H 615 (2015-2016) PROBATION VIOLATION COURT COSTS. Filed Apr 9 2015, AN ACT TO ESTABLISH COURT COSTS TO BE PAID BY PROBATION VIOLATORS.

House committee substitute makes the following changes to the 1st edition.

Amends new GS 7A-304.1 to require that court costs of $50 be assessed against a probationer if pursuant to a hearing held under GS 15A-1344 or GS 15A-1345, the probationer is found to be in violation of probation (previously did not require a violation in order to be assessed the costs).

Amends new subsections (h) of GS 15A-1344 and (f) of GS 15A-1345 to clarify that the assessment of the probation violation court costs required by GS 7A-304.1, as amended in this act, is contingent upon the probationer being found to be in violation of probation pursuant to a hearing.

This act becomes effective December 1, 2015 (was, July 1, 2015), and applies to probation violations occurring on or after that date.

H 879 (2015-2016) JUVENILE CODE REFORM. Filed Apr 14 2015, AN ACT TO MAKE VARIOUS CHANGES TO THE JUVENILE CODE IN REGARD TO DUE PROCESS PROTECTIONS, REENTRY OF JUVENILES IN THE DELINQUENCY SYSTEM, AND CONFINEMENT OF JUVENILES.

Senate amendment makes the following change to the 2nd edition.

Deletes all changes to GS 7B-3200 as amended in this act. Removes all of new subsection (e1), which allowed petitioning for the expunction of all juvenile records of a juvenile adjudicated delinquent for a minor offense as defined in GS 7B-2508. Also deletes a conforming change made to subsection (b) of GS 7B-3200.

As title indicates. Sets her term of office as July 1, 2015, to June 30, 2022.

S 399 (2015-2016) JOINT AGENCY TAX REFUND. Filed Mar 24 2015, AN ACT TO ALLOW A JOINT AGENCY CREATED TO PROVIDE POLICE PROTECTION, FIRE PROTECTION, AND EMERGENCY SERVICES A REFUND OF SALES AND USE TAXES PAID AND TO DIRECT THE REVENUE LAW STUDY COMMITTEE TO EXAMINE THE APPLICATION OF THE EXEMPTION OF THE MOTOR FUELS TAX TO ENTITIES COMPRISED OF MULTIPLE LOCAL GOVERNMENT UNITS.

Senate committee substitute makes the following changes to the 1st edition.

Amends the long title.

Amends GS 20-84(b) to authorize the Department of Motor Vehicles to issue permanent registration plates for vehicles owned and operated by a regional solid waste management authority. Effective when the act becomes law, applying to violations committed on or after that date.

H 110 (2015-2016) CHEROKEE/RUTHERFORD/CLAY BDS. OF ED. ELECTIONS. (NEW) Filed Feb 24 2015, AN ACT TO PROVIDE FOR THE PARTISAN ELECTION OF THE MEMBERS OF THE CHEROKEE, RUTHERFORD, CLAY, AND DAVIE COUNTY BOARDS OF EDUCATION, AND THE IREDELL-STATESVILLE SCHOOLS BOARD OF EDUCATION.

Senate committee substitute makes the following changes to the 2nd edition.

Adds Clay County to the act as follows.

Repeals Chapter 254 of the 1991 Session Laws, which changed the manner of election of the Clay County Board of education to nonpartisan.

Adds that the Clay County Board of Education (board) consists of five members elected for four-year terms. Requires, beginning in 2016, that board members be elected on a partisan basis and requires candidates for the board be nominated at the same time and manner as other county officers. Requires vacancies for positions elected on a nonpartisan basis in 2012 or 2014 to be filled by appointment made by the remaining members, and beginning in 2016 vacancies on the board for positions elected on a partisan basis must be filled according to GS 115C-37.1. Provides that this does not affect the terms of office of any person elected in 2012 or 2014 to the board.

Amends GS 115C-37.1 (concerning the filling of partisan elected positions) to add that the provisions of the statute also apply to Clay County, effective the first Monday in December 2016.

Makes clarifying changes.

Amends the act's short and long titles.
