Senate committee substitute makes the following changes to the 4th edition.

Amends the long title. 

Amends GS 143-136 concerning the Building Code Council, providing that the appointment of the member to the Building Code Council that is required to be an active member of the NC Fire Service with expertise in fire safety must be made based on the recommendation of the NC State Firemen's Association. 

Amends proposed GS 143-141(c1) to require the Department of Insurance to post and maintain on its website, in the areas devoted to the Council, all appeal decisions, interpretations, and variations of the Code issued by the Council within 10 business days of issuance (previously, required the posting of such information within three business days).

Amends GS 143-138.1(b) to require the Department of Insurance to post and maintain, on its website in the areas devoted to the Council, written commentaries and interpretations made and given by Council staff and the Department for each section of the Code within 10 business days of issuance (previously, required the posting of such information within three business days). 

Amends GS 153A-352 and GS 160A-412 concerning the duties and responsibilities of county and city inspectors and inspection departments, deleting language that required inspectors to conduct full inspections and provide permit holders with complete lists of all items that fail to meet the requirements of the Code for One- and Two-Family Dwellings and replacing it with the requirement that inspectors conduct all inspections requested by a permit holder for each scheduled inspection visit. Further requires the inspector to inform the permit holder of instances where the work inspected is incomplete or fails to meet requirements of the NC Residential Code for One- and Two-Family Dwellings. 

Adds a new section amending GS 153A-352 and GS 160A-412 as follows. Requires counties and cities to accept and approve, without further responsibility to inspect, a design or other proposal for a component or element in the construction of a building from a licensed architect or engineer if (1) the submission is completed under valid seal of the architect or engineer, (2) field inspection of the installation or completion of construction is performed by the architect or engineer, and (3) that architect or engineer provides a signed document stating the component or element of the building inspected is in compliance with the NC State Building Code or the NC Residential Code for One- and Two-Family Dwellings. Discharges the county, city, their inspection departments, and inspectors from any duties and responsibilities with respect to the component or element in the building construction when the signed document is accepted and approved. Makes clarifying changes. Makes conforming changes to GS 153A-356 and GS 160A-416.

Adds language exempting commercial building projects having a total value of less than $90,000 and a total project area less than 2,500 square feet from the requirement for a professional architectural seal.

Senate committee substitute makes the following changes to the 2nd edition.

Amends the long title.

Directs the Commission for Public Health (Commission) to amend 15A NCAC 18A .1956(7)(d) (Modifications to Septic Tank Systems: Sand Lined Trench System Rule) to provide that a Public Management Entity with a Certified Operator is not required for sand lined trench systems when drainage is utilized to lower the water table on a site. Provides that the above rule is to be implemented until a substantively identical permanent rule is adopted as specified.

Directs the Department of Health and Human Services or the Commission to repeal 15A NCAC 18A .1956(6) (Modifications to Septic Tank Systems: Saprolite System Rule) on or before December 1, 2015. Further provides that until the repeal is effective, no state agency or local government can implement or enforce the Saprolite System Rule.

H 882 (2015-2016) COMM. MGR. LICENSING & PLANNED COMM. ACT CHGS. Filed Apr 14 2015, AN ACT TO MAKE VARIOUS CHANGES TO THE PLANNED COMMUNITY ACT.

House committee substitute makes the following changes to the 1st edition.

Rewrites the long title to reflect changes made to the bill content in this committee substitute.

Deletes all of Part I. Community Association Property Management Act, which amended GS 93A-16(a) and enacted a new Article 7 in GS Chapter 93A, which made it unlawful for a person to directly or indirectly engage in the business of community association property management without being licensed as a real estate broker.

Enacts new GS 47F-2-105 in Article 2 (was, in Article 3) of GS Chapter 47F. Amends GS 47F-2-105 to replace references to "common interest community" with the term "planned community" wherever it occurs.

Deletes GS 47F-2-106, as enacted in this act (regarding allocation of common expense liabilities and votes) and makes a conforming change to GS 47F-2-105(a)(10), deleting a reference to GS 47F-2-106.

Amends GS 47F-2-117(b) to prohibit bringing any action to challenge the validity of an amendment to a declaration for a planned community more than three years (current law states one year) after the amendment is recorded (1st edition deleted subsection (b) in its entirety).

Deletes changes to the following statutes: GS 47F-2-120, GS 47F-3-101, GS 47F-3-103, GS 47F-3-114, and GS 47F-3-116.

Amends GS 47F-3-118 to clarify that for purposes of this statute, the means for copying records includes the receipt of copies through an electronic transmission if available. Permits an association to withhold records from inspection and copying that contain information regarding existing or reasonably anticipated (was, existing or potential) litigation, mediation, arbitration, or administrative proceedings. Also permits an association to withhold records from inspection and copying that contain information regarding existing or reasonably anticipated (was, existing or potential) federal, state, or local administrative or other formal proceedings before a governmental tribunal for enforcement of the declaration, bylaws, or rules. Authorizes an association to impose a reasonable charge that covers the costs of labor and material for producing records for inspection or copying any records provided to the lot owner. Mandates that the charge may not be more than the estimated cost of production or reproduction of the records.

Amends GS 47F-3-118(c) to provide that if an association fails to provide a lot owner with records requested under this section, the lot owner may obtain relief under GS 55A-16-04 (was, entitled the lot owner to receive $10 for each day that access to the records is denied).

Makes this act effective July 1, 2016 (was, effective when the act becomes law).

S 238 (2015-2016) STALKING BY GPS/CRIMINAL OFFENSE. Filed Mar 10 2015, AN ACT TO PROVIDE THAT A PERSON COMMITS THE OFFENSE OF CYBERSTALKING IF THE PERSON KNOWINGLY INSTALLS OR PLACES A TRACKING DEVICE WITHOUT CONSENT AND USES THE DEVICE TO TRACK THE LOCATION OF AN INDIVIDUAL.

House committee substitute makes the following changes to the 3rd edition.

Amends the long title.

Amends GS 14-196.3, concerning the exemptions from the prohibition on knowingly installing or placing an electronic tracking device without consent to track a person's location, by providing that owners or lessees (previously, owners or lessors were exempt) of any vehicle utilizing such a tracking device are exempt, unless the owner or lessee is subject to a domestic violence protective order or a court order prohibiting specified conduct. Amends the exemption for a legally authorized representative of a disabled adult as defined in GS 108A-101(d) by now providing that legal guardians for a disabled adult, as defined in GS 108A-101(d) and legally authorized individuals or organizations designated to provide protective services as specified in GS 108A-105(c) are exempt from the prohibition when the tracking device is utilized to track the location of the disabled adult. Amends the exemption concerning motor vehicle creditors, providing that creditors or other secured parties, lessors, and any assignees or successors in interest under a retail installment agreement or retail lease are exempt from the prohibition when the use of a tracking device is agreed to by the express written consent of the purchaser, borrower, or lessee of the vehicle (previously, exempted a creditor of a motor vehicle dealer or seller when tracking the vehicle in connection with the sale, loan, or lease of the vehicle with the written consent of the vehicle purchaser, borrower, or lessee). Adds a new exemption for motor vehicle manufacturers and their subsidiary and affiliates when installing or using a tracking device in conjunction with a telematics service program, provided the customer consents to the service. 

Amends Rule 803(6) of the Rules of Evidence found in GS Chapter 8C to allow a custodian of business records to authenticate such records by way of affidavit or by document under seal under Rule 902 of the Rules of Evidence made by the custodian in lieu of in-person testimony. Further provides that the authentication of evidence by affidavit must be confined to the records of non-parties and requires advance notice of intent to offer the evidence with authorization by affidavit. Effective October 1, 2015.
