H 1021 (2015-2016) AMEND SEX OFFENDER CERTAIN PREMISES (NEW). Filed May 3 2016, AN ACT TO AMEND THE LAW REGARDING SEX OFFENDERS ON CERTAIN PREMISES TO ADDRESS THE RULING IN DOE V. COOPER.

House amendment makes the following change to the 2nd edition.

Amends GS 15A-1460 to enact new subsection (3a) to define the term formal inquiry to mean the stage of an investigation when the Commission has entered into a signed agreement with the original claimant and the Commission has made efforts to notify the victim, as the term applies to Article 92 of GS Chapter 15A (provisions governing the North Carolina Innocence Inquiry Commission).

Changes the effective date of the act to August 1, 2016 (was, December 1, 2016), and provides that the act applies to any claim filed on or after that date and any claim pending on that date (was, applies to claims of factual innocence made on or after the effective date). Also provides that nothing in the act abates a claim filed prior to the effective date or invalidates any action taken on a claim prior to the effective date.

H 1009 (2015-2016) RETIRED SERVICE ANIMALS/CERTAIN LOCAL GOV'TS (NEW). Filed Apr 28 2016, AN ACT TO ALLOW THE TOWNS OF APEX, CARY, GARNER, KNIGHTDALE, MORRISVILLE, ROLESVILLE,WAKE FOREST, AND ZEBULON AND THE COUNTIES OF GUILFORD, MOORE, RANDOLPH, AND SURRY, AND ALL OF THE MUNICIPALITIES IN THOSE COUNTIES TO TRANSFER RETIRED SERVICE ANIMALS USED BY THE POLICE DEPARTMENT OR ANY OTHER TOWN AGENCY TO THE POLICE OFFICER OR EMPLOYEE WHO HAD NORMAL CUSTODY AND CONTROL OF THE ANIMAL.

House amendment deletes the provisions of the 1st edition and instead provides the following.

Enacts new GS 160A-279.5, concerning the disposition of animals.

Establishes that, upon the governing body determining any horse, dog, or other animal owned by the local government is no longer fit or needed for public service, the governing body may transfer ownership of the animal at a price determined by the governing body and upon any other terms and conditions as it deems appropriate.

Provides that the animal may be transferred to any of the following individuals, if that individual agrees to accept ownership, care, and custody of the animal: (1) the officer or employee who had normal custody and control of the animal during the animal's public service to the local government; (2) a surviving spouse, or in the event such officer or employee dies unsurvived by a spouse, surviving children of the officer or employee killed in the line of duty who had normal custody and control of the animal during the animal's public service to the local government; or (3) an organization or program dedicated to the assistance or support of animals retired from public service.

Establishes that the statute applies only to the Towns of Apex, Cary, Garner, Knightdale, Wake Forest, and Zebulon.

H 1126 (2015-2016) RED LIGHT CAMERAS/CITY OF GREENVILLE. Filed May 16 2016, AN ACT TO MAKE CHANGES TO THE LAW GOVERNING RED LIGHT CAMERAS IN THE CITY OF GREENVILLE.

Amends Section 2 of SL 1997-216, as amended, deleting Greenville from the list of cities to which the session law authorizing local governments to use photo images as evidence of a traffic violation applies. 

Amends Section 3 of SL 2007-341 to add Greenville to the list of cities to which Section 1 of the session law applies. Section 1 of the session law is comprised of GS 160A-300.1, Use of traffic control photographic systems.

Amends GS 160A-300.1(c) to allow Greenville to enter into a contract for the lease, lease-purchase, or purchase of a traffic control photographic system (red light system). Allows entering into only one contract, for no more than 60 months. After the contract period expires, the system must either becomes Greenville's property or be removed and returned to the contractor.

Amends GS 160A-300.1(c)(2), as amended, to increase the penalty for violations detected by a red light system from $75 to $100. Effective October 1, 2016, and applies to violations committed on or after that date.

Provides that Greenville and the Pitt County Board of Education can enter into an interlocal agreement to effectuate the purpose and intent of the provisions of GS 160A-300.1, concerning the use of red light systems, and the provisions of this act. Allows such an agreement to include cost-sharing and reimbursement provisions that are freely and voluntarily agreed to.

Provides that this act applies only to the City of Greenville and the Pitt County Board of Education.

Unless otherwise noted, act is effective July 1, 2016.
