Senate amendment to the 1st edition makes the following changes. Makes conforming changes to the act’s long title.
Section 2.
Removes definition of development approval. Tasks the Brunswick County Board of Commissioners (Board) with making the final decision on all preliminary subdivision plats that would result in the division of the original lot into twenty-five or more lots.
Section 3.
Tasks the Board with making the final decision on all special use permits.
Section 4.
Directs Brunswick County to require a traffic impact analysis, to be submitted in conjunction with an application for the four types of listed projects, including a special use permit, and a preliminary subdivision plat that would result in the division of the original lot into twenty-five or more lots. Provides for presentation of the traffic impact analysis to the Board in open session before voting on the project.
Section 5.
Requires the Board to make final decisions on the listed zoning matters, including zoning ordinance and map amendments, preliminary subdivision plats, variances, and special use permits, by a recorded vote taken in open session. Specifies that the official record of the meeting must reflect how each member voted on each matter before the Board.
Section 6.
Applies only to the use and development of land and structures located in Brunswick County outside of the land use and zoning jurisdiction of municipalities located in Brunswick County.
Section 7.
Clarifies that the act applies to applications on or after the act becomes law.

Repeals SL 2019-99, which amended GS 153A-343 as it applies to Brunswick County, to allow the board of commissioners to, by ordinance, delegate to the planning board the authority to conduct required public hearings and make the final decision on zoning map amendment proposals, with a right of appeal from the planning board's final decision to the board of commissioners.
Mandates the Brunswick County Board of Commissioners to make final decisions on all development approvals in the county and directs that meeting records where approvals are decided must include the roll call vote on each approval. Defines development approval by statutory cross-reference.
