H 553 (2019-2020) LICENSING CERTAIN FIRE SAFETY EQUIP. WORK. Filed Apr 2 2019, AN ACT TO REQUIRE LICENSING AND PERMITTING FOR FIRMS AND PERSONS THAT INSTALL AND SERVICE PORTABLE FIRE EXTINGUISHERS AND FIRE SUPPRESSION SYSTEMS.

House committee substitute makes the following changes to the 3rd edition.

Makes the following changes to proposed Article 82B, Licensing and Permitting for the Installation and Servicing of Portable Fire Extinguishers and Fire Suppression Systems, of GS Chapter 58. 

Modifies the provisions regarding grounds for disciplinary action against licensees or permittees, removing the following: failure to comply with a child support order; failure to pay State income tax; and conviction of a crime involving dishonesty, a breach of trust, or moral turpitude. Additionally, adds conviction of a felony as grounds for disciplinary action under the Article.

Makes clarifying changes to the Department of Insurance reporting requirement.

S 11 (2019-2020) ABC REGULATION AND REFORM. Filed Jan 31 2019, AN ACT TO STRENGTHEN THE PERMITTING ENFORCEMENT AUTHORITY OF THE ABC COMMISSION AND TO MAKE OTHER CHANGES TO THE ABC LAWS.

House committee substitute to the 3rd edition corrects reference to federal law set forth in the proposed changes to GS 18B-1000(5), which defines private club.

S 219 (2019-2020) MODIFY TEACHER LICENSING REQUIREMENTS. Filed Mar 11 2019, AN ACT TO MODIFY TEACHER LICENSURE REQUIREMENTS.

House committee substitute to the 3rd edition makes the following changes.

Part II.

Adds to proposed GS 115C-270.20(a)(7), which establishes a transitional license (TL) for out-of-state teachers. Provides that transitional licensees are not required to demonstrate preparation through achieving a minimum score on a standardized exam.

Part III.

Adds to the proposed changes to GS 115C-270.20(a)(4), which allows for issuance of a lifetime license after 30 or more years of teaching as a licensed teacher. Clarifies that a teacher has completed 30 or more years of teaching as a licensed teacher when the teacher holds a current NC teaching license and has completed 30 or more years of creditable service with the Teachers' and State Employees' Retirement System.

Part V.

Makes a technical change.

S 553 (2019-2020) REGULATORY REFORM ACT OF 2019. Filed Apr 2 2019, AN ACT TO PROVIDE FURTHER REGULATORY RELIEF TO THE CITIZENS OF NORTH CAROLINA.

Senate amendment makes the following changes to the 2nd edition.

Part I. State and Local Government Regulation

Modifies the proposed changes to GS 93A-40(a) concerning real estate licensing requirements for time share salespeople. Now defines a time share salesperson to be a licensed real estate broker unless the salesperson meets the requirements for exemption from licensure under specified state law, or is an employee of the registered time share developer, and has their income reported on the IRS W2 form (previously did not include employees of registered time share developers in the licensure exemption).

Part II. Agriculture, Energy, Environment, and Natural Resources Regulation

Eliminates the proposed changes to GS 130A-309.10 and instead maintains the existing prohibition against disposing discarded computer equipment or discarded televisions in landfills or by incineration.
