House committee substitute to the 2nd edition makes the following changes. Changes the due date of the Department of Agriculture and Consumer Services report from February 1, 2020, to February 1, 2021.
Enacts new GS 146-30.2, requiring that net proceeds from the sale of State-owned real property located outside of the State Capitol area (as defined in the act) be calculated in accordance with this statute. Defines net proceeds as the gross amount received from the sale of State-owned real property located outside of the State Capitol area, less: (1) any expenses incurred incident to that sale as may be allowed under rules and regulations adopted by the Governor and approved by the Council of State; (2) a service charge to be paid into the State Land Fund, unless such service charge is prohibited by GS 146-30 (Application of net proceeds); (3) an amount equal to 12.5% of the gross amount received to be paid into the Clean Water Management Trust Fund; and (4) an amount equal to 12.5% of the gross amount received to be paid into the Parks and Recreation Trust Fund. Requires net proceeds to be handled in accordance with the provisions of GS 146-30. Excludes from this statute proceeds derived from the sale of land or property originally purchased with, under the supervision and control of, or maintained with funds from the State Highway Fund or proceeds derived from the disposition of residue property.
Makes conforming changes to the act's long title.
