House committee substitute to the 1st edition deletes the content of the previous edition and replaces it with the following. Includes whereas clauses. Confirms the appointment of Theresa B. Stephenson to the Board of Review for a term beginning July 1, 2019, and ending June 30, 2023. Makes conforming changes to the act’s titles.

H 99 (2019-2020) TRANSFER ALE/MOVE BOXING ADVISORY COMMISSION. (NEW) Filed Feb 18 2019, AN ACT TO ESTABLISH ALCOHOL LAW ENFORCEMENT AS A SEPARATE DIVISION OF THE DEPARTMENT OF PUBLIC SAFETY AND TO CLARIFY THE JURISDICTION AND PRIMARY RESPONSIBILITIES OF ALCOHOL LAW-ENFORCEMENT AGENTS AND ALSO TO MOVE THE BOXING ADVISORY COMMISSION TO THE DEPARTMENT OF COMMERCE, TO RENAME IT THE BOXING COMMISSION, AND TO GIVE IT RULE-MAKING AUTHORITY.

Senate committee substitute makes the following changes to the 2nd edition. Appropriates $300,000 in recurring funds for each year of the 2019-21 biennium from the General Fund to the Department of Public Safety, Division of Alcohol Law Enforcement (ALE), to fund office space. Also appropriates $213,638 for 2019-20 and $427,276 for 2020-21 from the General Fund in recurring funds to ALE to fund eight full-time equivalent administrative positions.

H 848 (2019-2020) RV DEALER REGULATION. Filed Apr 16 2019, AN ACT TO REMOVE RECREATIONAL VEHICLES FROM ARTICLE 12 OF CHAPTER 20 OF THE GENERAL STATUTES, WHICH PROVIDES FOR LICENSING AND REGULATION OF MOTOR VEHICLE DEALERS AND MANUFACTURERS; TO ENACT A NEW ARTICLE 19 IN CHAPTER 20 OF THE GENERAL STATUTES TO REGULATE RECREATIONAL VEHICLE DEALERS AND MANUFACTURERS; AND TO UPDATE DEFINITIONS AND CROSS REFERENCES.

House committee substitute to the 1st edition makes the following changes. 

Makes technical and clarifying changes to proposed Article 19, Regulation of Recreational Vehicle (RV) Dealers and Manufacturers, GS Chapter 20. Additionally makes the Article's language gender-neutral.

Makes clarifying changes throughout that dealership agreements are manufacturer and dealership agreements. Concerning the termination, cancellation, or nonrenewal of a manufacturer and dealership agreement, allows a manufacturer to reduce the required 90 days' notice period to 30 days' notice if there is a material violation of the Article (rather than the act) which is not cured within 30 days after written notice by the manufacturer. Modifies the proposed terminology regarding the transfer of a dealership under agreement with a manufacturer, now referring to the transfer of the dealership rather than sale, and referring to the transferor dealer rather than the selling dealer.

Concerning the prohibition against manufacturers or distributors coercing dealers, prohibits coercing dealers to enter into an agreement that requires dealers to submit its disputes to binding arbitration or otherwise waives rights or responsibilities provided under the Article (rather than the act). 

Amends the proposed mediation provisions to refer to the Article rather than the act throughout.

H 1016 (2019-2020) UNC BOARDS OF TRUSTEES APPOINTMENTS. Filed May 28 2019, AN ACT TO MAKE APPOINTMENTS TO THE BOARDS OF TRUSTEES FOR CONSTITUENT UNIVERSITIES OF THE UNIVERSITY OF NORTH CAROLINA AND THE BOARD OF TRUSTEES OF CLEVELAND COMMUNITY COLLEGE.

Includes whereas clauses. Provides for 16 appointments by the Speaker of the House and 14 appointments by the President Pro Tem. of the Senate to the Boards of Trustees of specified constituent UNC institutions for terms expiring June 30, 2023. Additionally provides for the appointment of a member to the Board of Trustees of Cleveland Community College by the Speaker of the House for a term expiring June 30, 2023.
