S 257 (2017-2018) APPROPRIATIONS ACT OF 2017. Filed Mar 14 2017, AN ACT TO MAKE BASE BUDGET APPROPRIATIONS FOR CURRENT OPERATIONS OF STATE DEPARTMENTS, INSTITUTIONS, AND AGENCIES, AND FOR OTHER PURPOSES.

Senate amendments make the following changes to the 2nd edition:

Part VII. Public Schools

Section 7.13

Amendment #4 amends GS 115C-105.25 (Budget flexibility) to clarify that funds allotted for textbooks and digital resources may only be used to purchase those items, and may not be transferred by a local board of education to any other purpose.

Part X. Universities

Section 10.14

Amendment #7 changes the date by which the UNC Board of Governors must report on its study of the feasibility of establishing a School of Allied Health Sciences and Health Care at the University of North Carolina at Pembroke from May 1, 2018, to March 1, 2018.

Amendment #8 amends the study to require studying the feasibility of establishing a School of Health (was, Allied Health) Sciences and Health Care at the University of North Carolina at Pembroke; makes conforming changes by removing references to äóìallied health.äóù

Part XI. Department of Health and Human Services

SUBPART XI-A. Central management and support

Section 11A.5

Amendment #6 corrects a statutory reference in new language in Section 12A.5(a)(1) of SL 2015-241.

Section 11A.6

Amendment #6 makes a technical correction.

SUBPART XI-F. Division of MH/DD/SAS and state operated healthcare facilities

Section 11F.14

Amendment #2 adds a new section that requires of the funds appropriated to the Department of Health and Human Services, Division of Mental Health, Developmental Disabilities, and Substance Abuse Services, the recurring reduction for single-stream funding for each year of the 2017-19 biennium be increased by $100,000, with that amount used to purchase opioid antagonists, as follows: (1) $75,000 in recurring funds for each year of the 2017-19 fiscal biennium used to purchase opioid antagonists to be distributed for free to the North Carolina Harm Reduction Coalition to serve individuals at risk of experiencing an opioid-related drug overdose or to the friends and family members of an at-risk individual; and (2) $25,000 in recurring funds for each year of the 2017-19 fiscal biennium used to purchase opioid antagonists to be distributed for free to North Carolina law enforcement agencies.

Subpart XI-J Miscellaneous

Section 11J.1

Amendment #1 amends GS 58-3-200 (Miscellaneous insurance and managed care coverage and network provisions). The 2nd edition deletes language prohibiting insurers from penalizing an insured, unless certain requirements are met. The amendment reinstates that language.

Part XV. Department of Commerce

Section 15.5

Amendment #3 provides that the nonrecurring funds appropriated to the International Recruitment Coordination Office in budget code 1111 in the 2016-17 fiscal year carry forward to the 2017-18 fiscal year. Makes an organizational change.

Part XVI. Department of Public Safety

Section 16.1(d)

Amendment #5 amends GS 18B-500 (Alcohol law-enforcement agents). Authorizes alcohol law-enforcement agents to enforce criminal laws when they have probable cause to believe that a person has committed a criminal act in their presence, and at the time of the violation they are engaged in the enforcement of laws otherwise within their jurisdiction, or when they are asked to provide temporary assistance by the head of a state or local law enforcement agency or the head of the agency's designee. Such agents are not considered officers, employees, or agents of the state or local law enforcement agency asking for temporary assistance. Does not expand the agents' authority to initiate or conduct independent investigation into violations of criminal laws outside the scope of their jurisdiction.

Section 16.1(e)

Amendment #5 amends GS 18B-501 (Local ABC officers). Extends the same authority to local ABC officers that GS 18B-500, as amended by Amendment #5, extends to alcohol law-enforcement agents.

S 468 (2017-2018) QZAB USE MODIFICATION. Filed Mar 29 2017, AN ACT TO MODIFY THE USES FOR QUALIFIED ZONE ACADEMY BONDS.

Senate amendment makes the following change to the 1st edition:

Amends GS 115C-489.6. Amends the proposed conditions for the usage of funds allocated under the Qualified Zone Academy Bond (QZAB) program to further prioritize distribution to schools where 75% or more of the school's students are eligible for free or reduced lunch under the federal lunch program.
