Senate amendment makes the following changes to the 2nd edition.
Adds new subsection to GS 14-401.18A, enacted in this act, to make it a Class A1 misdemeanor for any person, firm, or corporation to sell, offer for sale, or introduce into commerce in this state an e-liquid container for an e-liquid product that contains nicotine unless the packaging states that the product contains nicotine.
Re-letters the subsections accordingly.
Changes the long title to reflect the added bill content.

Amends proposed GS 14-401.18A, definitions for use in the section concerning e-liquid containers, making technical and clarifying changes. Deletes a requirement that e-liquid containers must be labeled with safety warnings consistent with rules adopted by the NC Commission for Public Health. Makes organizational changes.
Deletes proposed changes made to GS 130A-29(c).

Enacts new GS 14-401.18A to make it illegal for any person, firm, or corporation to sell, offer for sale, or introduce into commerce in this state an e‑liquid container unless the container meets all of the following requirements: (1) constitutes child‑resistant packaging and (2) is labeled with safety warnings consistent with rules adopted by the North Carolina Commission for Public Health. Violations are a Class A1 misdemeanor and violators are liable in damages to any injured person. Defines child-resistant packaging, e-liquid, e-liquid container, and vapor product.
Amends GS 130A-29 to require the North Carolina Commission for Public Health to adopt rules establishing standards for safety warnings to be included on labels for e-liquid containers.
Effective December 1, 2015, applying to offenses committed on or after that date.
