AN ACT TO ALLOW THE DRIVER OF A VEHICLE TO OVERTAKE AND PASS SLOWER MOVING VEHICLES ON PORTIONS OF THE HIGHWAY WHICH ARE MARKED BY SIGNS, MARKERS, OR MARKINGS PLACED BY THE DEPARTMENT OF TRANSPORTATION STATING OR CLEARLY INDICATING THAT PASSING SHOULD NOT BE ATTEMPTED.

    Amends GS 20-150(e) as the title indicates. Specifies that unless the following conditions exist, the signs, markers, or markings, placed by the Department of Transportation, prohibiting passing are to be followed and no passing is to be attempted:

    (1) the slower moving vehicle to be passed is proceeding at less than half the speed of the posted speed limit;

    (2) the faster moving vehicle is capable of overtaking and passing the slower moving vehicle without exceeding the posted speed limit;

    (3) the faster moving vehicle can overtake and pass at least three feet to the left of the slower moving vehicle; and

    (4) visibility is clear and there is no oncoming traffic to the left side of the center of the highway, allowing for a sufficient distance to permit safe passing.

    Makes a conforming change to GS 20-149(a).

    Effective December 1, 2015, and applies to offenses committed on or after that date.
