Bill summary
Amends GS 90-22, concerning the creation of the North Carolina State Board of Dental Examiners (Board) by adding that it is a matter of public interest that State official possess and exercise power to review the acts of private parties and disapprove those that do not accord with State policy. Specifies that the potential for State supervision is not an adequate substitute for a decision by the State. Amends the membership of the Board by requiring members who are dentists to have been actively engaged in dentistry in NC for at least five years immediately preceding their appointment; requires the dental hygienist to have been actively engaged in dentistry in NC for at least five years immediately preceding their appointment; and increases the number of public members to two and requires that they both not have any financial interest in the provision of dental service, never have been licensed to practice dentistry or dental hygiene, never has been registered, certified, or licensed by an occupational licensing agency in the health care field, not be employed by or participate in the management of a business entity or other organization receiving funds from the Board, not use or receive a substantial amount of tangible goods, services, or money from the Board, not be affiliated with or employed by the Board or by any member on the Board, and not be a spouse of a dentist or dental hygienist. Specifies that members serve three-year terms and allow reappointment for one additional consecutive term; prohibits serving more than two three-year terms. Removes provision concerning the elections of different types of members and for the filling of vacancies. Repeals provisions related to nomination and election of members by licensed dentists, per diem compensation and expenses and the expenditures of funds, and appointment of individuals to assist with the elections. Makes additional organizational, clarifying, and technical changes.
Enacts new GS 90-22A governing the appointment of Board members, with members appointed by the Governor and the NCGA by recommendation of the Speaker of the House and President Pro Tempore of the Senate. Provides for filling vacancies. Allows the appointing authorities to remove their board members for neglect of duty, incompetence, or unprofessional conduct. Members receive per diem and travel and subsistence reimbursements. Sets out requirements for Board officers, who are elected to one-year terms. Amends GS 90-43 by removing the provision that paid Board members up to $100 for each day they are engaged in their duties.
Requires current Board members to finish their current terms and sets out provisions governing the appointment procedures and timing for the new members.
Requires the Board to adopt temporary rules to implement the act and permanent rules to replace those temporary rules.
