    House committee substitute to the 1st edition makes the following changes.

    Amends GS 113A-54.1(a2) to require an applicant seeking approval for an erosion and sedimentation control plan that includes a retaining wall or other similar device requiring a structural foundation to provide written certification from the designer of the device that it is designed and installed in accordance with applicable codes and specifications (was, specified that the erosion and sedimentation control inspector must receive written certification from the designer that the device was designed in accordance with applicable codes and specifications). Directs the Sedimentation Control Commission to provide a copy of the plan approval, which includes the written certification, to the Chief Building Code Enforcement Officer of the local government responsible for inspection and approval of the device (was, directed the Department of Environment and Natural Resources to provide the copy of the plan approval). Provides that the provisions in this subsection only apply to applicants seeking plan approval for land-disturbing activity in jurisdictions that do not administer or enforce erosion and sedimentation control plans.

    Makes additional conforming changes. Amends the long title of this act.
