    Senate amendments make the following changes to the 2nd edition.

    Amendment #1

    Encourages the designated Protection and Advocacy Agency (Agency) to annually hold six meetings with the public throughout the state to share the Agency's findings in the reports that are required in this act.

    No longer requires the Agency to report to the NCGA by December 1, 2023, on the Agency’s outcomes in advocating for students with disabilities in elementary and secondary education. 

    Amendment #2

    Changes the act's effective date (was, when the act became law) so that it is now effective on the date that H 125 (NC Health & Human Services Workforce Act) becomes law. Provides that if H 125 has not become law by December 31, 2023, then this act expires on that date.

    House committee substitute to the 1st edition makes the following changes. Changes the reporting requirements of the designated Protection and Advocacy Agency (Agency) from a quarterly report of the actions the Agency has taken in its efforts to advocate for persons with disabilities to the specified joint NCGA agencies to the following:  (1) A report submitted twice a year of actions the Agency has taken in its efforts to advocate for persons with disabilities to the specified NCGA Committees; (2) a report submitted by December 1, 2023 to the specified NCGA Committees on the Agency’s measured successes in advocating for persons with disabilities, which shall contain specific examples of how the Agency reduced barriers to employment, enabled independent living, and increased postsecondary educational opportunities for persons with disabilities; and (3) another report submitted by December 1, 2023, to the specified NCGA committee on the Agency’s outcomes in advocating for students with disabilities in elementary and secondary education with the minimum requirements specified in the act.

    Includes whereas clauses. Requires the designated Protection and Advocacy Agency (Agency) to submit a quarterly report of the actions the Agency has taken in its efforts to advocate for persons with disabilities to the specified joint NCGA agencies. Encourages the NCGA to examine the activities of the Agency to determine the impact on current and future State budgets.  Clarifies that the act should not be construed to impact the Agency’s ability to perform work within its governing laws.
