AN ACT TO DIRECT THE STATE BUREAU OF INVESTIGATION TO ESTABLISH AND IMPLEMENT A USED NEEDLE AND HYPODERMIC SYRINGE DISPOSAL PILOT PROGRAM. Enacted October 22, 2015. Section 2 is effective December 1, 2015. The remainder is effective October 22, 2015.

House committee substitute makes the following changes to the 1st edition.
Requires two counties to be selected to participate in the pilot program initially but allows selecting up to four counties total in which to operate the pilot program after successfully demonstrating the pilot in at least two counties. Amends the reporting requirement to allow a recommendation to continue the pilot in the initial counties for an additional year as well as adding two additional counties to the program. Requires the State Bureau of Investigation to provide another report at the conclusion of that second year.

Requires the State Bureau of Investigation (SBI) to establish and implement a used needle and hypodermic syringe disposal pilot program no later than December 1, 2015, with the purpose of reducing the spread of HIV, AIDS, viral hepatitis, and other bloodborne diseases. Sets out requirements for the program, including reasonable and adequate security of disposal sites and equipment.
Directs the SBI to select two counties in which to operate the pilot program. Requires the SBI to work with local health departments and law enforcement in regards to implementation of the program.
Provides limited criminal immunity, as specified, for individuals participating in the pilot program.
Requires the SBI to to report results of the program to the chairs of the Joint Legislative Oversight Committee on Health And Human Services and the Joint Legislative Oversight Committee on Justice and Public Safety no later than a year after implementation of the program. Provides that the pilot program expires once the above report has been submitted.
Amends GS 90-113.22(c) concerning the possession of drug paraphernalia adding language that allows individuals to alert a law enforcement officer that they are in possession of a needle or other sharp object and not be charged for any residual amounts of a controlled substance remaining in the needle or sharp object (previously, only exempted charges for the possession of the needle or sharp object as drug paraphernalia). Effective December 1, 2015.
