Senate committee substitute makes the following changes to the 1st edition.
Amends GS 14-34.7 to place the crime of assaulting a member of the National Guard in the section of criminal law relating to certain assaults (was, assaults inflicting serious injury) on a law enforcement officer, probation officer, parole officer, or a person employed at a state or local detention facility (was, placed the crime of assaulting a member of the North Carolina National Guard (National Guard) in GS 14-34.6, which relates to assault or affray on first responders including firefighters, emergency medical technicians, medical responders, and emergency department personnel).
Provides that unless some other provision of law provides greater punishment, a person who assaults a member of the National Guard while that member is discharging or attempting to discharge his or her official duties and inflicts serious bodily injury on the member is guilty of a Class F felony.
Makes clarifying changes to subsection (b) of GS 14-34.7.
Provides that unless some other provision of law provides greater punishment, a person who assaults a member of the National Guard while that member is discharging or attempting to discharge his or her official duties and inflicts physical injury on the member is guilty of a Class I felony.
Amends GS 14-34.5 to provide that any person who commits an assault with a firearm on a member of the National Guard while the member is performing his or her duties is guilty of a Class E felony.
