H 122 (2025-2026) NORTH CAROLINA BOARD OF INTEGRATIVE THERAPIES. (NEW) Filed Feb 13 2025, AN ACT TO ESTABLISH THE NORTH CAROLINA BOARD OF INTEGRATIVE THERAPIES AND TO CREATE LICENSURE PROCESSES FOR ART THERAPISTS AND MUSIC THERAPISTS.

House committee substitute to the 1st edition makes the following changes.

Instead of establishing the NC Healing Arts Commission to regulate music therapists and reflexologists, creates the NC Board of Integrative Therapies (Board) to now regulate music therapists and art therapists.  Makes conforming changes throughout the act to reflect these changes. Makes conforming changes to act’s long and short titles. Makes technical changes throughout.  

Defines integrative therapies and Board in GS 90-750.2 (definitions under the NC Integrative Therapies Act, new Article 44 to GS Chapter 90). Expands the Board’s membership to now include two licensed physicians who have experience with integrative therapies appointed by the Governor in GS 90-750.3 (was, four members of occupations licensed under new Article 44). Also requires any integrative therapies profession created after July 1, 2026 (was, January 1, 2026), to have two members on the Board. Exempts the physician Board members from the licensure requirement for Board members under new Article 44.

Adds art therapy to the definitions pertaining to Part 2 of new Article 44 (Art Therapy). Modifies certifying entity to refer to the Art Therapy Credentials Board or its successor. Removes reflexology. Changes the deadline for appointment of members to the NC Art Therapy Advisory Committee (Committee) from January 1, 2026, to January 1, 2027. Changes the date for renewal of an Integrative Therapy license for Art Therapy from on or before January 1 each year to a date established by rule in GS 90-750.15. Removes exemption from bar on compensation for unlicensed individuals under new Part 2 of Article 44 for individuals holding certifications of completion from a nationally recognized education completed no more than six months prior to that individual receiving compensation for services.

Modifies music therapy and music therapy services in new GS 90-750.21 (definitions pertaining to new Part 3, Music Therapy, of GS Article 44). Changes the deadline for appointment of members to the NC Music Therapy Advisory Committee (MT Committee) from January 1, 2026, to January 1, 2027. Removes the degree requirements and clinical training requirements for an Integrative Therapies license in Music Therapy in GS 90-750.24. In addition to existing requirements, allows an applicant for such a license to either provide proof of holding the described credential or passing an exam for board certification offered by the Certification Board for Music Therapists or a successor organization. Changes the date for renewal of an Integrative Therapy license for Music Therapy from on or before January 1 each year to a date established by rule in GS 90-750.25. Removes the identification card requirement in GS 90-750.27 (NC licensed music therapists). Clarifies that Chapter GS 90 does not restrict or prohibit the activities of (1) any individual licensed, certified, or regulated under in another profession or occupation, performing work, including the use of music, incidental to the practice of his or her licensed, certified, or regulated profession or occupation, if that person does not represent himself or herself as a music therapist; (2) any individual whose training and national certification attests to the individual's preparation and ability to practice his or her certified profession or occupation, if that person does not represent himself or herself as a music therapist; or (3) any practice of music therapy as an integral part of a program of study for students enrolled in an accredited music therapy program, if the student does not represent himself or herself as a music therapist. Allows for individuals to provide music therapy under supervision for a period no longer than 180 days from the start of practice if their application to obtain board certification is pending and they meet the remaining licensure requirements. Adds GS 90-750.29, governing collaboration, as follows. Requires individuals with an Integrative Therapy license for Music Therapy to review the client’s diagnosis, needs and treatment plan with the person’s healthcare providers involved in their care before starting music therapy. If that person is a student in a special education setting, requires the therapist to review any plan, the student’s diagnosis, treatment needs and treatment plan. Provides for collaboration, as applicable with the client’s treatment team, as specified. Prohibits an individual with an Integrative Therapy license for Music Therapy from replacing services providing by an audiologist. Bars such individuals from practicing as a speech-language pathologist while providing music therapy, unless authorized to practice speech language pathology. Bars persons with an Integrative Therapy license for Music Therapy from representing that they are authorized to treat a communication disorder, though they may say that they work with clients who have a communication disorder and address communication skills.

Adds physician appointees to the initial members of the Board, with one appointee serving two years, and another serving one year.  Requires that the initial appointments now be made by December 1, 2026 (was, December 1, 2025), with the terms beginning on January 1, 2027 (was, January 1, 2026). Expands the provisions that are effective on the first day of a month 180 days after the Board certifies to the Revisor of Statutes that it has begun accepting applications for Integrative Therapies licenses to include: GS 90-750.16 (compensation for art therapy), GS 90-750.17 (display of art therapy license and advertising), GS 90-750.26 (compensation for music therapy), and GS 90-750.27 (licensed music therapists).

Changes the effective date to when it becomes law except as otherwise provided (was, January 1, 2026).

H 1232 (2025-2026) CONST. AMEND./LIFE AT FERTILIZATION. Filed May 13 2026, AN ACT TO AMEND THE NORTH CAROLINA CONSTITUTION TO DECLARE THAT A DISTINCT AND SEPARATE HUMAN LIFE BEGINS AT THE MOMENT OF FERTILIZATION AND SHALL BE HELD INVIOLATE AS AN INDIVIDUAL PERSON AND PROTECTED BY THE LAWS OF THIS STATE FROM THE MOMENT OF FERTILIZATION UNTIL NATURAL DEATH, SO LONG AS THAT PERSON IS NOT CONVICTED OF A CAPITAL OFFENSE.

Subject to approval by a majority of voters during the 2026 general election, adds new Section 39 to Article I of the North Carolina Constitution as follows. Specifies that human life begins at fertilization. Recognizes a new human life as an individual person, entitled to the protection of the laws of this State from the moment of fertilization until the moment of natural death. Holds persons willfully seeking to destroy the life of another, at any stage of life, or who succeeds in doing so, accountable for first-degree murder, or attempted murder. Specifies that any person has the right to defend the life of themselves or another, even by use of deadly force if necessary, from willful destruction by another person. Specifies that the State has an  interest and a duty to defend innocent persons from willful destruction of their lives and to punish those who take the lives of persons, born or unborn, who have not committed any crime punishable by death. If approved, effective January 1, 2027.

S 355 (2025-2026) SUPPORT THE DEPT. OF ADULT CORRECTION.-AB Filed Mar 20 2025, AN ACT TO SUPPORT THE WORK OF THE DEPARTMENT OF ADULT CORRECTION.

House committee substitute to the 3rd edition makes the following changes.

Make a clarifying change in GS 15A-101.1. 

Changes the effective date of the changes made to GS 14-208.20 from December 1, 2025, to December 1, 2026.

Updates the numbering of the act's Parts and Sections.

S 814 (2025-2026) NATHANIEL DENNY; NC DEPT I.T. Filed Apr 21 2026, A SENATE RESOLUTION CONFIRMING NATHANIEL DENNY AS THE SECRETARY OF THE DEPARTMENT OF INFORMATION TECHNOLOGY.

Senate amendment makes the following changes to the 1st edition. Removes the whereas clauses. Confirms Nathaniel Denny to serve as the Secretary of the Department of Information Technology.  Makes conforming changes to the act's long title.

S 990 (2025-2026) STUDENTS FIRST ACT. Filed Apr 30 2026, AN ACT TO ENACT THE PROTECT CAMPUS SURVIVORS ACT AND TO APPROPRIATE FUNDS TO THE UNIVERSITY OF NORTH CAROLINA TO SUPPORT PUBLIC EDUCATION.

Senate committee substitute makes the following changes to the 1st edition. Makes technical change to act’s long title.  

Removes the prior contents of Part I of the act (the Protect Campus Survivors Act) and makes the following changes instead. Makes technical change to Part I’s catchline.

Enacts GS 132-1.3B, pertaining to records of student disciplinary proceedings held by public institutions of higher education. Defines disciplinary proceeding, personally identifiable information, and public institutions of higher education. Specifies that a public record does not include any record of a disciplinary proceeding that reveals personally identifiable information (as defined in the regulations governing the Family Educational Rights and Privacy Act-FERPA) about a student enrolled in a public institution of higher education, even if release is authorized under FERPA. Specifies that the statute does not limit the disclosure of a public record that does not contain personally identifiable information from a student’s disciplinary proceeding, including aggregated data, guidelines, instructions, or summaries. Makes conforming changes to GS 116-43.17 (confidentiality of certain records) and GS 115D-78 (access to information and public records). Applies to requests for records of a disciplinary proceeding that reveals personally identifiable information about a student submitted on or after the act becomes law.

S 1040 (2025-2026) REPEAL CON FOR ASCS AND INPATIENT REHAB. Filed Apr 30 2026, AN ACT REPEALING CERTIFICATE OF NEED LAWS FOR AMBULATORY SURGICAL FACILITIES AND FOR INPATIENT REHABILITATION SERVICES, FACILITIES, AND BEDS; APPROPRIATING FUNDS TO THE DEPARTMENT OF HEALTH AND HUMAN SERVICES TO IMPLEMENT THESE CHANGES AND DEVELOP A PLAN FOR THE PHASED ELIMINATION OF THE STATE'S REMAINING CERTIFICATE OF NEED LAWS; AND DELETING OBSOLETE DEFINITIONS FOR BEHAVIORAL HEALTH FACILITIES THAT ARE NO LONGER SUBJECT TO CERTIFICATE OF NEED REVIEW.

Senate committee substitute to the 1st edition makes the following changes.

Amends GS 131E-176 by changing the definition of rehabilitation facility to a facility that has been classified and designated as an inpatient rehabilitation facility by the Centers for Medicare and Medicaid Services under Part 412 of Subchapter B of Chapter IV of Title 42 of the Code of Federal Regulations.

S 1080 (2025-2026) LOWER TAXES FOR ALL NC. Filed May 13 2026, AN ACT TO AMEND THE NORTH CAROLINA CONSTITUTION TO PROVIDE THAT THE MAXIMUM TAX RATE ON INCOMES CANNOT EXCEED THREE AND ONE-HALF PERCENT.

Subject to approval of the voters at the Statewide general election to be held November 3, 2026, amends Section 2 of Article V of State Constitution to lower the cap on State income tax from 7% to 3.5%. Effective upon certification and applies to taxable years beginning on or after January 1, 2027.
