AN ACT GRANTING MECKLENBURG COUNTY, WHO WAS PREVIOUSLY GRANTED AUTHORITY TO EXTEND COUNTYWIDE JURISDICTION TO THE POLICE DEPARTMENT OF THE CITY OF CHARLOTTE, AUTHORITY TO EXTEND LAW ENFORCEMENT AUTHORITY TO AN INDIVIDUAL TOWN WITHIN THE COUNTY FOR THE AREA WITHIN THAT INDIVIDUAL TOWN'S EXTRATERRITORIAL JURISDICTION. Enacted June 22, 2017. Effective June 22, 2017.

Senate committee substitute makes the following changes to the 2nd edition.
Deletes proposed amendments to, and current text of, SL 1969-1170, Section 1. Subject to the approval of the Board of Commissioners, authorizes Mecklenburg County and the City of Charlotte to enter into an agreement to extend the powers and rights of Charlotte police officers within the City of Charlotte and throughout Mecklenburg County. Subject to the approval of the Board of Commissioners, authorizes Mecklenburg County and any municipality in Mecklenburg County to enter into an agreement to extend the powers and rights of that municipality's police officers within that municipality and throughout that municipality's extraterritorial jurisdiction. Under these agreements, these officers would have the same privileges, immunities, and workers' compensation coverage throughout their expanded territory as within Charlotte or their municipality, respectively. Requires the agreements to be made prior to the exercise of powers or authority of an officer, and to set forth the guidelines and procedures to implement this act. Does not restrict or prohibit the Sheriff of Mecklenburg County from exercising the powers and authority of that office.

Amends proposed changes to Section 1 of SL 1969-1170 to clarify that the powers that may be extended in an agreement between Mecklenburg County and any municipality in the county include jurisdiction (instead of extraterritorial jurisdiction). Adds that nothing in Section 1 authorizes police officers in Mecklenburg County to exercise any power or right outside of their original jurisdiction that they cannot exercise within their original jurisdiction.

Amends Section 1 of SL 1969-1170 to allow the Mecklenburg County Board of Commissioners (BOC) to authorize the police departments of the towns of Cornelius, Davidson, Huntersville, Matthews, Mint Hill, and Pineville, in addition to the existing authorization for the City of Charlotte police, to exercise general policing power throughout the unincorporated areas of Mecklenburg County, as designated by the Board of Commissioners. However, removes service of civil process from the grant of jurisdiction, authority, powers, and rights. Provides that officers will have the same privileges and immunities in this extended jurisdiction as in their respective municipality, as long as the municipality and Mecklenburg County enter into an agreement setting forth guidelines and procedures for implementation of this act. Provides that the BOC cannot approve this extended exercise of power and authority to unincorporated areas of the county that fall within the sphere of influence or extraterritorial jurisdiction of another municipality, unless such a municipality consents in writing. Clarifies that nothing in this section restricts or prohibits the authority already granted to the police officers of the City of Charlotte over unincorporated areas of the county as it stands on or before the date this act becomes effective. Further, clarifies that nothing in this section restricts or prohibits the Sheriff of Mecklenburg County from exercising the powers and authority of the Sheriff's Office. Makes conforming and clarifying changes.
