Bill summary

Senate committee substitute makes the following changes to the 2nd edition.

Adds Clay County to the act as follows.

Repeals Chapter 254 of the 1991 Session Laws, which changed the manner of election of the Clay County Board of education to nonpartisan.

Adds that the Clay County Board of Education (board) consists of five members elected for four-year terms. Requires, beginning in 2016, that board members be elected on a partisan basis and requires candidates for the board be nominated at the same time and manner as other county officers. Requires vacancies for positions elected on a nonpartisan basis in 2012 or 2014 to be filled by appointment made by the remaining members, and beginning in 2016 vacancies on the board for positions elected on a partisan basis must be filled according to GS 115C-37.1. Provides that this does not affect the terms of office of any person elected in 2012 or 2014 to the board.

Amends GS 115C-37.1 (concerning the filling of partisan elected positions) to add that the provisions of the statute also apply to Clay County, effective the first Monday in December 2016.

Makes clarifying changes.

Amends the act's short and long titles.
