Senate committee substitute makes the following changes to the 1st edition. Makes technical change to act’s long title.  

Removes the prior contents of Part I of the act (the Protect Campus Survivors Act) and makes the following changes instead. Makes technical change to Part I’s catchline.

Enacts GS 132-1.3B, pertaining to records of student disciplinary proceedings held by public institutions of higher education. Defines disciplinary proceeding, personally identifiable information, and public institutions of higher education. Specifies that a public record does not include any record of a disciplinary proceeding that reveals personally identifiable information (as defined in the regulations governing the Family Educational Rights and Privacy Act-FERPA) about a student enrolled in a public institution of higher education, even if release is authorized under FERPA. Specifies that the statute does not limit the disclosure of a public record that does not contain personally identifiable information from a student’s disciplinary proceeding, including aggregated data, guidelines, instructions, or summaries. Makes conforming changes to GS 116-43.17 (confidentiality of certain records) and GS 115D-78 (access to information and public records). Applies to requests for records of a disciplinary proceeding that reveals personally identifiable information about a student submitted on or after the act becomes law.
