    House committee substitute makes the following changes to 3rd edition. Amends SL 2018-5, Section 35.21, as amended by Section 8.2(a) of Senate Bill 335, 2017 Regular Session, if it becomes law, to provide 4% increase to salary of all State employees in adult correctional facilities. Appropriates $4,813,184 for the 2018-19 fiscal year from the General Fund to the Department of Public Safety to support these increases. Directs the Division to establish minimum salaries for Correctional Officers. 

    Amends title regarding highway. Amends SL 2016-94, Section 35.28(a), changing which portions of Interstate 40 are named the "Senator Wendell Holmes Murphy, Sr. Freeway."

    Amends title to include duties of law enforcement pertaining to involuntary commitment. Amends GS 112C-263(a) and GS 112C-283(a) if Senate Bill 630 becomes law to require law enforcement to bring a person being involuntarily committed to a facility or location identified in the plan that has an available commitment examiner, unless the respondent appears to be suffering from a medical emergency, in which case the officer must seek medical attention for the respondent. The transporter must bring the respondent to an available site for a first examination when possible. Provides direction for when a commitment examiner is not available or a plan has not been adopted. Effective October 1, 2019.

    Amends SL 2018-5, Section 38.9(b), which amends GS 105-395.1 concerning due date of taxes when deadline is on a holiday or weekend, making section effective July 1, 2017, instead of July 1, 2018.

Amends GS 90-113.73 by moving the provision allowing a veterinarian to submit prescription information by paper or other means, provided that all information required of electronically submitted data is submitted into its own subsection (g) and sets it to expire on October 1, 2019. Makes GS 90-113.73 effective January 1, 2019.

    Senate Committee Substitute amends 1st edition as follows:

    Rewrites the bill title to include language relating to additional provisions added by committee substitute.

    Adds new bill section amending GS 90-113.74C to exempt licensed veterinarians from the requirement that practitioners review the controlled substance reporting system prior to prescribing a controlled substance to a patient.

    Adds new bill section amending GS 90-106(a1) to clarify that, beginning January 1, 2020, a licensed veterinarian may prescribe targeted controlled substances with written, oral, or facsimile prescriptions.

    Adds new bill section amending GS 90-113.73 to include a licensed veterinarian within the definition of a dispenser for purposes of reporting controlled substance prescriptions when the veterinarian is dispensing Schedule II through V controlled substances.  Allows veterinarians to report subscription information by paper form or other means, and requires the Commission for Mental Health, Developmental Disabilities, and Substance Abuse Services to adopt rules requiring the information to be reported.

    Adds new bill section amending GS 90-106 exempting controlled substances administered in an emergency facility, veterinarian hospital, or animal hospital from the limitations on prescribing controlled substances for acute pain.  Exempts from the definition of acute pain that being treated as part of care provided by a veterinarian, and includes within the definition of surgical procedure procedures performed on animals by licensed veterinarians.

    Adds new bill sections mandating that the Veterinary Medical Board require continuing education on controlled substance abuse as a condition of license renewal for veterinarians who prescribe controlled substances, and adding a representative of the Veterinary Medical Board to the Prescription Drug Abuse Advisory Committee.


  • Summary date: May 24 2018 - View Summary

    Amends GS 153A-225 to provide that if a person in the custody of a local confinement facility dies, the medical examiner and the coroner must be notified immediately, regardless of the physical location of the prisoner at the time of death.

    Requires the Department of Health and Human Services (DHHS) to study how to improve prisoner health screening with the goal of improving the determination that a prisoner in a local confinement facility has been prescribed life-saving medication and a process to ensure timely administration of those medications. Requires DHHS to report to the Joint Legislative Oversight Committee on Health and Human Services on or before November 1, 2018.

    Requires DHHS and the Government Data Analytics Center to collaborate with local government and local law enforcement organizations to explore participating in the North Carolina Health Information Exchange Network (HIE Network) to facilitate electronic transmission of  health information for prisoners in the custody of local confinement facilities. Also requires the Department of Public Safety, DHHS, and the Government Data Analytics Center to work together to ensure that the State’s prison facilities are full participants in the HIE Network. Requires an interim report on or before October 1, 2018, to the Joint Legislative Oversight Committee and a final report on or before October 1, 2019, on the these required actions.
