    Amends GS 20-11 by amending the conditions to be met for a person who is at least 16 years old but less than 18 years old to obtain a limited provisional license to require the person to have held a limited learner's permit issued by the Division for at least six months (was, nine months under the previous edition and 12 months under current law).

    Eliminates the proposed uncodified provisions of previous Section 2 of the bill, which authorized the Division of Motor Vehicles (DMV) to certify commercial driver training school licensed under Article 14 to administer road tests required by Article 2 of GS Chapter 20, with DMV oversight. Eliminates related reporting requirements. Makes conforming deletions to the proposed changes to GS 20-11(d)(3). Makes conforming changes to the act's long title.

    Deletes the proposed changes in GS 20-11(c) which would have restricted driving hours for those driving with a limited learner's permit to restrict driving hours to between the hours of 5:00 am and 9:00 pm for the first three months (currently law is first six months) after permit issuance, and specifies that after the first three (current law is six) months after issuance, the permit holder may drive at any time. Also amends the requirements to be met in (d) in order for a person who is at least 16 years old but less than 18 years to obtain a limited provisional license, to require the person to have held a limited learner's permit for at least nine (was, six, current law, 12) months.

    Senate committee substitute amends the 1st edition as follows.

    Makes organizational changes regarding the proposed changes to GS 20-11, separating the proposed changes to subsections (c) and (d). Makes clarifying changes regarding the effective date of the act.

    No longer eliminates the requirement of passing a road test from the limited provisional drivers license requirements for persons at least 16 but less than 18 years old, set out in GS 20-11(d). Instead, requires passing a road test administered by the Division or Motor Vehicles (DMV) or by a commercial driver training school certified by the DMV to administer road tests (currently, only DMV administered road tests are permitted).

    Deletes the previous provisions mandating the DMV to use third-party vendors to administer the road tests. Instead, authorizes the DMV to certify commercial driver training school (training schools) licensed under Article 14 to administer road tests required by Article 2 of GS Chapter 20. Requires the DMV to oversee road tests administered by training schools. Requires documentation of passing applicants to be submitted to the DMV as the DMV specifies prior to license issuance. Directs the DMV to report to the specified NCGA committee by November 1, 2021, including the number of training schools certified, the change in the number of available road tests and the change in the number of days an applicant must wait to take a road test, and the effect on DMV customer service, or if no training schools are certified by November 1, 2021, the reasons for not implementing the provisions, and all measures taken and their effect to reduce wait times and improve customer service for road tests. 

    Makes conforming changes to the act's long title.

    Amends GS 20-11 as follows. Amends the driving restrictions on those driving with a limited learner's permit to restrict driving hours to between the hours of 5:00 am and 9:00 pm for the first three months (was, first six months) after permit issuance, and specifies that after the first three (was, six) months after issuance, the permit holder may drive at any time. Amends the requirements to be met in order for a person who is at least 16 years old but less than 18 years to obtain a limited provisional license, to require the person to have held a limited learner's permit for at least six (was, 12) months; also removes the requirement of passing a road test.

    Requires the Division of Motor Vehicles (DMV) to use third-party vendors to administer the road tests required by Article 2 of GS Chapter 20. Requires each vendor to obtain a certification from DMV that the test complies with criteria and training developed by DMV. Allows vendors to charge a fee for the road test and requires any road test fee charged by a private vendor to be deducted from the fee charged by DMV for the license for which the applicant is required to take the road test. Requires DMV to maintain oversight of the road tests conducted by vendors. Requires DMV to report to the specified NCGA committee by November 1, 2021, on specified information related to this requirement.
