    Senate committee substitute to the 2nd edition makes the following changes.

    Amends the revisions to the terms of office for members of the Board of Trustees of Southwestern Community College to require that for the one term elected by the Macon County Board of Commissioners, expiring June 30, 2024, that the Jackson County Board of Commission (was, Macon County Board) elect one trustee to a term of four years (was, appoint a trustee to a term of one year); specifies that the term expires June 30, 2028. Removes the provision regarding the term elected by the Macon County Board of Commissioners before the act's effective date that expires June 30, 2025. Adds the following: (1) for the additional term to be elected by the Jackson County Board of Commissioners, the Board must elect one trustee to a term of one year, beginning July 1, 2024, so the term expires June 30, 2025 and (2) for the one term elected by the Swain Board of Education expiring June 30, 2025, the NCGA, upon the recommendation of the Speaker of the House, must appoint one trustee to a term of two years, beginning July 1, 2025, so that the term expires June 30, 2027.

    Amends the revisions to the terms of office for members of the Board of Trustees of Tri-County Community College by deleting the provision related to: (1) the two additional terms to be elected by the Clay County Board of Commissioners and (2) the provision for the additional term to be elected by the Cherokee County Board of Commissioners. Adds the following. Requires for the terms elected by the Clay County Board of Commissioners that expire (1) June 30, 2027, the Cherokee County Board of Commissions must elect one trustee to the term beginning July 1, 2027, and every four years thereafter; (2) June 30, 2024, the NCGA, upon the recommendation of the Speaker of the House, must appoint a trustee to the term beginning July 1, 2024, and every four years thereafter; and (3) June 30, 2026, the Clay County Board of Commissioners must elect one trustee to a term of one year, beginning July 1, 2026, and expiring June 30, 2027. Requires that for the remaining three terms to be appointed by the NCGA upon recommendation of the Speaker of the House, the terms are to be staggered as specified, with terms beginning in 2025, 2026, and 2027.

    Senate amendment to the 1st edition makes the following changes.

    Notwithstanding GS 115D-13 (pertaining to terms of office of the trustees of the boards of trustees for the State’s community colleges) as amended by Section 6.10(o) of SL 2023-134, adds the following revision to the terms of office for the Board of Trustees of Southwestern Community College. For the term elected by the Macon County Board of Commissioners prior to the act becoming law and whose term expires on June 30, 2025, requires the Jackson County Board of Commissioners to elect one trustee to a four-year term starting on July 1, 2025, and that the term expires on June 30, 2029.

    Notwithstanding GS 115D-13 (pertaining to terms of office of the trustees of the boards of trustees for the State’s community colleges) as amended by Section 6.10(o) of SL 2023-134, revises the terms of office for the following trustees as follows:

    (1) Asheville-Buncombe Technical Community College:

    • Of the term elected by the Madison County Board of Commissioners that expires June 30, 2025, requires that board elect one trustee to a one-year term, beginning July 1, 2025, so that the term expires June 30, 2026.

    (2)  Blue Ridge Community College       

    • Of the two terms elected by the Henderson County Board of Commissioners that expire June 30, 2025, requires that board elect one trustee to a three-year term, beginning July 1, 2025, so that the term expires June 30, 2028.
    • Of the two terms elected by the Henderson County Board of Commissioners that expire June 30, 2027, requires that board elect one trustee to a three-year term, beginning July 1, 2027, so that the term expires June 30, 2030.
    • Of the two terms elected by the Henderson County Board of Education that expire June 30, 2025, requires the General Assembly, upon the recommendation of the Speaker of the House of Representatives, to appoint one trustee to a term of three years, beginning July 1, 2025, so that the term expires June 30, 2028.
    • Of the two terms elected by the Henderson County Board of Education that expire June 30, 2027, requires the General Assembly, upon the recommendation of the Speaker of the House of Representatives, to appoint one trustee to a term of three years, beginning July 1, 2027, so that the term expires June 30, 2030.

    (3) Davidson-Davie Community College

    • For the one term elected by the Davidson County Board of Education that expires June 30, 2024, requires the General Assembly, upon the recommendation of the Speaker of the House of Representatives, to appoint one trustee to a term of one year, beginning July 1, 2024, so that the term expires June 30, 2025.
    • Of the two terms elected by the Davie County Board of Commissioners that expire June 30, 2026, requires that board elect one trustee to a two-year term, beginning July 1, 2026, so that the term expires June 30, 2028.

    (4) Southwestern Community College 

    • For the one term elected by the Macon County Board of Commissioners that expire June 30, 2024, requires that board appoint one trustee to a one-year term, beginning July 1, 2024, so that the term expires June 30, 2025.
    • Of the two terms elected by the Jackson County Board of Commissioners that expire June 30, 2026, requires that board elect one trustee to a one-year term, beginning July 1, 2026, so that the term expires June 30, 2027.
    • Of the two terms to be elected by the Swain County Board of Commissioners, specifies that board elect one trustee to a two-year term, beginning July 1, 2024, so that the term expires June 30, 2026. 

    (5) Tri-County Community College 

    • Of the two terms elected by the Clay County Board of Commissioners, requires that board to elect (i) one trustee to a one-year term, beginning July 1, 2024, so that the term expires June 30, 2025, and (ii) elect the other trustee to a three-year term beginning July 1, 2024, so that the term expires June 30, 2027. 
    • Of the two terms to be elected by the Graham County Board of Commissioners, requires that board elect one trustee to a two-year term, beginning July 1, 2024, so that the term expires June 30, 2026.
    • For the additional term to be elected by the Cherokee County Board of Commissioners, requires that board elect one trustee to a three-year term, beginning July 1, 2024, so that the term expires June 30, 2027. 

    In line with the amendments to GS 115D-12, GS 115D-13, and SL 2023-134, specifies that for Board of Trustees seats where a specific term length is not provided or revised: (1) the term of current seats will expire at the end of its previously appointed or elected terms and (2) the initial term of additional seats to be elected or appointed pursuant to Section 6.10 of SL 2023-134 will begin on July 1, 2024, and expire on June 30, 2028, so to maintain staggered terms.

    Specifies that the successors to the trustees elected or appointed to terms of less than four years or whose terms were otherwise revised above will be elected or appointed, following the expiration of their terms, to four-year terms starting on July 1 and every four years thereafter.
