AN ACT TO ESTABLISH A REQUIREMENT FOR THE NORTH CAROLINA CRIMINAL JUSTICE EDUCATION AND TRAINING STANDARDS COMMISSION AND THE NORTH CAROLINA SHERIFFS' EDUCATION AND TRAINING STANDARDS COMMISSION TO UTILIZE THE NATIONAL DECERTIFICATION INDEX MAINTAINED BY THE INTERNATIONAL ASSOCIATION OF DIRECTORS OF LAW ENFORCEMENT STANDARDS AND TRAINING IN THE CERTIFICATION PROCESS FOR CERTIFIED PERSONNEL.

Bill summary

Amends GS 17C-6(a) (powers of the NC Criminal Justice Education and Training Standards Commission) to give the Commission the power to search the National Decertification Index (NDI) using applicant information for applicants for certification or lateral transfer and to use records of convictions resulting from the search to determine if an applicant is disqualified from certification or lateral transfer. Amends GS 17E-4(a) (powers of the NC Sheriffs Education and Training Standards Commission) to add subsection (17) mirroring the above changes to GS 17C-6(a). These provisions are effective October, 1 2021 and apply to applications submitted on or after that date.
Amends GS 150B-38 (Other Administrative Hearings – Scope; Hearing Required; Notice; Venue) by adding Subsection (a1) exempting the NC Criminal Justice Education and Training Standards Commission and the NC Sheriffs Education and Trainings Standards Commission from the provisions of this section. This provision is effective October 1, 2021, and applies to any contested case arising on or after that date.
