    House committee substitute replaces the content of the 2nd edition with the following.

    Applicable to Rockingham Community College only, amends GS 115D-12 to modify the college's board of trustees to include two rather than four trustees elected by the board of education of the surrounding public school administrative area, four rather than six trustees elected by the Rockingham County board of commissioners, and four trustees appointed by the NCGA (was, by the Governor). Provides the procedure for legislative appointment of trustees, with the Speaker of the House of Representatives making recommendations for appointments for members to terms expiring 2023 and 2025, and the President Pro Tempore of the Senate making recommendations for appointments for members to terms expiring 2022 and 2024, with legislative appointments every four years thereafter, respectively. Requires vacancies for legislatively appointed members to be filled pursuant to GS 120-122. 

    Requires gubernatorially elected trustees to serve the remainder of their term, and sets forth the procedure for filling any vacancy occurring in a gubernatorially appointed seat, with recommendation to the Governor by either the Speaker or the President Pro Tempore, depending on the term expiration. Otherwise, requires appointment and filling vacancies pursuant to GS 115D-12, as amended.

    Adds Cabarrus County to the scope of the act. Limits the act's applicability to any time when the occupancy capacity of outdoor sporting events is limited to less than 50% by an emergency executive order, secretarial order, or directive related to the COVID-19 pandemic.

    Includes whereas clauses. Limits the act to Davidson, Davie, Forsyth, Johnston, Jones, Montgomery, Nash, Rowan, and Stanly counties.

    Allows all public and nonpublic high schools to limit the number of spectators at outdoor sporting events for the remainder of the scheduled 2020-21 school year, as follows. Defines spectator to exclude athletes, school employees, entertainers, and event support staff. Caps spectators at 50% capacity of an outdoor facility's approved occupancy capacity under the fire code, or no more than seven persons for every 1,000 feet for those without an approved occupancy capacity. Provides that for outdoor sporting facilities allowing spectators to bring their own seats, individuals sitting in their own seats do not count toward the limit on the number of spectators so long as those individuals maintain at least six feet of distance between themselves and anyone outside of their family. Requires high schools to comply with the requirements of the StrongSchoolsNC Public Health Toolkit as it existed on February 2, 2021, and the Interim Guidance for Administrators and Participants of Youth and Amateur Sports Programs as it existed on January 28, 2021, in allowing access to outdoor sporting facilities so long as the requirements are consistent with the act's provisions.  Does not prohibit a school's implementation of stricter access to outdoor sporting events at that school.
