H 192 (2015-2016) COMPLIANCE COURT COSTS. Filed Mar 10 2015, AN ACT TO ESTABLISH COMPLIANCE COURT COSTS AND TO DIRECT THE ADMINISTRATIVE OFFICE OF THE COURTS TO ESTABLISH A SYSTEM FOR THE ELECTRONIC PAYMENT OF COMPLIANCE COURT COSTS.

House amendment #1 makes the following changes to the 3rd edition.

Amends subsection (a) of new GS 7A-304.1, effective July 1, 2016, which permits a person charged for any of the offenses indicated in subsection (b) to elect to provide proof of compliance to the district attorney before or on the scheduled court appearance date. Provides that the district attorney may agree to a voluntary dismissal of the case in exchange for the person's signed waiver of appearance and payment of court costs in the amount of $50 per citation (was, $50) if paid in person to the clerk of court, or $10 per citation (was, $10) if paid through the electronic payment system established by the Administrative Office of the Courts (AOC).

H 424 (2015-2016) PROHIBIT UNLAWFUL CUSTODY TRANSFER OF CHILD (NEW). Filed Mar 31 2015, AN ACT TO PROHIBIT THE UNLAWFUL TRANSFER OF CUSTODY OF A MINOR CHILD AND TO MAKE CONFORMING STATUTORY CHANGES.

House amendment #1 makes the following changes to the 1st edition.

Deletes Section 8 of this act, which appropriated $56,042 from the General Fund to the Department of Health and Human Services (DHHS) for fiscal year 2015-16. Also deletes Section 9 of this act, which appropriated $1,328,499 from the General Fund to DHHS for the 2016-17 fiscal year. Renumbers the Sections of this act accordingly, providing in Section 8, as amended, that the provisions of this act become effective August 1, 2016.

H 495 (2015-2016) OSHR MODERNIZATION/TECHNICAL CHANGES. Filed Apr 1 2015, AN ACT ENHANCING THE EFFECTIVENESS AND EFFICIENCY OF STATE GOVERNMENT BY MODERNIZING THE STATE'S SYSTEM OF HUMAN RESOURCES MANAGEMENT.

Senate amendments make the following changes to the 5th edition.

Amendment #1

Amends GS 126-14.2 to require that state departments, agencies, and institutions select the most qualified persons from a pool of qualified persons for state government employment (was, select a candidate from the pool of qualified persons). Makes conforming changes.

Amendment #2

Deletes changes made to GS 126-23(a), which deleted a requirement that the age of state employees be kept in personnel records.

Senate committee substitute makes the following change to the 1st edition.

Changes the effective date of this act to January 1, 2016 (was, July 1, 2015).

H 337 (2015-2016) TOWN OF CARY/RELEASE UNNEEDED EASEMENTS. Filed Mar 24 2015, AN ACT TO AMEND THE CHARTER OF THE TOWN OF CARY TO AUTHORIZE THE TOWN COUNCIL TO DELEGATE TO THE CITY MANAGER THE AUTHORITY TO DISPOSE OF EASEMENTS THAT ARE NO LONGER NEEDED BY THE TOWN AND TO AUTHORIZE THE RALEIGH CITY COUNCIL TO DELEGATE TO THE CITY MANAGER THE AUTHORITY TO DISPOSE OF EASEMENTS THAT ARE NO LONGER NEEDED BY THE CITY.

Senate committee substitute makes the following changes to the 1st edition.

Adds a Section 1.5 to this act to provide that regardless of the provisions of Article 12 (Sale and disposition of property) of GS Chapter 160A, the Raleigh City Council may authorize the city manager or an assistant city manager to dispose of water or sewer easements or similar interests in real propertywithout obtaining city council approval (1) if they are part of an exchange for other water and sewer easements or similar interests in property or (2) no longer needed by the city. Specifies that this provision applies only to the City of Raleigh.

Makes conforming changes to the bill title to reflect the changes in bill content.

H 415 (2015-2016) FONTANA DAM/ESTABLISH ELECTRIC POWER BOARD. Filed Mar 31 2015, AN ACT TO AMEND THE CHARTER OF THE TOWN OF FONTANA DAM TO AUTHORIZE THE TOWN COUNCIL TO ESTABLISH AN ELECTRIC POWER BOARD TO MANAGE AND CONTROL THE TOWN'S ELECTRIC PUBLIC ENTERPRISE SERVICE.

Senate committee substitute makes the following changes to the 1st edition.

Amends the composition of the five-member Town of Fontana Dam Electric Power Board, which is established in this act. Clarifies that two of the members must be residents of the Town of Fontana Dam and requires that there be three at-large members, who may reside outside of the Town but must be residents of the state of North Carolina (was, required two members to be Town residents and all members to be residents of Graham County).

S 50 (2015-2016) Wilson County Occupancy Tax Modification. Filed Feb 9 2015, AN ACT TO INCREASE THE AUTHORIZATION FOR WILSON COUNTY TO LEVY AN OCCUPANCY TAX.

Senate committee substitute makes the following changes to the 2nd edition.

Amends provisions concerning the distribution and use of the additional occupancy tax revenue, providing that one-third of net proceeds are to be distributed to the Wilson County Tourism Development Authority (Authority) for the overall promotion of travel and tourism in Wilson County and two-thirds of the net proceeds to the City of Wilson, on a quarterly basis, for use for tourism-related expenditures in Wilson County that have been specifically approved in advance by the Wilson County Tourism Development Authority (previously, required the remittance of proceeds on a monthly basis, requiring that one-third of the proceeds of the additional occupancy tax be remitted monthly to the Authority with the remaining two-thirds remitted to the City of Wilson. Required seven-eighths of proceeds remitted to the Authority to be used for travel and tourism promotion. Required the City to use at least one-fourth of the funds remitted to it to promote travel and tourism in the County and the remainder for tourism-related expenditures in the County that have been specifically approved in advance by the Authority.)
