House committee substitute to the 3rd edition makes the following changes.
Changes the act’s titles.
Removes the increase on the sales tax on boats.
Adds the following.
Requires the Wildlife Resources Commission (Commission) to issue one resident Elk Permit by raffle and one Elk Permit by auction, for the 2026 hunting season. Requires any elk taken to be reported and presented to Commission staff. Prohibits transferring, selling, or reassigning the permits. Sets out the procedures for the raffle, including setting the ticket price at $20 or a maximum of 30 raffle tickets for $500. Allows the Commission to retain from the proceeds the actual costs of administering the raffle, up to $25,000, and requires the remaining funds to be deposited in the Wildlife Resources Fund for the conservation and management of elk. Requires the Commission to select one nonprofit wildlife conservation organization that has been involved in the reintroduction of elk into North Carolina to conduct the auction for one Elk Permit. Allows the organization to retain up to 25% of the auction proceeds and for the remaining proceeds to be deposited in the Wildlife Resources Fund for the conservation and management of elk. Allows the Commission, for hunting seasons after the 2026 season, based on its evaluation of its elk management goals, to raffle off one or more Elk Permits and select one nonprofit wildlife conservation organization to conduct an auction for one Elk Permit. Requires for those future hunting seasons that the Commission: (1) conduct an Elk Permit raffle for one or more Elk Permits if it conducts an Elk Permit auction and (2) reserve 50% of all Elk Permits made available via raffle for NC residents. States the NCGA’s intent that receipts generated by the activities authorized by this act supplement, rather than replace, other funds budgeted for management of elk. Requires the Commission to report by March 1, 2027, and every year thereafter in which the Commission conducts Elk Permit raffles and auctions, to the specified NCGA committees and division on the effectiveness of the auction and raffle programs, including the amount of money raised, recommendations as to whether to continue the programs, and, if so, legislative recommendations to improve the programs.
Amends GS 113-129(7c) by adding elk to the definition of game animals.
Amends GS 113-291.8 by requiring both elk and deer hunters to wear hunter orange in a manner that is visible from all directions. Removes outdated language.

Amends GS 105-164.4 by increasing the sales tax on boats, including accessories attached to the boat when it is delivered to the purchaser, from 3% to 3.25%; maintains the cap of $1,500 per article. Enacts new GS 105-164.44N requiring that 6% of the proceeds of that sales tax on boats be transferred within 75 days after the end of the fiscal year to the Wildlife Resources Fund. Applies to sales occurring on or after October 1, 2025. Makes conforming changes to the act's long title.

Amends GS 20-79.4 by adding that the Wildlife Resources Commission plate is not subject to GS 20-79.3A (Requirements to establish a special registration plate) or GS 20-79.8 (Expiration of special registration plate authorization).
Amends GS 20-79.7 by requiring that $20 of the $30 fee for the Lifetime Conservationist plate be transferred quarterly to the Wildlife Resources Fund.
Adds a provision allowing the Revisor of Statutes to alphabetize, number, and renumber the special registration plates.
Makes all of the changes in Section 2, impacting license plates, effective July 1, 2025, instead of when the act becomes law.

Amends GS 143-254.5 making confidential records that contain site-specific information regarding rare species of plants or animal or the location of sensitive habitats when the Executive Director of the North Carolina Wildlife Resources Commission finds that disclosure will create a risk of harm, theft, or destruction of the species or habitats or the area where they are located. Excludes requests for release of records by the owner of land where the species, habitats, or areas are located.
Amends GS 20-63 allowing the issuance of a Wildlife Resources license plate. Amend GS 20-79.4 to allow the issuance of a Lifetime Conservationist special license plate. Amends the Wildlife Resources special license plate by adding the phrase that must be included. Amends GS 2081.12 requiring transferring the specified money from the sale of the Lifetime Conservationist plates to the Wildlife Resources Fund. Amends the requirements for the Wildlife Resources plate to no longer include the specified number of applications and plate description.
Amends GS 75A-7 providing that water vessel does not have to be numbered if a vessel that is required to be awarded an identification number under federal law or another state and that number has been awarded, provided that the vessel has not been within this State for a period in excess of 60 (was, 90) consecutive days. Makes conforming changes to GS 75A-5. Amends GS 75A-6.1 requiring vessels operated on waters of this State to comply with navigation rules (was limited to those vessels required to obtain an identification number, that had a valid marine document). Amends GS 7A-13.3 requiring personal watercraft that is equipped by the manufacturer with an engine cut-off switch, to require the switch to be used while the vessel is operating on a plane or above displacement speed (was, those equipped with a lanyard type of engine cut-off switch had to have the lanyard securely attached in the specified manner at all times when the watercraft is being operated in a way to turn off the engine if the operator dismounts while the watercraft is in operation). Refers to navigation rules instead of rules of the road. Effective October 1, 2025, and specifies that prosecutions for offenses committed before that date are not abated or affected by this act and the statutes that would be applicable but for this act remain applicable to those prosecutions.
