Enacted July 13, 2015. Effective July 13, 2015.

Senate committee substitute makes the following changes to the 2nd edition.
Amends the long title.
Directs the Commission for Public Health (Commission) to amend 15A NCAC 18A .1956(7)(d) (Modifications to Septic Tank Systems: Sand Lined Trench System Rule) to provide that a Public Management Entity with a Certified Operator is not required for sand lined trench systems when drainage is utilized to lower the water table on a site. Provides that the above rule is to be implemented until a substantively identical permanent rule is adopted as specified.
Directs the Department of Health and Human Services or the Commission to repeal 15A NCAC 18A .1956(6) (Modifications to Septic Tank Systems: Saprolite System Rule) on or before December 1, 2015. Further provides that until the repeal is effective, no state agency or local government can implement or enforce the Saprolite System Rule.
Makes technical changes.

Directs the Commission for Public Health and the Department of Health and Human Services to enact a temporary rule, to replace 15A NCAC 18A .1945, "Repair Reserve Rule," concerning septic tanks, that allows a repair area that accommodates replacement systems as specified. Provides that the temporary rule is effective until the Commission for Public Health adopts the permanent rule to replace the Repair Reserve Rule. Requires the permanent rule to be substantively identical to the temporary rule. Provides that the permanent rule will become effective as though 10 written objections have been received, pursuant to the rule-making provisions of the Administrative Procedure Act, GS Chapter 150B, Article 2A.
