Short and Long Title Changes

House committee substitute to the 2nd edition makes changes to the short and long titles. The original titles are as follows:

LANDOWNERS/LESSEES MAY TRAP COYOTES.

A BILL TO BE ENTITLED AN ACT TO DIRECT THE WILDLIFE RESOURCES COMMISSION TO ENACT RULES FOR THE YEAR ROUND TRAPPING OF COYOTES AND ESTABLISH A PERMIT FOR THE YEAR ROUND TRAPPING OF COYOTES BY LANDOWNERS AND LESSEES ON THEIR LAND; TO PROVIDE THE WILDLIFE RESOURCES COMMISSION WITH AUTHORITY TO ESTABLISH TRAPPING SEASONS IN THE EXERCISE OF ITS TEMPORARY RULE-MAKING AUTHORITY; TO INCREASE THE PENALTY FOR UNLAWFULLY SELLING, POSSESSING FOR SALE, BUYING A FOX, OR TAKING ANY FOX BY UNLAWFUL TRAPPING OR WITH THE AID OF ANY ELECTRONIC CALLING DEVICE; AND TO CREATE PENALTIES FOR REMOVING A LIVE COYOTE FROM A TRAP AND TRANSPORTING A LIVE COYOTE AFTER REMOVAL.

    The House committee substitute to the 2nd edition deletes the contents of the 2nd edition and replaces it with: AN ACT TO ALLOW MONTGOMERY COUNTY EMPLOYEES AND THE DEPENDENTS OF EMPLOYEES TO PARTICIPATE IN THE STATE HEALTH PLAN FOR TEACHERS AND STATE EMPLOYEES.

    Amends GS 135-48.47(a) to add employees of Montgomery County and those employees' dependents to those who are eligible to participate in the State Health Plan.

    Senate committee substitute makes the following changes to the 1st edition.

    Changes long title.

    Deletes the provisions of the previous edition in its entirety and makes the following proposed changes.

    Directs the Wildlife Resources Commisison to adopt rules allowing a landowner or lessee to trap coyotes on that person's owned or leased property outside of trapping seasons.

    Enacts new GS 113-274(c)(1d) requiring the Wildlife Resources Commission to issue out-of-season coyote trapping permits as provided above. Imposes some restrictions on the disposition of trapped coyotes and specifies certain information that must be included on the permit.

    Amends GS 150B-21.1 to authorize the Wildlife Resources Commission to adopt temporary rules to establish trapping seasons.

    Amends GS 113-294(j), which establishes the penalty for unlawfully selling, possessing for sale, buying, or taking a fox. Such violations are punishable as Class 2 misdemeanors. New language provides that violations are punishable by a fine of not less than $500 in addition to any other punishment prescribed by law. Clarifies that each act specified constitutes a separate offense.

    Adds new GS 113-294(t) to establish the same penalties as above for unlawfully removing any coyote from a trap while the coyote is alive or transporting the live coyote after its removal.

    Effective October 1, 2013.

    Adds new section to GS 113-291.2 allowing landowners and their lessees to trap coyotes any time of year to control the coyote population, consistent with the trapping requirements in GS 113-291.6 (related to permits and types of permissible traps).
