    Amends GS 153A-210.1(b) to extend the sunset for GS Chapter 153A, Article 9A, Special Assessments for Critical Infrastructure Needs, to July 1, 2019, only for projects authorized in GS 153A-210.2(a1) (was, extended for all).

    Amends GS 153A-210.2 to add that the provisions of (a1), concerning the special assessment for repairing the lake dam only apply to a privately owned dam formerly used for textile mill purposes, forming a lake between 225 and 325 acres in area. 

    Makes the act applicable statewide instead of just Richmond County.

    Makes conforming changes to the act's titles.

    House committee substitute makes the following changes to the 1st edition:

    Changes the short and long titles.

    Deletes the provisions of the previous edition in their entirety.

    Enacts new GS 153A-210.1(a1), which provides that the General Assembly finds that dam repair is a public purpose promoting flood control and public safety.

    Amends GS 153A-210.1(b) to extend the sunset for GS Chapter 153A, Article 9A, Special Assessments for Critical Infrastructure Needs, to July 1, 2019 (was, July 1, 2015).

    Enacts new GS 153A-210.2(a) to provide that the board of commissioners of a county may make special assessments, as provided in GS Chapter 153A, Article 9A, for the purpose of repairing the dam of that lake, against property that is contiguous to a lake and benefits from access to the same lake.

    This act applies only to Richmond County.

     


  • Summary date: May 14 2014 - View Summary

    Authorizes Richmond County to create a fee-supported dam repair district, by resolution, for properties contiguous to a lake with a dam that needs repairs.  Allows the county to impose an annual fee for dam repairs; fee must be established on or before July 1 of each year. Provides limitations on fees imposed, including that fees cannot exceed the cost of dam repairs and fees can only be imposed on owners of dwellings or parcels that could or do benefit from lake access.

    Directs the county to adopt procedures similar to those in GS Chapter 153A, Article 9, for special assessments.  Outlines procedures for the billing of fees and provides that fees collected must be deposited in a separate fund used only to pay for costs incurred for dam repairs.

    Allows the fee-supported district to be abolished when there is no longer a need for the fee-supported district.

    Applies only to Richmond County.
