AN ACT TO AMEND THE CONSTITUTION OF NORTH CAROLINA TO SIMPLIFY THE MANAGEMENT OF PUBLIC PRIMARY AND SECONDARY EDUCATION BY PROVIDING FOR A SECRETARY OF EDUCATION TO REPLACE THE CURRENT SYSTEM OF A SUPERINTENDENT OF PUBLIC INSTRUCTION AND, STATE BOARD OF EDUCATION.

    Repeals Section 4 (State Board of Education) of Article IX of the NC Constitution. Amends Section 5 of Article IX to establish a Department of Education (Department) to supervise and administer the public school system and the education funds provided for its support. The head of the Department is to be appointed by the Governor, subject to confirmation by the General Assembly. Gives the General Assembly the power to fill temporary vacancies in the position. Makes conforming changes to Section 7 of Article III. The amendments are to be submitted to qualified voters at a statewide general election on November 4, 2014. If the amendments are approved, the amendments are effective January 1, 2017; the terms of members of the Board of Education that would expire between certification of the amendment and December 31, 2016, are extended until January 1, 2017; and no election for Superintendent of Public Instruction may take place in 2016.
