AN ACT TO AUTHORIZE THE DELAY OF THE 2021 ELECTIONS FOR THE CHARLOTTE-MECKLENBURG BOARD OF EDUCATION IF CENSUS DATA IS NOT AVAILABLE TO THE BOARD OF EDUCATION BY A DATE CERTAIN.

    Provided that the federal decennial census information for 2020 has not been received by the Charlotte-Mecklenburg Board of Education (Board) by July 19, 2021, bars holding elections for the Board in 2021. Requires members elected to the Board in 2017 and any persons filling vacancies for those terms to hold over in office until their successors are elected and qualified. Requires elections for the Board to be held at the general election for county offices in 2022, with candidates filing their notices of candidacy between noon on July 25, 2022, and noon on August 12, 2022. Provides for terms of members elected in 2022 to commence on December 6, 2022, and expire on December 25, 2025. Requires the Board of adopt a resolution prior to July 26, 2021, stating its failure to receive the federal census information and that the next election for the Board will occur at the 2022 election as provided by this act. Requires the Board to publish notice of the delay on its website and at least once in a newspaper of general circulation within seven days of adoption of the resolution. Requires the resolution be submitted to the Mecklenburg Board of Elections and the State Board of Elections prior to July 26, 2021.
