H 40 (2017-2018) HIGH SCHOOL DROPOUT AGE PILOT/MCDOWELL COUNTY. Filed Feb 6 2017, AN ACT TO INCLUDE MCDOWELL COUNTY SCHOOLS IN THE PILOT PROGRAM TO RAISE THE HIGH SCHOOL DROPOUT AGE FROM SIXTEEN TO EIGHTEEN.

Amends provisions relating to a pilot program to raise the high school dropout age from 16 to 18 years old in Section 8.21 of SL 2016-94 (2016 Appropriations Act) to direct the State Board of Education (State Board) to authorize McDowell County schools to establish and implement the pilot program beginning with the 2017-18 school year (previously, only authorized Hickory Public Schools, the Newton-Conover City Schools, and the Rutherford County Schools). Requires the local school administrative unit to partner with the McDowell Technical Community College in administering the program. Prohibits the State Board from authorizing a pilot program in McDowell County except upon receipt of a copy of a resolution adopted by the board of education for the McDowell County Schools setting a date to begin establishment and implementation of the pilot program. Makes conforming changes.

H 43 (2017-2018) AUTOMOBILE INSURANCE REGULATORY MODERNIZATION. Filed Feb 6 2017, AN ACT TO ALLOW AUTOMOBILE INSURERS TO ESTABLISH AND IMPLEMENT INSURER-SPECIFIC DRIVER INCENTIVE PLANS.

Amends GS 58-36-65 (Classifications and Safe Driver Incentive Plan for nonfleet private passenger motor vehicle insurance) by adding a new subsection to allow an insurer to elect to develop, file, and implement an insurer-specific driver incentive plan for nonfleet private passenger motor vehicle insurance instead of setting rates pursuant to the Safe Driver Incentive Plan filed by the North Carolina Rate Bureau (Bureau) under subsection (b) of the statute. Clarifies that an insurer that makes no election must implement the Safe Diver Incentive Plan as filed by the Bureau.

Sets out requirements insurers must meet to establish and implement their own driver incentive plans, including requiring (1) the incentive plans to distinguish among various classes of drivers based on driver safety history and provide premium differentials among those classes, (2) insurers to file the plans or amended plans with the Commissioner of Insurance prior to their implementation (limits the application of amended plans to policies written or renewed at least 30 days after filing amended plans with the Commissioner), and (3) insurers to only apply the plans to drivers, risks, and coverages that have not been ceded to the North Carolina Reinsurance Facility. Clarifies that the provisions of the Bureau's Safe Driver Incentive Plan have no effect or application to drivers, risks, and coverages retained by an insurer that has made the election and filed a driver incentive plan with the Commissioner. Makes conforming changes to GS 58-36-75 (At-fault accidents and certain moving traffic violations under the Safe Driver Incentive Plan).

Effective September 1, 2017, and constitutes a recent act of the General Assembly within the meaning of GS 150B-21.1(a).

H 41 (2017-2018) SCHOOL CALENDAR FLEX./ROWAN COUNTY. Filed Feb 6 2017, AN ACT TO PROVIDE ADDITIONAL FLEXIBILITY TO THE ROWAN COUNTY BOARD OF EDUCATION IN ADOPTING THE SCHOOL CALENDAR.

Under current law, GS 115C-84.2(d) sets the parameters within which local boards of education must determine the opening and closing dates of public schools under subdivision (a)(1) of this statute.  Amends GS 115C-84.2(d) to provide the local board of education for the Rowan County Schools with additional flexibility in adopting its school calendar. Limits application of this provision to the Rowan County School System.

Applies beginning with the 2017-18 school year.

H 42 (2017-2018) ROWAN-SALISBURY BD. OF ED. ELECTION METHOD. Filed Feb 6 2017, AN ACT TO PROVIDE FOR A REFERENDUM TO CHANGE THE ELECTION METHOD OF THE ROWAN-SALISBURY BOARD OF EDUCATION FROM NONPARTISAN TO PARTISAN.

Subject to Rowan County voter approval in a referendum in a county-wide election conducted either prior to January 1, 2018, or on November 6, 2018, (depending on when the Rowan County Board of Elections conducts a county-wide election) changes the election of members of the Rowan-Salisbury Board of Education from nonpartisan to partisan, requiring candidates to be elected as candidates who are affiliated with a political party, beginning in 2018 if approved prior to January 1, 2018, or beginning in 2020 if approved on November 8, 2018, with all current members completing their terms of office. Repeals Sections C and D of Article V of "A Plan For Merger of the Rowan County School and the Salisbury City Schools, as approved by the State Board of Education, filed with the Secretary of State, and amended by SL 1987-890. Provides that, beginning in either 2018 or 2020 (depending on when the referendum required by this act occurs), the Rowan Salisbury Board of Education (Board) will have seven members, each elected on a partisan basis from a single-member residency district, as specified. Sets forth the seven residency districts for the Board. Sets out additional parameters regarding the Board's organization, members' terms, and vacancy appointments. Makes conforming changes.
