House committee substitute makes the following changes to the 2nd edition:
Makes changes to the definitions in subsection (a) of GS 130A-283, as follows. Modifies definition of body art by changing "artistic" to "aesthetic," adding that the art is applied to the human body, and deleting reference to subdermal implants. Modifies definition of body piercing by removing reference to the skin "of a person" and making other grammatical changes. Modifies the definition of branding by changing "on human tissue" to "on the skin." Modifies the definition of scarification by redefining that term as "the creation of a permanent mark on the skin by scratching, etching, or cutting." Deletes the definition of subdermal implanting.
Modifies the limitations in subsection (e) by adding "insert an object under the skin" to the list of prohibited activities and making technical formatting changes to that subsection.

Amends GS 90A-51 to add body art establishment sanitation to those environmental health service areas that are under the definition of environmental health practice for the purposes of GS Chapter 90A, Article 4, Registrations of Environmental Health Specialists.

Amends GS 130A283. Defines a number of terms, including body art (procedures conducted for artistic purposes that include body piercing, branding, scarification, subdermal implants, and tattooing as these terms are also newly defined). Redefines tattooing to exclude the production of scars (now defined as scarification ). Applies existing regulations of tattooing to all forms of body art. Creates a new Class A1 misdemeanor consisting of any violation of GS 130A283. Adds text clarifying that GS 130A283 does not authorize licensed body artists to treat injuries or otherwise practice medicine. Makes conforming changes.
Amends GS 130A29(c) to apply the existing regulation of tattooing to all forms of body art.
Amends GS 130A39(g) to make a conforming change.
Effective January 1, 2018. Permits for tattooing issued before that date, but not yet expired, remain valid until expiration.
