    House amendment makes the following changes to the 3rd edition.

    Modifies the proposed provisions to require the Wake County Board of Commissioners to consider, rather than the previously proposed mandated inclusion of, the Ten-Ten (Fairview) Fire Protection Oversight Board's recommendation in its adopted budget. Removes the requirement that the Wake Commissioners execute any contracts recommended by the Oversight Board.

    Modifies the period in which the Wake Commissioners must continue the same provision of services to the properties described in the same manner as provided on the date the act becomes law, removing the sunset for the mandate, which previously limited the requirement to the remainder of the 2018-19 fiscal year.

    Requires the Wake County Board of Commissioners to furnish their accounting for the fire district taxes on properties provided fire protection services by the Ten-Ten (Fairview) rural fire protection district to the Ten-Ten (Fairview) Fire Protection Oversight Board (Board) on March 1 and at other times upon the request of the Board (previously, only furnished upon request by the Board). Prohibits the Board's budget recommendation to the Wake County Commissioners required by the act from exceeding the amount reported to the Board on March 1.

    Changes the act's long title.

    Creates the Ten-Ten (Fairview) Fire Protection Oversight Board (Board), charged with governing the fire protection services provided to properties located within the Ten-Ten (Fairview) rural fire protection district in Wake County, as the district existed on July 1, 2018. Provides for member appointment to the Board, with initial members required to be appointed on or before March 1, 2019. Requires the Wake County Board of Commissioners to separately account for the fire district taxes levied and collected on the described properties and furnish the Board the information upon request. Requires the Board to submit recommendations to the Wake County Commissioners regarding the annual budget and provision of services on or before April 30 of each fiscal year. Requires the Wake County Commissioners to include the Board's recommendations in its adopted budget and execute any recommended contracts. Directs the Wake County Commissioners to continue providing the same fire protection services to the properties located within the described district in the same manner as it is provided on the date the act becomes law for the remainder of the 2018-19 fiscal year. Applies to Wake County only.

    House committee substitute makes the following changes to the 1st edition.

    Changes the name of the fire protection district to the Ten-Ten (Fairview) (was, Fairview only) fire protection district. Adds that the proceeds of the reestablished tax collected within the boundaries of the Ten-Ten (Fairview) fire protection district, less the cost of administering and collecting the tax (not to exceed two percent) of the amount collected each year must be remitted to the special fund described in GS 69-25.7. Makes additional clarifying changes.

    Amends GS 69-25.7 by reinstating the language deleted in the previous edition and limiting the scope of those provisions to fire protection in portions of Wake County excluding the Ten-Ten (Fairview) fire protection district. Makes organizational changes but retains the provisions requiring the special fund for the tax to be administered to provide protection within the Ten-Ten (Fairview) fire protection district by the Fairview Fire Protection District Commission with appointments and terms as previously specified. These provisions apply to the portion of Wake County designated as of the effective date of the act within the boundaries of the Ten-Ten (Fairview) fire protection district.

    Enacts the following, applicable to Wake County only.

    Directs the Wake County Board of Commissioners to (1) reestablish the fire protection tax to be levied within the boundaries of the Fairview fire protection district at the same rate as that currently levied in the Wake County fire protection district; and (2) remove the Fairview fire protection district from the Wake County fire protection service district and from the jurisdiction of the Wake County Fire Commission. 

    Provides that all firefighting apparatus and equipment located at either station of the Fairview Rural Fire Department (Department) becomes the property of the Department, except any vehicle or associated equipment under a contract for the provision of services other than fire protection. Further provides that all funds collected by the Department held administratively by Wake County remain the property of the Department and available only for use at the direction of the Department's Board of Directors.

    Amends GS 69-25.7, establishing the Fairview Fire Protection District Commission in order to administer the funds from the fire protection tax. Provides for the appointment and terms of commissioners.
