H 1050 (2019-2020) PED/LOW-PERFORMING SCHOOL DISTRICTS. Filed Apr 29 2020, AN ACT TO REQUIRE CONSIDERATION OF EARLY CHILDHOOD LEARNING IN IMPROVEMENT PLANS FOR LOW-PERFORMING LOCAL SCHOOL ADMINISTRATIVE UNITS AND TO REQUIRE THAT COMPREHENSIVE NEEDS ASSESSMENTS FOR LOW-PERFORMING LOCAL SCHOOL ADMINISTRATIVE UNITS INCLUDE ANALYSIS OF EARLY CHILDHOOD LEARNING.

House committee substitute makes the following changes to the 1st edition.

Amends the act's effective date provision to specify that the act applies beginning with plans of improvement and comprehensive needs assessments for local school administrative units identified as low-performing based on data from the 2020-21 school year (previously, applies beginning with local school administrative units identified as low-performing during the 2019-20 school year).

Changes the act's long title.

H 1169 (2019-2020) BIPARTISAN ELECTIONS ACT OF 2020. (NEW) Filed May 22 2020, AN ACT TO MAKE VARIOUS CHANGES TO THE LAWS RELATED TO ELECTIONS AND TO APPROPRIATE FUNDS TO THE STATE BOARD OF ELECTIONS IN RESPONSE TO THE CORONAVIRUS PANDEMIC.

Senate committee substitute makes the following changes to the 4th edition.

Section 1

Makes technical changes.

Section 2

Makes further changes to the directive to the Department of Health and Human Services and the State Board of Elections (State Board) regarding multipartisan team assistance in congregate living situations to consistently refer to the development of "guidance" rather than a "joint program" concerning safety.

Amends proposed GS 163-226.3, regarding the composition of multipartisan teams. Of the team members required to represent the two political parties having the highest number of affiliated voters in the State, requires the team members to be recommended by the county chair of each respective political party.

Section 4.5

Adds a new section.

Amends GS 163-182.2 to require precinct preliminary reports to the county board to include the number of provisional ballots cast in that precinct.

Amends GS 163-166.11 to require county boards to publish the number of provisional ballots cast in an election by 5:00 p.m. on the day after the close of polls.

Section 7

Mandates the State Board to investigate IP addresses or VPNs accessing the website for submitting online requests for absentee ballots to request absentee ballots for more than 10 qualified voters from the date the website is first available to voters through October 27, 2020. Requires the State Board to report to the specified NCGA committee on investigation outcomes by February 1, 2021. Makes conforming changes.

Section 10.5

Adds a new section amending GS 163-132.5G to require county boards of elections to report, by precinct for each item on the ballot, the number of voters who did not select a choice for an item on the ballot and the number of voters who selected more choices than available for the item on the ballot when reporting returns to the State Board of Elections. Adds a new requirement for a county board chair to appear and explain any delay in meeting the statute's voting data and return requirements at the next official meeting of the State Board.

H 1189 (2019-2020) DRIVER EDUCATION COVID-19 RESPONSE. Filed May 26 2020, AN ACT TO PROVIDE ACCOMMODATIONS FOR DRIVER EDUCATION COURSEWORK INTERRUPTED BY SCHOOL CLOSURES IN THE SPRING SEMESTER OF 2020 AND TO REQUIRE THE DIVISION OF MOTOR VEHICLES TO TEMPORARILY WAIVE THE ROAD TEST REQUIREMENT.

House committee substitute makes the following changes to the 1st edition.

Modifies the proposed accommodations for interrupted driver education coursework. Now, deems students enrolled in classroom driver education between January 2020 and March 16, 2020, in a public school or a licensed commercial driver training school to have completed all driver education classroom instruction requirements if the student completed at least 15 hours, rather than 20 hours, of classroom instruction before March 16, 2020. Requires giving students who have not completed at least 15 hours of classroom instruction the opportunity to take and pass the proficiency exam developed by the Department of Public Instruction (DPI), as provided in specified State Board of Education policy (previously not included), to waive the classroom instruction requirement. Adds a new provision authorizing public schools to resume driver education programs consistent with DPI guidance.

Adds new provisions to require the Division of Motor Vehicles (DMV) to issue temporary regular drivers licenses and limited provisional licenses without the applicant passing a road test if the applicant meets all other licensure requirements and provides proof of required financial responsibility under state law. Requires that the temporary licenses must expire no later than 90 days from issuance, and authorizes the DMV to issue additional temporary licenses consistent with the act's requirements if the administration of regularly scheduled road tests have not resumed upon expiration. Sunsets these provisions when the DMV resumes administering regularly scheduled road tests, with a required sunset of no later than 180 days from the date the act becomes law.

H 1230 (2019-2020) EXTEND STATE OF EMERGENCY RULES/MODIFICATIONS. Filed Jun 2 2020, A HOUSE RESOLUTION TO EXTEND A HOUSE RESOLUTION AMENDING THE 2019 HOUSE PERMANENT RULES OF THE 2019 GENERAL ASSEMBLY DURING EMERGENCIES.

Readopts House Resolution 1044, which amends the 2019 House Permanent Rules set out in House Resolution 16, with the following changes.

Amends Rule 3(b) to decrease the maximum time required for response to an electronic roll call when the point of quorum is raised, from 40 to 30 minutes, unless the Chair directs otherwise without objection and the 61st vote is recorded.

Amends Rule 20 to decrease the required time allowed for voting on the question when the electronic voting system is used, from 40 to 30 minutes, unless the Chair directs otherwise without objection. 

Eliminates the changes to Rule 52, which closed the gallery to the public and allowed members to be seated in the gallery, thereby reverting to the original language of Rule 52 set out in House Resolution 16.

Eliminates the provisions allowing for members to cosponsor an introduced bill or resolution on the day the bill or resolution is first read and referred and while still in possession of the House.

Amends new Rule 61.3 regarding the expiration of the Rule modifications upon written objection of either the Majority or Minority Leader, to include the same upon written objection of the Speaker. Now requires the written objection to be received by the Principal Clerk on any Monday by 5:00 p.m. (previously, required receipt on one of three identified Mondays in May).

Makes technical changes to Rule 15.1 and Rule 61.3.

Changes the expiration of the resolution to the earlier of a properly submitted written objection or adjournment sine die of the 2019 NCGA (was, or May 31, 2020).

Filed May 13 2020, AN ACT TO EXPEDITE OCCUPATIONAL LICENSURE FOR MILITARY SPOUSES, PUBLICIZE LICENSURE INFORMATION, AND REPORT DATA REGARDING APPLICANTS WHO ARE MILITARY SPOUSES AND APPLICANTS THAT HAVE MILITARY TRAINING, AS RECOMMENDED BY THE JOINT LEGISLATIVE PROGRAM EVALUATION OVERSIGHT COMMITTEE.

Senate amendment #2 makes the following changes to the 2nd edition.

Further amends GS 93B-15.1 regarding licensure for individuals with military training and experience or military spouses. Removes existing language in subsection (i) which deems the State Board of Education an occupational licensing board when issuing teacher licenses under Article 17E, GS Chapter 115C.

H 1157 (2019-2020) ABOLISH CORONER IN VARIOUS COUNTIES. (NEW) Filed May 19 2020, AN ACT ABOLISHING THE OFFICE OF CORONER IN AVERY, BLADEN, HOKE, AND MONTGOMERY COUNTIES.

Senate committee substitute to the 2nd edition makes the following changes.

Changes the effective date of Section 2 (Abolishes the office of coroner in the specified counties) and Section 3 (allowing any coroner elected in the 2018 or 2020 general election to serve the remainder of their term) from when the act became law to January 1, 2021.

H 1199 (2019-2020) GRADUATING SR. NUMERIC GRADE. (NEW) Filed May 26 2020, AN ACT TO ALLOW GRADUATING SENIORS IN UNION COUNTY PUBLIC SCHOOLS TO RECEIVE NUMERIC GRADES ON TRANSCRIPTS.

House committee substitute makes the following changes to the 1st edition.

Limits the scope of the act to the Union County Public School System and the Union County Board of Education (Board) only, rather defining the scope to include all systems and local boards of education. Expands the authorization's notwithstanding clause to include GS 116-11(10a), regarding standardized transcripts and secondary and postsecondary information exchange. Concerning the authority granted to the Board to allow each graduating senior to choose how each course grade appears on transcripts, specifies that the options are for how the grades will appear on the student's official transcript. Further specifies that the numeric option includes the grade during the remainder of the semester through remote instruction if it is higher than the grade representing learning as of March 13, 2020, only if numeric grades were given during remote instruction.

Eliminates the appropriation and accompanying provisions.
