    Senate amendment makes the following changes to the 3rd edition.

    Deletes Section 2 of SL 1967-1242, as amended by Section 2 of SL 2010-42, which provided that members of the Davie County Board of Education were to be elected in a nonpartisan election.

    Beginning in 2016, adds the Davie County Board of Education (Davie Board) to those county boards of education whose members are to be elected on a partisan basis at the time of the general election in each even-numbered year as terms expire. Provides for the election to four-year terms of four members to the Davie County Board in 2016, and every four years thereafter. Also provides that in 2018, and every four years following, three members of the Davie Board are to be elected to four-year terms.

    Makes conforming changes to Section 3 of SL 1967-1242, as amended by Section 3 of SL 2010-42, to delete language specifying that the Davie Board elections are to be nonpartisan and that ballots do not include any political party affiliation designation for candidates and instead declares that the election is to be partisan.

    Amends Section 4 of SL 1967-1242, as amended by SL 1979-5, SL 1995-307, and Section 4 of SL 2010-42, to provide that members of the Davie Board are to be inducted into office and take the oath of office on the first Monday in December (was, in July) following their election.

    Requires vacancies for positions elected to the Davie County Board on a nonpartisan basis in 2012 or 2014 to be filled by appointment made by the remaining members, and beginning in 2016 vacancies on the board for positions elected on a partisan basis must be filled according to GS 115C-37.1. Provides that this does not affect the terms of office of any person elected in 2012 or 2014 to the Davie County Board.

    Also provides that regardless of the "Plan of Merger of the Iredell County and Statesville City Schools Board of Education," as amended by Section 2 of SL 2002-18, beginning in 2016 the Iredell-Statesville Schools Board of Education (Iredell-Statesville Board) is added to those school boards whose members are to be elected on a partisan basis at the general election in each even-numbered year as terms expire. Requires that candidates for the Iredell-Statesville Board be nominated at the same time and in the same manner as other county officers. Provides that members are to take office on the first Monday in December following their election and terms of their predecessors are to expire at the same time. Provides that vacancies on the Iredell-Statesville Board for positions elected on a partisan basis are to be filled in accordance with GS 115C-37.1. Requires vacancies for positions elected to the Davie County Board on a nonpartisan basis in 2012 or 2014 to be filled for the unexpired term by the remaining members of the Board.

    Amends GS 115C-37.1(d) to make conforming changes to add Davie County and Iredell County to the counties to which the provisions of this statute apply.

    Senate committee substitute makes the following changes to the 2nd edition.

    Adds Clay County to the act as follows.

    Repeals Chapter 254 of the 1991 Session Laws, which changed the manner of election of the Clay County Board of education to nonpartisan.

    Adds that the Clay County Board of Education (board) consists of five members elected for four-year terms. Requires, beginning in 2016, that board members be elected on a partisan basis and requires candidates for the board be nominated at the same time and manner as other county officers. Requires vacancies for positions elected on a nonpartisan basis in 2012 or 2014 to be filled by appointment made by the remaining members, and beginning in 2016 vacancies on the board for positions elected on a partisan basis must be filled according to GS 115C-37.1. Provides that this does not affect the terms of office of any person elected in 2012 or 2014 to the board.

    Amends GS 115C-37.1 (concerning the filling of partisan elected positions) to add that the provisions of the statute also apply to Clay County, effective the first Monday in December 2016.

    House committee substitute makes the following changes to the 1st edition.

    Makes technical changes.

    Amends Section 4 of Chapter 359 of the 1973 Session Laws deleting provisions which previously provided for nonpartisan elections for the Rutherford County Board of Education. Adds language which provides that the elections will now be on a partisan basis. Changes the deadline for delivering the map and description of the boundaries of the districts to the chairman to February 1 (was, August 10).

    Makes clarifying changes.

    Provides that the partisan elections for the Rutherford County Board of Education will begin in 2016 as specified in the act. Provides that vacancies for positions elected on a partisan basis will be filled in accordance with GS 115C-37.1(d). 

    Amends GS 115C-37.1(d) to add Rutherford County to the listed counties to which the statute applies effective the first Monday in December 2016. 

    Deletes the provision repealing laws in conflict with the act.

    Provides that beginning in 2016, all members of the Cherokee County Board of Education (Board) will be elected on a partisan basis, at the general election in each even-numbered year as terms expire. Provides that candidates for election to the Board will be nominated at the same time and manner as other county officers.  Such elected members are to take office and qualify on the first Monday in December of the year of their election and as such the terms of their predecessors will expire at the same time.  Requires vacancies on the Board for positions elected on a partisan basis to be filled in accordance with GS 115C-37.1, provisions concerning the filling of partisan elected positions.

    Amends GS 115C-37.1(d) to provide that the provisions of the statute also apply to Cherokee County, effective the first Monday in December 2016.

    Amends Section 2 of Chapter 502 of the 1975 Session Laws to delete language that provided that no primary election would be held for the seats of the Cherokee County Board of Education.

    Makes other conforming and clarifying positions, including repealing Section 8 of Chapter 502 of the 1975 Session Laws, concerning the filing for nonpartisan candidacy for the Cherokee County Board of Education.

    Also amends Section 10 of Chapter 502 of the 1975 Session Laws to clarify that vacancies occurring in nonpartisan positions in 2012 or 2014 for the Board must be filled within 20 days of such vacancy by the remaining members of the Board and for the unexpired term.  Makes technical changes.

    Provides that the bill does not affect any term of office of a person elected in 2014 or 2014 to the Board.

    Provides that all laws and clauses in conflict with this bill are repealed to the extent of the conflict.
