional provisions in Part V to provide flexibility in property management so as to permit DENR or any other responsible agency to conduct the studies and or activities specified in this Part and report the findings to the Environmental Review Commission no later than March 1, 2016.

Amends new GS 113A-96 to provide that trails are exempt from certain environmental regulation (was, exempt from environmental regulation). Provides that a trail is not considered a "built-upon area" under GS 143-214.7(b2). Makes a conforming change to GS 143-214.7(b2). Deletes provision defining an agency authorized to implement and enforce state and federal environmental laws. Effective when this section becomes law and applies to the construction, maintenance, or removal of a trail occurring on or after that date.

Regardless of any provision of SL 1939-168, as amended, authorizes the Department of Administration, acting on behalf of the State, to enter into an agreement to convey the real property as described in Section 7(c) of this act from the Raleigh-Durham Airport Authority in exchange for conveyance of the State-owned real property described in Section 7(d) of this act. Prescribes that fair market value be established for each property to be conveyed.

Provides that if the real property described in Section 7(c) of this act is acquired by the State, the property is to be incorporated into Umstead State Park (Park) and dedicated to the State Nature and Historic Preserve. Directs the Division of Parks and Recreation of DENR or any other department given responsibilities for state parks to dedicate between 500 and 600 acres in the southwestern corner of Umstead Park to single-track bike trails and to work with regional and local bicycle stakeholders to modify the master plan for the Park to include a single-track bicycle course within the Park's boundaries.

Removes several tracts in the Park from the Preserve. Requires the conveyance of approximately 40.82 acres of the Department of Transportation right-of-way previously acquired for the Duraleigh Connector to North Carolina State University for inclusion in Schenck Forest.

Particularly describes all property to be conveyed, and the restrictions and requirements regarding conveyance of said property. Specifies the conditions to which the property conveyed by the state to Raleigh-Durham Airport Authority are to be subject. Authorizes the Secretary of Administration to negotiate the terms of the exchange agreement necessary to fulfill the provisions of this act. Directs the Secretary to ensure that the map, dated April 14, 2015, and referenced in this act is filed in the State Property Office. Provides that the requirements of Section 7 of this act become effective only upon a simple majority vote of the Raleigh-Durham Airport Authority to proceed with the property exchange identified in this act. Makes an exception that Section 7(K), which authorizes the Secretary to negotiate the terms of the exchange agreement, is effective when this act becomes law.

S 573 (2015-2016) STRENGTHEN OYSTER INDUSTRY. Filed Mar 26 2015, AN ACT TO ENCOURAGE AND PROMOTE THE AQUACULTURE AND OYSTER CULTIVATION INDUSTRIES.

Senate committee substitute makes the following changes to the 1st edition.

Amends the long title.

Amends the definition for water column found in GS 113-201.1(5), making a technical correction. Effective July 1, 2015.

Amends GS 113-202 concerning the application process for a shellfish cultivation lease, providing that location information required by the application can be based on coordinate information from a device equipped to receive global positioning system data. Also sets the application fee for lease renewal at $50 (was, $100) and provides that the rental for initial leases is fifty cents per acre until the first day of July following the first anniversary of the lease, at which time it increases to $5 per acre (previously leases were $10 per acre per year for leases entered into after July 1, 1965). Makes conforming changes. Adds new subsection (r) providing that the specified lease includes the right to place devices or equipment related to the cultivation of marine resources on or within 18 inches of the leased bottom. Sets out when a water column lease would be required for devices or equipment. Effective July 1, 2015.

Amends GS 113-202.1 concerning water column leases for aquaculture, providing that shellfish cultivation leases can only be  amended to allow the use of devices or equipment not resting on the bottom or that extend more than 18 inches above the bottom when certain specified criteria are met, including the submittal of an application with a nonrefundable $50 application fee (previously application fee was $100). Provides that the annual rental fee for a new or renewal water column amendment is $50 (was, $100 an acre).  Effective July 1, 2015.

Deletes the following provisions from the previous edition: changes made to GS 106-758 (definitions for use in the Aquaculture Development Act); changes made to GS 106-761 (Aquaculture facility registration and licensing); proposed GS Chapter 113, Article 16A (Leasing of Bottom Land and Waters of the State for Marine Aquaculture); and changes made to GS 113-134.1 (Jurisdiction over marine fisheries resources in Atlantic Ocean).

Amends Section 44 of SL 2014-120, concerning the Senator Jean Preston Marine Oyster Sanctuary, adding a new component to the plan to construct and manage additional oyster habitat that provides that the plan cannot provide funding or resources to water bodies where a moratorium or other legal prohibition on shellfish leasing as specified is in effect. 

Directs the Division of Marine Fisheries and the Division of Coastal Management to create a new permitting process for oyster restoration projects, with a required report to be submitted to the Environmental Review Commission no later than May 1, 2016. 

Directs the Coastal Resources Commission and the Department of Environment and Natural Resources to implement 15A NCAC 03O .0503(g) (Scientific or Educational Activity Permit rule) until the required, substantively identical revised permanent rule as provided can be adopted, to allow issuance of a scientific or educational activity permit for approved activities conducted by or under the direction of a nongovernmental conservation organization as well as a scientific or educational institution. 

Amends GS 113-169.2, Shellfish license for North Carolina residents without a Standard Commercial Fishing License (SCFL), to allow individuals that work for a shellfish leaseholder with a valid SCFL to take shellfish from the leased cultivation area without personally holding a SCFL. Makes technical and conforming changes.

S 716 (2015-2016) MOUNTAIN ENERGY ACT OF 2015 (NEW). Filed May 20 2015, AN ACT TO: (1) DIRECT THE NORTH CAROLINA UTILITIES COMMISSION TO RENDER AN EXPEDITED DECISION, UNDER CERTAIN CONDITIONS, ON AN APPLICATION FOR A CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY FOR AN APPLICANT TO CONSTRUCT A GENERATING FACILITY THAT USES NATURAL GAS AS THE PRIMARY FUEL AND (2) MODIFY CERTAIN REQUIREMENTS UNDER THE COAL ASH MANAGEMENT ACT OF 2014 FOR COAL ASH SURFACE IMPOUNDMENTS LOCATED ON SITES AT WHICH ALL COAL-FIRED GENERATING UNITS PRESENT ON THOSE SITES WILL PERMANENTLY CEASE OPERATIONS BY JANUARY 31, 2020.

Directs the NC Utilities Commission (Commission) to provide an expedited decision concerning an application to construct a generating facility that uses natural gas as the primary fuel. Requires the public utility to submit an estimate of the costs of construction with as much detail as required by the Commission. Requires the Commission to render its decision on such application within 45 days of the date of application if: (1) the application is for a generating facility to be constructed on site at the Asheville Steam Electric Generating Plant, (2) the public utility will cease operations of all coal-fired generating units on or before the commercial operation of the new facility, and (3) the new natural gas-fired facility has no more than twice the generation capacity as the coal-fired units to be retired. States that GS 62-82(a), concerning notice and hearing requirements, does not apply.

Amends Section 3(b) of SL 2014-122 concerning the closure of high priority coal combustion residuals surface impoundments (impoundment), providing that the impoundment located at the Asheville Steam Electric Generating Plant must be closed as soon as practicable but no later than August 1, 2022 (was, no later than August 1, 2019). Makes technical changes. Provides that the requirements of GS 130A-309.210(c) - (f), concerning the prohibition of the discharge of stormwater into impoundments and the required conversion to the disposal of "dry" fly or bottom ash do not apply to impoundments and electric generating facilities at the Asheville Steam Electric Generating Plant. Effective August 1, 2016, if on or before that date the Commission has issued a certificate of public convenience and necessity to Duke Energy Progress for a new natural gas-fired generating facility as specified above, based on notice that Duke Energy Progress will permanently cease operations of all coal-fired generating units at the Asheville Steam Electric Generating Plant no later than January 31, 2020.

S 218 (2015-2016) FRANKLIN/ARCHDALE/SATELLITE ANNEXATIONS. Filed Mar 10 2015, AN ACT REMOVING CERTAIN RESTRICTIONS ON SATELLITE ANNEXATIONS FOR THE TOWN OF FRANKLIN AND THE CITY OF ARCHDALE AND TO REMOVE CERTAIN DESCRIBED PROPERTY FROM THE CORPORATE LIMITS OF THE TOWN OF MURPHY.

Senate committee substitute makes the following changes to the 1st edition.

Amends the short and long titles.

Provides that the deletion of the requirement in GS 160A-58.1(b)(4) that all of a subdivision be annexed if the noncontiguous area proposed to be annexed includes any or all of the subdivision applies to the Town of Franklin and the City of Archdale (previously, deletion only applied to Franklin). 

Removes specified property from the corporate limits of the Town of Murphy. Provides that this has no effect in regards to the validity of any liens of the Town of Murphy for ad valorem taxes or special assessments which were outstanding prior to the effective date of this section. Provides that such liens can be collected or foreclosed after the effective date as if the specified property is still within the corporate limits. Effective June 30, 2015.
