Amends GS 115D-2.2, as enacted by SL 2021-90, which provides for the legislative selection of State Board of Community College (State Board) members. Modifies the language to provide for the election rather than the selection of State Board members. Makes conforming changes to the act's titles.

Enacts GS 115D-39(e), deeming a US citizen eligible to receive the State resident community college tuition rate for the school year immediately following the student's graduation from high school if the following criteria are met. Requires that (1) the individual satisfied the qualifications for assignment to a public school under state law, (2) the individual was enrolled in a NC public school for the entirely of the final school year before receiving a high school diploma from the public school unit, and (3) the individual was unable to establish residency for tuition purposes through the determination processed administered by the State Education Assistance Authority due to lack of evidence.
