H 1167 (2019-2020) PRISONER RELEASE/NOTIFICATION REQUIRED. Filed May 20 2020, AN ACT TO REQUIRE THE DIVISION OF ADULT CORRECTION AND JUVENILE JUSTICE AT THE DEPARTMENT OF PUBLIC SAFETY TO PROVIDE NOTICE TO THE RELEVANT PUBLIC HEALTH DIRECTOR AND LOCAL REENTRY COUNCIL PRIOR TO RELEASING AN INCARCERATED PERSON DURING THE COVID-19 OUTBREAK.

States the act's purpose is to prevent community spread of COVID-19 from persons who have been in prison or congregate living conditions.

Requires the Department of Public Safety (DPS), Division of Adult Correction and Juvenile Justice (Division), prior to releasing an incarcerated person from prison, to (1) administer COVID-19 testing, and (2) provide five days' notice of release to the respective county public health director and Local Reentry Council, if applicable, where the person intends to reside. Requires the county public health director or Local Reentry Council to use best efforts to provide COVID-19 testing, and medical treatments and quarantine, if necessary. Clarifies that failure to provide required testing or notice cannot prevent or delay release. Applies to the release of persons on or after the date the act becomes law. Expires on the date Executive Order No. 116 (State of Emergency Declaration for COVID-19) is rescinded.

Appropriates $25,000 in nonrecurring funds from the General Fund to DPS for the 2019-20 fiscal year to implement the act.

S 828 (2019-2020) ABSENTEE BALLOT EQUALITY/2020 ELECTION. Filed May 21 2020, AN ACT TO PROVIDE EQUAL ACCESS AND TREATMENT FOR ALL IN SUBMITTING ABSENTEE BALLOTS FOR THE 2020 GENERAL ELECTION IN RESPONSE TO THE COVID-19 PANDEMIC.

Includes several whereas clauses regarding the impacts COVID-19 poses on the general election. 

Mandates the State Board of Election (State Board) to provide all eligible voters the option of submitting their mail-in absentee ballots with a signed declaration for the 2020 general election. Provides for the signed declaration to be similar to the option given through special programs under the Uniform Military and Overseas Voters Act, Article 21A, GS Chapter 163. Specifies that compliance is not required of more stringent requirements for the submission of 2020 general election mail-in absentee ballots than those required under Article 21A, GS Chapter 163. Applies to elections held on or after the date the act becomes law and expires upon certification of the 2020 general election.

S 829 (2019-2020) REPURPOSE PRE-REGULATORY LANDFILL FUNDS. Filed May 21 2020, AN ACT TO REVISE MATCHING REQUIREMENTS FOR STATE FUNDING OF REMEDIATION ACTIVITIES AT THE CHARLOTTE MOTOR SPEEDWAY.

Amends Section 13.2 of SL 2018-5, as amended, regarding the diversion of $2 million credited to the Inactive Hazardous Sites Cleanup Fund for the assessment and remediation of pre-1983 landfills to instead be used by the Department of Environmental Quality, Division of Waste Management, to provide a matching grant to the Charlotte Motor Speedway. Revises the grant's matching requirement from $1 for every $2 in non-State funds, to $1 for every $1 in non-State funds, up to $2 million for the matching grant.

S 830 (2019-2020) CARES ACT FUNDS FOR GREENSBORO. Filed May 21 2020, AN ACT TO APPROPRIATE FEDERAL CARES ACT FUNDS TO THE CITY OF GREENSBORO TO BE USED TO PREVENT COMMUNITY SPREAD OF COVID-19.

Identical to H 1166, filed 5/20/2020.

Directs the State Controller to transfer $10 million from the Local Government Corornavirus Relief Reserve to the Coronavirus Relief Fund (both established in SL 2020-4, 2020 COVID-19 Recovery Act). Appropriates from the Coronavirus Relief Fund $10 million in nonrecurring funds to the Office of State Budget and Management (OSBM) for the 2020-21 fiscal year. Requires allocation of the funds to the City of Greensboro (City) for expenditures consistent with federal Treasury guidance regarding the federal Corornavirus Relief Fund.

Deems the City liable to the State for any misuse or mishandling of appropriated funds. Subjects funds to clawbacks and other appropriate measures regarding misuse. Provides for personal civil liability to the State against any City officer, official or employee for violations of the act. Establishes quarterly reporting requirements, beginning October 1, 2020, for the City to report to OSBM on the use of allocated funds until funds are expended or accounted for. 

Makes the guidance, reporting and audit requirements in specified sections of SL 2020-4 applicable to the act.

Effective July 1, 2020.

S 831 (2019-2020) MUNICIPALITIES OCCUPANCY TAX. Filed May 21 2020, AN ACT TO AUTHORIZE THE MUNICIPALITIES LOCATED WITHIN HIGH-POPULATION COUNTIES TO LEVY AN ADDITIONAL ONE PERCENT ROOM OCCUPANCY TAX.

Authorizes municipalities located in whole or in part in a county with a population greater than 900,000 to level a room occupancy tax up to 1% of the gross rental receipt with proceeds utilized for a public purpose of the municipality. Specifies that the tax is in addition to any State or local sales tax or other enabling municipal tax acts. Requires the tax to be levied, administered, collected and repealed consistent with the uniform provisions for room occupancy tax prescribed in GS 160A-215, with penalties provided under the same.

Amends GS 160A-215 to expand the scope of the act's provisions relating to levying room occupancy tax, including collection, administration, repeal, and use of the tax, to include Raleigh, Apex, Cary, Charlotte, Cornelius, Davidson, Fuquay-Varina, Garner, Holly Springs, Huntersville, Knightdale, Matthews, Mint Hill, Morrisville, Pineville, Rolesville, Stallings, Wake Forest, Wendell and Zebulon.

Appropriates $25,000 from the General Fund to the Department of Commerce for the 2020-21 fiscal year to study the anticipated effects of the tax increase authorized by the act in municipalities opting to levy the tax.
