    Amends GS 58-36-65 (Classifications and Safe Driver Incentive Plan for nonfleet private passenger motor vehicle insurance) by adding a new subsection to allow an insurer to elect to develop, file, and implement an insurer-specific driver incentive plan for nonfleet private passenger motor vehicle insurance instead of setting rates pursuant to the Safe Driver Incentive Plan filed by the North Carolina Rate Bureau (Bureau) under subsection (b) of the statute. Clarifies that an insurer that makes no election must implement the Safe Diver Incentive Plan as filed by the Bureau.

    Sets out requirements insurers must meet to establish and implement their own driver incentive plans, including requiring (1) the incentive plans to distinguish among various classes of drivers based on driver safety history and provide premium differentials among those classes, (2) insurers to file the plans or amended plans with the Commissioner of Insurance prior to their implementation (limits the application of amended plans to policies written or renewed at least 30 days after filing amended plans with the Commissioner), and (3) insurers to only apply the plans to drivers, risks, and coverages that have not been ceded to the North Carolina Reinsurance Facility. Clarifies that the provisions of the Bureau's Safe Driver Incentive Plan have no effect or application to drivers, risks, and coverages retained by an insurer that has made the election and filed a driver incentive plan with the Commissioner. Makes conforming changes to GS 58-36-75 (At-fault accidents and certain moving traffic violations under the Safe Driver Incentive Plan).

    Effective September 1, 2017, and constitutes a recent act of the General Assembly within the meaning of GS 150B-21.1(a).
