    AN ACT TO ALLOW ENTITIES REGULATED UNDER PHASE II OF THE NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM PROGRAM TO UTILIZE THE DEPARTMENT OF TRANSPORTATION'S BEST MANAGEMENT PRACTICES TOOLBOX FOR LINEAR TRANSPORTATION PROJECTS. Enacted May 29, 2014. Effective January 1, 2012.

    Senate committee substitute deletes the 1st edition entirely and adds the following:

    Changes the bill's short and long titles in their entirety to reflect new bill language.

    Adds new subsection (b1) to Sec. 9 of S.L. 2006-246 (as amended by S.L. 2008-198) to authorize a permittee, delegated program, or regulated entity to use the stormwater best management practices (BMPs) of the NC Department of Transportation for linear transportation projects when complying with Phase II NPDES requirements.

    Act becomes effective retroactively to January 1, 2012.

    Amends Section 8 of SL 2006-246, as amended, to exclude public and private linear transportation projects from post-construction practices if the projects meet the Department of Transportation's best management practices outlined in the "Stormwater Best Management Practices Toolbox," to the extent the city determines is practicable. Applies to Winston-Salem only. Effective July 1, 2012.
