    House committee substitute to the 2nd edition makes the following changes. Amends definition of electric vehicle charging station so that it is a parking space (not a public or private parking space) served by charging equipment that has as its primary purpose the transfer of electric energy to a battery or other energy storage device in an electric vehicle.  Amends new GS 20-162.4 (parking in an electric vehicle charging station space) to specify that an owner of private property may elect, but is not required, to designate an electric vehicle charging station  located on the owner's property with a sign as provided in GS 120-162.4(b), in which case no person may park a vehicle in the space so designated if the vehicle is not connected to the charging equipment. Reduces the penalty for parking in an electric vehicle charging station space from $100 to $50.

    Amends new GS 20-162.4 to prohibit parking a vehicle in a space designated with a sign as an electric vehicle charging station located (previously did not refer to the signage requirement) on public or private property if the vehicle is not connected to the charging equipment. Specifies that a space designated as a parking space for handicapped persons that is served by charging equipment may not be designated as an electronic vehicle charging station.

    Adds to GS 20-4.01 to define electric vehicle charging station to mean a public or private parking space that is served by charging equipment that has as its primary purpose the transfer of electric energy to a battery or other energy storage device in an electric vehicle.

    Enacts GS 20-162.4 to prohibit parking a vehicle in an electric vehicle charging station located on public or private property if the vehicle is not connected to the charging equipment, punishable as an infraction and fine of $100. Details signage required of a space designated as an electric vehicle charging station. Permits municipalities to, by ordinance, prohibit additional conduct and provide higher penalties regarding parking in a space designated as an electric vehicle charging station. Requires enforcement by the State, county, city, and other municipal authorities in their respective jurisdictions in the same manner as other parking laws and ordinances are enforced.

    Enacts GS 143-139.5 prohibiting electric vehicle charging stations that use parking spaces in parking lots or parking garages from displacing handicapped accessible parking spaces.

    Applies to offenses committed on or after December 1, 2023.
